RESOLUTION NO. 03- 4 91
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE EXPENDITURE OF $193,000 TO
UNDERWRITE THE "HEARTS OF OUR PARKS"
CULTURAL AND RECREATIONAL PROGRAMMING SERIES
FOR THE SUMMER OF 2003, MANAGED BY THE
DEPARTMENT OF PARKS AND RECREATION;
ALLOCATING FUNDS FROM PROJECT ACCOUNT
NO. 119002, ENTITLED "DEPARTMENTAL
IMPROVEMENT INITIATIVE;" AUTHORIZING THE
CITY MANAGER TO NEGOTIATE AN AGREEMENT, WITH
THE DADE COMMUNITY FOUNDATION FOR THE
ESTABLISHMENT OF A DONOR -ADVISED ENDOWMENT
FUND AND A DONOR -ADVISED OPERATING FUND;
FURTHER DIRECTING THE CITY MANAGER TO
PRESENT THE AGREEMENT TO THE CITY COMMISSION
FOR CONSIDERATION WITHIN 60 DAYS.
WHEREAS, Ordinance No. 012276, adopted September 11, 2002,
amended the City of Miami's ("City") Financial Integrity
Principles and created a Special Revenue Fund to capture surplus
revenue at the end of each Fiscal Year from the Department of
Parks and Recreation; and
WHEREAS, the use of budget surpluses allocated to the
Special Revenue Fund, pursuant to Section 18-542(4)(b) of the

City's Code, shall be limited to the purchase of parks
recreational and maintenance equipment and the direct operations
of recreational programs in and for the City's parks, subject to
appropriation by the City Commission; and
WHEREAS, the City Commission seeks to appropriate funding
to support recreational and cultural programming as part of the
"Heart of Our Parks" series, managed by the Department of Parks
and Recreation, for the Summer of 2003; and
WHEREAS,
the City
Commission
wishes
to
create a
donor -advised
Endowment
and Operating
Fund
that
will help
underwrite such programming in perpetuity;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The expenditure of $193,000 to underwrite
the 2003 "Hearts of Our Parks" cultural and recreational
programming series for the summer of 2003, managed by the
Department of Parks and Recreation is authorized, with funds

allocated from Project Account
"Departmental Improvement Initiative."

Section 3. The City Manager is authorized!' to negotiate
an agreement, with the Dade Community Foundation ("DCF") for the
establishment of a donor -advised Endowment fund anr3 a
donor -advised Operating fund, to be known as the "Hearts of Our
Parks Endowment Fund" and the "Hearts of Our Parks Operating
Fund," with the DCF.
Section 4. The City Manager is directed to present the
negotiated agreement to the City Commission for consideration
within 60 days.
Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'

The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.
If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the
City Commission.

Parks Trust Fund — "Hearts of
Our Park" Summer Series
I would respectfully recommend that you adopt the attached Resolution authorizing the
expenditure of $193,000 from the Project No. 119002 — Departmental Improvement
Initiative — to support summer recreational and cultural programming as part of the
"Hearts of Our Parks" series. The requested funding represents a portion of the
available funding in that account which consists of past Parks & Recreation Department
surpluses and the surplus funding from the Mayor's Office Fiscal Year 2002-2003
budget.
Background:
In July of 2002, my office presented a series of recommendations amending the Chapter
18, Article IX, Division H — Financial Integrity Principles - of the City of Miami Code.
Among those recommendations was included a change which established a Special
Revenue Fund to capture surpluses generated by the Parks & Recreation Department at
the end of each fiscal year. The changes to the Financial Integrity Principles Ordinance,
adopted on second reading on September 11, 2002, in addition to the allocation of an
additional $500,000 to the newly established account has resulted in a fund balance
totaling $865,948.
Pursuant to Section 18-542(4) (b) of the Code, the existing fund balance can be used to
for the purchase of parks recreational and maintenance equipment and to support the
direct operations of recreational programs in and for the city's parks, subject to
appropriation by the City Commission. The enclosed resolution authorizes the
expenditure of $193,000 of the current fund balance to support the following activities
that compose the "Heart of Our Parks " series. The programs listed below are scheduled
to take place from the months of June — August of this year.

