HomeMy WebLinkAboutR-03-0448J-03-400 04/29/03 RESOLUTION NO. 03— 448 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RELATED TO THE REAPPORTIONMENT OF THE JURISDICTIONAL BOUNDARIES OF THE CITY COMMISSION DISTRICTS FOR USE IN THE NOVEMBER 4, 2003 ELECTION AND EACH ELECTION THEREAFTER; OFFICIALLY DELINEATING THE BOUNDARIES OF EACH DISTRICT AS SET FORTH IN "EXHIBIT A," ATTACHED AND INCORPORATED. WHEREAS, the voters of the City of Miami adopted a Charter Amendment on September 4, 1997, providing for a non-voting Executive Mayor elected City-wide, and five City Commissioners elected from districts; and WHEREAS, the City Commission adopted Resolution 97-495 providing for the jurisdictional boundaries of the City Commission Districts; and WHEREAS, Resolution No. 02-612, adopted June 13, 2002, to facilitate the retention of Special Counsel and Advisors, and to fund any requisite reapportionment process; and WHEREAS, said Special Counsel conducted publicly noticed public meetings and workshops on the subject of City Commission ATS` A C N AlEe% T SVS) 3 rd OF A1?4Z CITY COMMMIOd1, MEETING Cff MAY 0 ' 2003 hesalution No. 03— 448,-- Redistricting for purposes of apprising the public of the potential district boundary changes and obtaining the public's input and participation; and WHEREAS, the aforementioned public hearings, the complete records of which are attached and incorporated, were held: February 18, 2003, at 7:00 p.m. at Legion Post, 6445 Northeast 7th Avenue, Miami, Florida; February 19, 2003, at 7:00 p.m. at Verrick Park, 3580 Day Avenue, Miami, Florida; and February 24, 2003, at 6:00 p.m. at Temple Israel, 137 Northeast 19th Street, Miami, Florida; and WHEREAS, on May 8, 2003, during its Regular Meeting, the City Commission and Special Counsel conducted a Public Workshop, the complete record of which is incorporated herein by reference thereto, to apprise the City Commission of the Special Legal Counsel's findings and recommendations regarding implementation of the 2000 Census prompted modification of City Commission district boundaries, and receive the City Commission's input, recommendations and direction relative to such modification and implementation; and WHEREAS, the results of the 2000 Census show changes in the City's population and population deviations between the existing districts which exceed ten percent (10%); and T'3 Page 2 of 4 48 WHEREAS, as a result of the aforementioned population changes, it is necessary to officially reapportion the City of Miami City Commission districts pursuant to the requirements of law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City delineates the jurisdictional boundaries of each of the five delineated districts, as set forth in Exhibit 1, attached and incorporated, which shall be used in the November 4, 2003 election and all elections subsequent thereafter. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.11 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Thompson, Cit le FROM: Alejandro Vilarello, Ci At e DATE: July 9, 2003 RE: Redistricting; G�ection of Scrivener's Errors; Resolution City Commission Meeting of May 8, 2003 _U N C w c..s O T' v"= 3 No. 0, g- 4 Z On May 8, 2003, the Commission adopted Resolution 03-448, which provided the boundaries for the five (5) City Commission Districts. The districts were drawn with software that utilized TIGER (Topologically Integrated Geographic Encoding and Referencing) street descriptors. This is the same software used by the Florida Legislature to redistrict the State's House, Senate and Congressional delegations. After the maps were drawn, street descriptions were created following the boundaries lines contained in the generated maps. As you may recall, the City Commission amended the draft resolution on May 8`h by altering the boundary between districts 2 and 5. On short order, the border between Districts 2 and 5 was moved westward. New maps and street -by -street descriptions were prepared and presented to the City Commission the very same day. However, when the street -by -street descriptions were given to the GIS Division of the Planning and Zoning Department, it was discovered that some of the streets identified using the TIGER line files were mislabeled and other streets did not actually connect, although the Census description claimed that they did. In order to have maps that reflect the intent of the City Commission and the present state of the City of Miami's topography, the attached replacement "Exhibit A" contains corrections to what are "scrivener's errors" and ambiguities. In making these corrections, no population was moved and the demographics of the districts as passed on May 8th remain the same. Please replace all the existing "Exhibits" currently attached to Resolution 03-448 with the corrected "Exhibit A" that accompanies this memo. Again, the new "Exhibit A," which, like its predecessor, also consists of the Overall Map, District Descriptions and District Maps, should be substituted in lieu of the existing "Exhibit 1" to Resolution No. 03-448. These corrected pages carry the initials "CCM" on the bottom of ea, -h page. It is the opinion of this Office that this matter is purely one of correcting Scrivener's errors and ambiguities. Thus, no further action by the City Commission is necessary. Please substitute said pages (description and maps) for "District 2" and "District 5" in said Resolution's attachments. The attached new district descriptions and maps reflect the Commission's amendatory action regarding those districts. The maps and descriptions of the other districts is unchanged from those currently in the packet. Therefore, after the aforementioned actions, the Resolution should be sent to the Mayor for his execution. You requested that I reformat the descriptions to match the format used in the resolution. The descriptions also include new maps showing the boundaries districts 2 and 5. This letter will also serve as a follow-up to my previous correspondence with you concerning the re- precincting of the City of Miami. I still have not received a list of the "problem" precincts as I had requested. Time is growing short and if we are to have an effect on changing the precincts, we need to identify those precincts where voters are asked to leave the precincts to cast their ballots. In additiae,,Aw a I previously requested, we need to have the City's net offices identify alternative voting sites which meet the accessibility requirements that I sent with my previous correspondence. If the Elections Department is going to change the precinct map, it needs to submit the changes to the Board of County Commissioners Elections Committee in June and then to the full Commission in July. As a consequence thereof, City Commissioners adopted Resolution 97-495 providing for the jurisdictional boundaries of the first single -member City Commission districts. In order to facilitate and fund any reapportionment process to redraw the current single - member City Commission district boundaries necessitated by the 2000 Census, the City Commission, on June 13, 2002, adopted Resolution 02-612, which initiated, facilitated and funded the review process, as well as provided for retention of a Special Counsel and Advisor in connection with matters relating to Commission Redistricting. Special Counsel conducted several noticed public meetings and workshops on the subject of City Commission Redistricting to apprise the public of potential district boundary changes and obtain public input and participation. The aforementioned public hearings were held: February 18, 2003, at 7:00 p.m. at Legion Post, 6445 NE 7th Avenue; February 19, 2003, at 7:00 p.m. at Verrick Park, 3580 Day Avenue; and February 24, 2003, at 6:00 p.m. at Temple Israel, 137 NE 19th Street. A Public Workshop is also scheduled for May 8, 2003, during the Commission's meeting of that date, prior to the public hearing on the subject resolution, to apprise the City Commission of the Special Counsel's findings and recommendations regarding implementation of the 2000 Census prompted modification of City Commission district boundaries, and receive the Commission's input, recommendations and direction relative to such modification and implementation.
