A RESOLUTION OF THE MIAMI CITY COMMISSION
APPOINTING CERTAIN INDIVIDUALS AS REGULAR
MEMBERS OF THE CODE ENFORCEMENT BOARD FOR
TERMS AS DESIGNATED HEREIN.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The following individuals are hereby
appointed as regular members of the Code Enforcement Board, each
to serve terms as designated herein:

The Code Enforcement Board was created to issue orders having the force of law commanding
whatever steps are necessary to bring a Code violation into compliance.
Florida Statutes Section 162.05(2) requires members of the Code Enforcement Board to be
residents of the City of Miami. City Code Section 2-812 states that whenever possible, the
board is to consist of an architect, a businessperson, an engineer, a general contractor, a
subcontractor, and a realtor. Pursuant to Florida Statutes Section 162(3)(b), all members serve
three year terms.
Pursuant to City Code Sec. 2-886(a), any board member shall be automatically removed if, in a
given calendar year: (1) he/she is absent from three consecutive meetings; or (2) He/she is absent
from four of the board's meetings. The provisions of this section may be waived by a four-fifths
vote of the members of the full city commission.
Four appointments are needed at this time for members whose terms expired on February 10, 2003:
• Commissioner Regalado has one nomination for seat currently held by Ney Denis Rod,
who has exceeded the number of absences allowed per City Code.
• Vice Chairman Teele has one nomination for seat currently held by James Keane.
• Chairman Winton has one nomination for seat currently held by Michael Gongora.
• The Commission At -Large has one appointment for seat currently held by Charles
McEwan.
For your convenience, we have included a copy of the current membership of said board. By copy
of this memorandum, we are requesting the Agenda Office to place this issue on the March 13,
2003 Commission agenda.