Programs
• ACE Academy (Art, Culture and Entertainment)
Program Description: The program, offered on Mondays, Wednesdays, and
Fridays to all summer participants that have an interest in the arts, will
include:
• Instructional, cultural dance workshops;
• Middle and High School band camps; and
• Arts programs that specialize in the area of photography, graphic arts,
sculpture, and more.
The following partners will facilitate the summer programs:
• Arts for Learning
$50,000
Partner parks: Duarte, Grapeland, Coral Gates, Robert King High,
Momingside, and Reeves
• The Face of Dance
$30,000
Partner parks: Clemente, Gibson, Kinloch, Legion, Range and Shenandoah
• The Mayor's Band Camp $ 8,000
Partner park: Curtis
• Summer Academic Camp (SAC)
Program Description: SAC consists of a summer tutoring program that will
be offered on Tuesday's and Thursday's to all summer participants that need
remedial assistance. The program will have a strong emphasis on improving
reading and math skills and will also assist students with preparing for the
Florida Comprehensive Assessment Test (FCAT).
The following partners will facilitate the summer programs:
• Police Athletic League/FOCAL $10,000
• Hearts of Our Parks Summer Concert Series
Program Description: This component consists of a neighborhood monthly
music series that will include live local bands, arts and crafts, cultural foods,
games, and much more. The events are created to promote family and

community pride and will take place in parks in Allapattah, Model City, Coral
Way, Little Havana, Overtown, Wynwood, and Little Haiti.
Cost for the summer concert series total $95,000. A breakdown of
expenditures related to the concert series is listed below:
Talent $42,000
Sound $25,000
Transportation $ 8,000
Support staff (Coordinator) $10,000
Marketing/Promotion $10,000
Total Series Cost: $95,000
In addition to authorizing the above listed expenditures, the accompanying Resolution
also authorizes the City Manager to enter into negotiations with the Dade Community
Foundation (DCF) regarding the establishment of a two donor -advised funds. It is our
intention to work with the Dade Community Foundation to launch a capital campaign to
support the creation of an endowment fund that will help to fund expanded recreational,
cultural, and educational programming at parks throughout the city. The establishment of
these funds will allow the City to solicit and accept donations from a variety of corporate,
public, and philanthropic sources.
The Dade Community Foundation is a not-for-profit community foundation with more
than $70 million in assets dedicated to supporting the work of non-profit organizations
throughout Miami -Dade County. DCF currently operates nearly 300 donor -advised
funds from a diverse range of donors, which support a diverse range of causes. Members
of my staff have met with representatives of the Dade Community Foundation to
determine the feasibility of such an effort. DCF staff and my staff concur that they can
meet the city's goals in designing a workable trust that will help us leverage city assets,
while allowing the Parks Department and its respective advisory boards the necessary
flexibility to design and implement the desired programming.

Message From The President
Several years ago the then Dade Community Foundation held a
planning session to determine its role in this community. Grass
roots, civic, business and political leaders worked with us to fashion
a mission with a focus on building community and meeting the
emerging needs of Greater Miami. An integral part of this mission
included the establishment of a permanent endowment - our
community savings account - and a process of effective grant
making.
The goal of each grant we have funded through the years has been
to strengthen relationships between and among the diverse
residents of this community. We consider all grant proposals from
nonprofit agencies in the context of this commitment. Grants are
made in the full sweep of education, arts and culture, environment,
economic development, social justice, religion, health and human
resources. With assistance from national foundations we have
initiated special grant making programs, all with the overarching
goal of bringing our diverse ethnic and social groups together in
constructive relationships.
As this community continually seeks ways to work together, ways
to understand the passion that swells in every conversation, I
applaud the mediating influence of the nonprofit agencies and the
work they do every day in bringing the residents of our community
closer together.
Building an endowment to support the great work of the local
nonprofit sector is the primary business of the Foundation. Dade
Community Foundaiton is committed to the values of inclusiveness,
diversity, equal opportunity, equity and community development. As
an agent of civil society and the public good, this is an institution
whose permanent concern is Miami -Dade County, but we know
that happens across the globe, across the country and across the
street has direct implications for each of us.
Dade Community Foundation offers our knowledge of the
community to all who are interested in helping others who have
been working at building our community through the years - our
nonprofit organizations. We do not need to create anything new.
We do need to support the agencies that provide the safety net for
those in need and enrich all our lives. How fortunate we are to have
these organizations in place. Since our establishment in 1967, this

Mission Statement
Dade Community Foundation exists to enhance the quality of
life for all residents of Miami - Dade County. Our mission is to
encourage philanthropy and charitable giving by developing a
permanent endowment to meet current and future emerging
charitable needs. The Foundation approaches our grantmaking
not solely in terms of program categories, but rather with a
focus on community building. By bringing together diverse
groups in Miami -Dade County we help improve the quality of
life and build a more cohesive community. We have committed
our resources to trying to reduce cultural and social
fragmentation and strengthen the fabric of our community. We
consider all grant proposals in the context of this commitment.
Dade Community Foundation protects and manages the assets
of philanthropic funds and provide grant making expertise to
donors with various interests at all levels of giving. The
Foundation supports local nonprofit organizations with grants
and technical assistance. It makes grants in the broad program
areas of education, health, human services, arts and culture,
environment, community and economic development. In
addition to our unrestricted funds, our grantmaking through field
of interest funds addresses the needs of the economically
disadvantaged, abused and neglected children, immigrant and
refugee populations, people with HIV/AIDS, homelessness,
social justice, black affairs, care of animals, and heart disease.

