A/K/A THE HOUSE OF RADIATORS, INC., PURSUANT TO SAID RESOLUTION, FOR THE ACQUISITION AND INSTALLATION OF AUTOMOTIVE RADIATOR RECORING AND REPAIR SERVICES FOR THE DEPARTMENT OF MUNICIPAL SERVICES, HEAVY FLEET DIVISION, AS CASA FAILED TO SUBMIT DOCUMENTATION REQUIRED PURSUANT TO ITS CONTRACT WITH THE CITY. WHEREAS, pursuant to Resolution No. 02-1042, adopted September 26, 2002, a bid was awarded to Casa de Radiadores a/k/a House of Radiators, Inc. ("Casa") for the acquisition and installation of radiator recoring and repair services, for the Department of Municipal Services, Heavy Fleet Division, on an as needed contract basis for a one-year period, with the option to renew for two additional one-year periods; and WHEREAS, subsequent to the award of the bid, Casa failed to submit proof of insurance, as specifically required by the contract; and CITY COMMISSION MEETING ON MAY 0 3 2003 Resolution X.P. g' 03- 428 WHEREAS, it is in the best interest of the City to rescind the bid awarded to Casa and Resolution No. 02-1042, in its entirety; and WHEREAS, the City Commission wishes to re-evaluate the insurance requirements for the acquisition and installation of radiator recoring and repair services, and issue a new bid; and WHEREAS, Casa de Radiadores was the sole responsive and responsible bidder, and its contract is in default; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 02-1042, in its entirety, and the bid awarded to Casa de Radiadores a/k/a House of Radiators, Inc. for the acquisition and installation of radiator recoring Page 2 of 3 03- 428 and repair services, for the Department of Municipal Services, Heavy Fleet Division, are rescinded. Casa de Radiadores a/k/a House of Radiators, Inc. has defaulted on the contract due to their failure to submit proof of insurance as required in bid documents. Casa de Radiadores was the sole responsive and responsible bidder who responded to the IFB. Additionally, the Purchasing Department and Risk Management have re-evaluated the City's insurance requirements to encourage all local and M/VVBE vendors to participate in the City of Miami procurement opportunities. The insurance requirement threshold amount has been lowered for General Liability from $1,000,000 to $300,000 and $500,000 to $300,000 for Automobile Liability. It is anticipated that these new insurance requirements will increase the likelihood of local and MWBE vendors to compete with other vendors for this bid. BACKGROUND On September 26, 2002 under Resolution No. 02-1042, Casa de Radiadores a/k/a House of Radiators, was awarded the contract for the furnishing of radiator recoring and repairs pursuant to Bid No. 01-02-213R. The bid documents require certain limits of insurance coverage to be maintained throughout the contract period. Upon notice of award, and after numerous attempts by the City to receive the insurance certificates, Casa de Radiadores a/k/a House of Radiators, Inc. failed to submit the required proof of insurance and have, therefore, defaulted on the contract. The City of Miami Purchasing Department will rebid this contract with reduced insurance requiremen hat will encourage more local and MWBE vendors to compete within this bidding oces .
