HomeMy WebLinkAboutR-03-0462J-03-378 04/23/03 RESOLUTION NO. 03— 462 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), DECLARING A CITY -OWNED PARCEL OF REAL PROPERTY ("PROPERTY"), DESCRIBED IN "EXHIBIT A," ATTACHED AND INCORPORATED, AS SURPLUS, LOCATED ADJACENT TO 592 NORTHEAST 60TH STREET, MIAMI, FLORIDA; APPROVING THE SALE OF SAID PROPERTY TO THE CUSHMAN SCHOOL, FOR THE SUM OF $500, SUBJECT TO APPROVAL AND RECORDATION OF THE FINAL PLAT OF THE CUSHMAN SCHOOL REPLAT AND OTHER CONDITIONS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE FOLLOWING DOCUMENTS BOTH IN SUBSTANTIALLY THE ATTACHED FORM: (1) A QUIT CLAIM DEED, "EXHIBIT B," CONVEYING THE PROPERTY FROM THE CITY OF MIAMI TO THE CUSHMAN SCHOOL, AND (2) AN OWNERS AFFIDAVIT, "EXHIBIT C;" FURTHER AUTHORIZING THE CITY MANAGER TO EXERCISE PROVISIONS CONTAINED HEREIN. WHEREAS, on July 16, 2002, the Cushman School ("School"), made an offer to the City of Miami ("City") of $500 to acquire a forty-eight foot strip of land owned by the City, as more particularly described in composite "Exhibit A," attached and incorporated, located adjacent to property owned by the School located at the Northeast corner of Northeast 60th Street and Northeast 5th Avenue, Miami, Florida; and WHEREAS, on November 6, 2001, the electorate of the City of Miami approved an amendment to Section 29-B of the City Charter TTrru r �Wr� CITY COMMISSION MEETING OF Mrd' 0 2003 Rasolation No. 03 4.62 to create an exception from City requirements for competitive bidding for disposition of non -waterfront City -owned property to an adjacent property owner when the subject property is 7,500 square feet or less, or the subject non -waterfront property is non -buildable; and WHEREAS, the area contained in the Property is not in excess of 7,500 square feet, is non -buildable, is non -waterfront, and its conveyance to the School would assist in providing for the orderly assemblage of land by the School in connection with the proposed Cushman School Replat ("Plat"); and WHEREAS, the City administration recommends, subject to the approval and recordation of the Plat and payment by the School of all costs, expenses and fees of the closing and of all charges upon the Property now existing and may be imposed in the future, that the Property be sold to the School, as it is in the best interest of the City that the Property be consolidated with the adjacent Cushman -owned property and placed on the tax rolls; and WHEREAS, the City Commission, in reliance of the foregoing, finds it is in the best interest of the City of Miami and its residents to convey the Property to the School as set forth above, subject to the foregoing conditions which require approval and recordation of the final plat of The Cushman School Replat and assure that the Property will be placed on the tax rolls, and Page 2 of 5 03- 462 62 that the City will be protected from any liability or costs of any nature whatsoever with respect to the Property, and its sale to the School; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City -owned parcel of Real Property, as more particularly described in composite "Exhibit A," ("Property") attached and incorporated, located adjacent to 592 Northeast 60th Street, Miami, Florida, is declared surplus. Section 3. The sale of the Property to the Cushman School, for the sum of $500, subject to approval and recordation of the final plat of The Cushman School Replat and other conditions, is approved. Section 4. The City Manager is authorized) to execute the following documents both in substantially the attached forms: (1) a Quit Claim Deed, "Exhibit B," conveying the property from 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Page 3 of 5 ©3- 462 the City of Miami to the Cushman School, and (2) Owners Affidavit, "Exhibit C." Section 5. The City of Miami does not warrant the sufficiency of its title nor any interest it may have in the Property, nor does it make any covenant whatsoever as to the Property, which is being conveyed to the School "AS IS" and "WHERE IS" and which Property, the School accepts "AS IS" and "WHERE IS." Section 6. The School shall record said "Exhibit B" at its expense, and furnish the City Attorney and City Clerk with. a duly certified and recorded copy thereof, within a reasonable time after the adoption of this Resolution and approval and recordation of the final plat of Cushman School Replat. Section 7. The School shall pay any and all expenses existing at this time and incurred in the future relating to the Property, including but not limited to all costs involved in the conveyance of title, all recording fees, documentary stamp taxes and any other fees, taxes or charges upon the Property, as may exist at this time and from this day forth in the future. Section 8. This Resolution is not intended to alter nor abridge any agreements between the parties nor any other requirements imposed on the School by the City. Page 4 of 5 03- 44632 Section 9. The Resolution also authorizes the City Manager to execute a quit claim deed conveying the Property. BACKGROUND: On July 16, 2002, The Cushman School (the "School"), made an offer to the City of Miami ("City") of $500.00 to acquire a 48 square foot strip of land owned by the City of Miami, as more particularly described in the attached and incorporated "Exhibit A", ("Property"). The 48 square foot strip of property adjacent to the property located at Northeast 60th Street and 5 Avenue, Miami, Florida is not needed for right-of-way purposes. The School seeks to include this Property in the replatting of their adjacent property. The Property is non -waterfront and is only 48 sq. ft., which is too small to be developed for its own use. On November 6, 2001, the voters approved an amendment to the Charter of the City of Miami creating an exception in the bid and referendum requirements listed in Section 29-B for certain non -waterfront City property limited in size and/or value and/or non -buildable from the competitive process for conveyance. The School is the only adjacent property owner to the Property. Based on the foregoing, the administration recommends the site be sold to the School based upon their need to include it in their replatting of the adjacent property known as the "Cushman School," and it is in the best interest of the City to consolidate the Property with the adjacent property and be place AV on the tax rolls.
