RESOLUTION NO. 03, 340
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY ATTORNEY TO (1) SEEK
INJUNCTIVE RELIEF FOR THE REMOVAL AND ABATEMENT
OF AN UNSAFE STRUCTURE LOCATED AT 348 NORTHEAST
20TH TERRACE, MIAMI, FLORIDA ("PROPERTY"),
(2) SEEK AND INITIATE ANY AND ALL APPROPRIATE
ALTERNATIVES AND APPLICABLE ADMINISTRATIVE/CIVIL
ACTIONS, INCLUDING WITHOUT LIMITATION, AN ACTION
BEFORE THE MIAMI-DADE COUNTY UNSAFE STRUCTURES
BOARD, AND (3) INITIATE FORECLOSURE ACTIONS
RELATED TO OUTSTANDING LIENS OF UNPAID CITY
CHARGES OR AMOUNTS WHICH CONSTITUTE A LIEN.
AGAINST THE PROPERTY, CODE ENFORCEMENT
VIOLATIONS AND/OR COSTS AND FEES RELATED TO
THESE VIOLATIONS AT A TIME PERMITTED BY
APPLICABLE LAW; CONDITIONING SAID AUTHORIZATIONS
UPON CONCRETE ACTION BEING TAKEN AT THE PROPERTY
LOCATED AT 365 NORTHWEST 8TH STREET, MIAMI,
FLORIDA, WITHIN THIRTY BUSINESS DAYS OF THE DATE
OF THIS MEETING.
WHEREAS, the Unsafe Structures Board of Miami -Dade County
ordered that the rear two-story CBS structure located at 348
Northeast 20th Terrace, Miami, Florida ("Property") be demolished
by the enforcing municipality in which it is located; and
WHEREAS, the Miami -Dade County Unsafe Structures Board has
not yet determined the status of the main residential two-story

CBS structure at said location, but the structure does appear,
by casual observation, to be a fire hazard and/or unsafe and/or
in an otherwise dangerous condition, including, without
limitation, having a pronounced hole in the roof and not
securely boarded despite its vacant status; and
WHEREAS, the City finds that it is in the public interest
to remove or abate the unsafe, dilapidated, dangerous, decrepit,
and unsecured structures particularly when such structure is
adjacent to major thoroughfares and populous areas of the City;
and
WHEREAS, such action is conditioned upon concrete action
being taken at the property located at 365 Northwest 8th Street,
Miami, Florida, within thirty business days of the date of this
meeting;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

Section 2. The City Attorney is authorized!' to (1) seek
injunctive relief for the removal and abatement of an unsafe
structure located at 348 Northeast 20th Terrace, Miami, Florida
("Property"), (2) seek and initiate any and all appropriate
alternatives and applicable administrative/civil actions,
including without limitation, an action before the Miami -Dade
County Unsafe Structures Board, and (3) initiate foreclosure
actions related to outstanding liens of unpaid City charges or
amounts which constitute a lien against the Property, Code
Enforcement violations and/or costs and fees related to these
violations at a time permitted by applicable law.
Section 3. The herein authorizations are conditioned
upon concrete action being taken at the property located at 365
Northwest 8th Street, Miami, Florida, within thirty business days
of the date of this meeting.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.�V
�i The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.
If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
