A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR-FIFTHS ( 4 / 5Txs )
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S FINDINGS OF AN
EMERGENCY(S), WAIVING THE REQUIREMENTS FOR
COMPETITIVE SEALED BIDDING PROCEDURES AS
DESCRIBED ON THE EXHIBIT(S) ATTACHED AND
INCORPORATED; ALLOCATING FUNDS FROM THE
BUDGETS OF VARIOUS USER DEPARTMENT ACCOUNTS.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. By a four-fifths (4/5th,) affirmative vote,
the City Manager's findings of an emergency(s), waiving the
requirements for competitive sealed bidding procedures as
described on the exhibit(s) attached are ratified, approved and
confirmed, with funds allocated from the budgets of various user
department accounts.

This memo serves to request your approval to waive formal bids and proceed with emergency
repairs to the Manuel Artime Community Center. Funds are available, and must be expended this
fiscal year, from CDBG Allocation, CIP #322060.
Repairs are immediately required to fix damaged floor tile, and install emergency exit stairs at the
office building at 970 S.W. ls` Street, and to outfit doors at the 900 Building*with panic hardware.
Additionally, it is necessary to replace handrails, and install a lifter and a handicapped ramp to
comply with ADA requirements at the 900 Building and the Theater. These repairs are necessary
to ensure the safety of the tenants, guests and visitors to the buildings and the Theater.
Other repairs, as outlined on the attached list, are critical to the operation of the buildings to
provide uninterrupted service to the tenants, and to ensure the well being and safety of the tenants,
visitors and citizens. served by the Manuel Artime Community Center.

Emergency A/C Air
Handlers Replacement
This memorandum serves to request your authorization to proceed on an emergency basis
to replace the AIC air handlers at the Coconut Grove Convention Center. Further, to
direct the Department of Public Works to obtain five informal bids, and to direct the
Department of Management and Budget to identify the necessary funds to complete this
project.
As you are aware, the air conditioning condenser units were recently replaced at the
Coconut Grove Convention Center, using CIP funds allocated for the center. Since the
amount of CIP funding allocated was half of our original request, our intention was to
replace the rooftop condenser units with the funds available, and seek additional CIP
funding to replace the air handlers at a later date. However, we .nave now been made
aware by Aero. Cooling, the contractor awarded the bid to install the condenser units, that
the technology has changed so much between the new equipment and the outdated air
handlers that these systems are now incompatible.
The major manu£rctiuers contacted about the air handlers have advised that they do not
manufacture this equipment anymore. The new condenser units have been modified to
accommodate the air handlers, which are operating at low efficiency.
We have been warned by both the manuf ictim and the contractor that we will eventually
lose compressors in the new equipment, resulting in expensive repairs to the system if the
air handlers are not replaced. We have consulted with the City's Mechanical Inspectors,
who confirmed these findings. Additionally, I am enclosing reports from Public Wodm
and the City's Chief Air Conditioning Mechanic who are all in agreement that the air
handlers must be replaced. Upon doing so, the system will operate more efficiently, and
will result in savings on electrical usage.
Today, we were advised by Aero Cooling that since the new equipment has been installed
on May 12th, we have already lost one compressor, and risk additional system failure.

Due to this new development, and the importance of a fimcdoning air condition system to
the convention center operations, we now seek your avtborizatiion to replace the air
handlers on an emergency basis.
The estimated cost for this project is approximately sm o00.o0. Additionally, we seek
your authorization for the Budget Depatnemt to encumber these funds from the
appropriate source.

I have enclosed a memo from the Public Works Department that underscores the need for
the additional work, estimated at $40,000.
The funding has been secured and approved by the City Commission through emergency
ordinance 11909.