The History of Dade
Community Foundation
Dade Community Foundation was created in 1967 as Greater
Miami's permanent philanthropic endowment. A nonprofit tax-
exempt organization, the Foundation manages funds to support
the emerging charitable needs of Miami -Dade County. For 35
years, the Foundation has served individuals, families,
corporations, private foundations, and charitable organizations
by providing information on the benefits and options of
philanthropy. We offer insight into community priorities, and
supply a stable, tax -advantaged financial structure to maximize
donations and to assure their viability in perpetuity.
Dade. Community Foundation puts the value of local people into
action by pooling funds from donors and making grants focused
on concrete programming for sound purposes. Our professional
staff can assist donors and assure effective grant making. The
Foundation's Board of Governors identifies local emerging
issues and targets gaps in community services that need to be
addressed. Our Board of Governors establishes the overall
investment policy and monitors the performance of the financial
institutions. Several banks, trust companies, and money
managers safeguard and invest Foundation funds and our
accounts are audited annually by an independent firm. Dade
Community Foundation gives its donors permanence,
accountability, flexibility and expertise.

Board of Governors
Dade Community Foundation is governed by a twenty-one member
Board of Governors, which establishes policy, oversees financial
management, and approves grants and awards. Members serve
without compensation and for a maximum of two terms of three
years. They are selected for their judgment, integrity,
understanding of philanthropic needs, and diverse knowledge of
the Greater Miami area. This group of distinguished community
leaders represents Greater Miami's diversity as they serve as the
source of the Foundation's intellectual capital, providing sage
advice and demonstrating their commitment to community.

Commissioner Jimmy Morales, Esq. (Chair) is a shareholder
with Stearns Weaver Miller Weissler Alhadeff & Sitterson, P.A., is
the Miami -Dade County Commissioner for District 7. He serves as
chair of the Mayor's Task Force on Efficiency and Competition, and
is the County's representative to the Downtown Development
Authority, the Dade League of Cities, and the Florida Association of
Counties. He serves on the Board of Trustees for the Leadership
Florida Program.
:: Richard Milstein, Esq. (Vice Chair) is a shareholder in the
Miami office of Akerman, Senterfitt & Eidson, P.A. He serves on the
board of the SAVE DADE Foundation, Inc., and is counsel to the
Performing Arts Center Trust. He has received numerous awards,
including the Florida Supreme Court Tobias Simon Pro Bono
Service Award in 1996.
:: Maricarmen Martinez, A.I.A. (Secretary) is principal of Upstairs
Studio, Inc. Architects and a member of the Inaugural Class of the
Miami Fellows Initiative, a Foundation Special Initiative. She is Co -
Chair of the Bicentennial Park Design Committee, member of the
current class of Intemational Women's Forum Leadership
Foundation Fellows, and a Board member of Arango Design
Foundation, among other civic organizations.
:: Richard Lavina (Treasurer) is Senior Vice President of La Salle
Bank N.A., and serves on the advisory board of the Miami Museum
of Science and the Epiphany School Financial Review Committee.
::John R. Anzivino, CPA is the principal in charge of Kaufman,
Rossin & Co.'s Estate, Trust, and Exempt Organization
Department. His community involvement includes service on the
boards of the College Assistance Program, Fairchild Tropical
Garden, Leave a Legacy, and the Planned Giving Council of Miami -
Dade County.

:: Cristina Mendoza, Esq. is a former Senior Vice President
General Counsel and Secretary of HBO Latin America Media
Services, a former Vice President of Knight-Ridder, Inc., and a past
instructor at the University of Miami School of Law. She serves on
the New World Symphony Board of Directors and on The Bertha
Abess Children's Center Board of Directors, among other
organization.
:: Tomas Mestre is chair and CEO of Mestre Enterprises. He
currently serves on the Board of Directors of the Boys and Girls
Club of America, the Advisory Board of Baptist Hospital of
Homestead, the Board of the Magic City Foundation and the Board

N Charisse L. Grant, Director of Programs, manages grant making, special projects
directs the technical assistance programs. She provides grant making expertise to donor
