(PEICO), IN AN AMOUNT NOT TO EXCEED $180,000; ALLOCATING FUNDS FROM THE CAPITAL IMPROVEMENT PROGRAM, ACCOUNT CODE NO. 311009.299401.6.850. WHEREAS, the Department of Police has two underground fuel storage tank systems located at the North and South Substations, which store 2,000 gallons of fuel; and WHEREAS, these tanks fuel the emergency generators, which the Department of Police uses as a backup power source for operations in the event of loss of power due to catastrophic situations; and CITY COMXjS,%HW MEETING CK ;1 MAA n P. 2003 "aPOIUUOn No. 03- 478 WHEREAS, during the annual inspections the fuel tanks were leaking fuel which are required by law to be reported to the Department of Environmental Resources Management ("DERM") and the Environmental Protection Agency ("EPA"); and WHEREAS, Notices of Violations have been issued from DERM to the Department of Police for non-compliance at a rate of $8,000 per day; and WHEREAS, the City Manager approved the emergency removal and installation of two underground fuel storage tank systems and the installation of above ground fuel storage tanks, at the North and South Substations of the Department of Police, from U.S. Laboratories Professional Engineering and Inspections Company, Inc. (PEICO), in an amount not to exceed $180,000; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bidding procedures and approving the emergency installation/upgrade of the underground fuel storage tank systems at the North and South Substations of the Department of Police, from U.S. Laboratories Professional Page 2 of 3 03— 478 Engineering and Inspections Company, Inc. Lauderdale, FL 33325, in an amount not to exceed $180,000. Funding is available for the Capital Improvement Program, Account Code No. 311009.299401.6.850. BACKGROUND The Miami Police Department (MPD) has two underground fuel storage tank (UST) systems at the North and South substations, which store 2,000 gallons of fuel. These tanks fuel the emergency generators, which are utilized as a backup power source for Police Department operations in cases of loss of power due to catastrophic situations. As per Department of Environmental Resources Management (DERM) and Environmental Protection Agency (EPA) requirements, MPD conducts annual inspections and cathodic protection tests to assure the integrity of the fuel tank system lines. During one of these inspections, it was discovered that the South Substation's tank was leaking fuel under ground. As required by law, MPD reported this finding to both DERM and EPA. Notices of Violations from the Miami -Dade County Department of Environmental Resources Management have been issued to MPD for the non-compliant UST systems at both sites. Failure to comply will result in the assessment of fines at a rate of $8,000 per day. Due to the severity of the leakage and due to the fact that both tanks are over 25 years old, the Police Department received authorization from the City Manager for an Emergency Purchase to install and upgrade the emergency underground fuel storage tank (UST) systems at the North and South Substations, in an amount not to exceed $180,000. This will enable MPD to proceed with the establishment of a purchase order to initiate this project. Failure to respond within the timeframe stipulated may result in the issuance of a Uniform Civil Violation Notice. The report includes county, state, federal, and municipal sites that currently have violations of applicable environmental regulations as well as the compliance actions taken to correct such violations. Violation sites that have been closed out since the December 2000 report have also been included. According to the information we have accumulated, there are facilities/sites i ithin your city's control or use where environmental violations have been verified, or on-going environmental compliance activities are occurring. The report is tentatively scheduled for review by the Board of County Commissioners at the 1=ebruary- 12, 2002, meeting. (PEICO) is pleased to provide you with this proposal for completing the upgrade of emergency underground fuel storage tank (UST) systems at the above -referenced sites. Notices of Violations from the Miami -Dade County Department of Environmental Resources Management (DERM) have been issued to the City of Miami Police Department for the non-compliant UST systems at both North and South Stations. Specifically, PEICO has reviewed the construction documents prepared on June 2002, by H.J. Ross Associates, Inc. and proposes to complete the upgrade at both locations. Our licensed Pollutant Storage Contractor will obtain permits to remove the existing UST at the South Station, and abandon in-place the existing UST at the North Station. All services will be conducted in general accordance with the June 2002 prepared construction documents. COMPENSATION Our lump sum fee for the requested services is as follows: 1. North Station (1000 NW 62nd Street) $85,504.58 2. South Station (2200 West Flagler Street) $84,765.22 Sub Total Lump Sum = $170,269.80 Contingency @ 6% $ 9,730.20 Total Not -To -Exceed = $180,000.00 The scope of work includes providing all labor, equipment and materials necessary to upgrade and install the new UST systems. A mutually agreeable schedule for completion of the work will be developed prior to commencing with construction. QUALIFICATIONS PEICO will make reasonable effort to avoid underground utilities, sprinkler systems and underground wiring in the location of the tank excavation and underground piping, but is not responsible for accidental damage to unknown subsurface structures. Any overhead utilities at tank area will need to be relocated by others, if required. The use of sheet piling is not included in our price for the installation of the USTs. Should subsurface conditions require the use of sheet piling, shoring or dewatering, PEICO will provide the Client with pricing for these services prior to the initiation of the work. If site conditions differ from what is assumed above, PEICO shall notify the Client immediately of such conditions. Any unforeseen changes in site conditions which require a modification to the agreed to scope of services and cost, PEICO shall immediately notify the Client of such changes. Any changes in the proposed work scope or cost shall be documented and agreed to in writing. PEICO will not exceed the total authorized cost without prior written authorization. All work shall be performed in accordance with the terms and conditions attached to this proposal. PEICO shall invoice Client on a monthly basis, lump sum in accordance with the Schedule of Values attached to this proposal.
