RESOLUTION NO. 03— 337
A RESOLUTION OF THE CITY OF MIAMI COMMISSION
AUTHORIZING THE CITY MANAGER TO SUBMIT AN
APPLICATION AND EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, TO THE FLORIDA INLAND NAVIGATION
DISTRICT FOR A GRANT FUNDING UNDER ITS
WATERWAYS ASSISTANCE PROGRAM FOR THE
IMPLEMENTATION OF A MOORING AND ANCHORAGE
FIELD IN THE DINNER KEY MARINA AREA.
WHEREAS, the Department of Conferences, Conventions &
Public Facilities wishes to apply for grant funds from the
Florida Inland Navigation District Waterways Assistance Program
(FIND) for the design and construction of a Mooring and
Anchorage Field in the Dinner Key Area; and
WHEREAS, the City of Miami is seeking funds in the amount
of $484,064; and
WHEREAS, under the FIND program, financial assistance is
available for fifty (500) percent of the actual cost of the
design and construction of this project; and

WHEREAS, matching funds in the amount of $538,036 has been
allocated from the Homeland Defense Bond funds for this
project; and
WHEREAS, the Projected Net Revenue to the City over a five
year period would be $1,209,273.79; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1 The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized!' to submit an
application to Florida Inland Navigation District for grant
funding under it's Waterway Assistance Program, in the amount
of $484,064 for the design and construction of a Managed
Mooring and Anchorage Field in the Dinner Key Marina area, with
a matching funds in the amount of $538,036 allocated from the
Homeland Defense Bond Funds.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

Section 3. The City of Miami accepts the terms and
conditions set forth in FIND Rule 66B-2 F.A.C., which outlines
the Waterways Assistance Program and which is a part of the
Project under the proposal.
Section 4. The City Manager is authorized to execute
all the necessary document(s) in a form acceptable to the City
Attorney, to submit said application to FIND for matching
funds, in the amount not to exceed $484,064.
Section 5. The City of Miami is in complete accord with
the proposal and agrees to carry out the project in the manner
described in the proposal, and any plans and specifications
attached thereto, unless prior approval for any change has been
received from the District.
Section 6. The City of Miami will maintain adequate
financial records for the proposed project to substantiate
claims for reimbursement.
Section 7. The City of Miami will make available to
FIND, if requested, a post audit of expenses incurred on the
project prior to, or in conjunction with, request for the final
ten (100) per cent of the funding agreed to by FIND.

Section 8. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.V

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
