A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO PROVIDE CITY
OF MIAMI EMPLOYEES WHO ARE MEMBERS OF THE
UNITED STATES MILITARY RESERVE OR FLORIDA
NATIONAL GUARD AND ORDERED TO REPORT FOR
ACTIVE DUTY IN RESPONSE TO THE UNITED STATES'
WAR WITH IRAQ OR TERRORIST ATTACKS AGAINST
THE UNITED STATES, A SUPPLEMENT, RETROACTIVE
TO SEPTEMBER 25, 2002, IF APPLICABLE, TO
CONTINUE UNTIL SEPTEMBER 25, 2003, TO
MILITARY PAY RECEIVED IN AN AMOUNT NECESSARY
TO BRING TOTAL SALARY, INCLUSIVE OF BASE
MILITARY PAY, TO THE LEVEL EARNED AT THE TIME
OF THE ORDER TO ACTIVE MILITARY DUTY;
APPROVING CERTAIN OTHER SPECIFIED BENEFITS,
WITH THE MONIES FOR SUCH EXPENDITURE BEING
ALLOCATED FROM PREVIOUSLY APPROPRIATED SALARY
AND SALARY SURPLUS FUNDS; DIRECTING THE CITY
MANAGER TO DETERMINE THE NEED TO CONTINUE OR
TERMINATE SUCH BENEFITS EVERY SIX MONTHS AND
TO ADVISE THE CITY COMMISSION ACCORDINGLY;
AND DIRECTING THE CITY MANAGER TO EXECUTE ALL
THE NECESSARY DOCUMENTS FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No. 01-1056, adopted
September 25, 2001, and as amended by Resolution No. 02-591,
adopted May 23, 2002, the City Commission authorized that City of
Miami employees who were reservists in the United States Armed
Forces or members of the Florida National Guard, and ordered to
active military duty for national defense in response to
terrorist attacks against the United States receive a supplement

through September 25, 2002, if applicable, to military pay
received in an amount necessary to bring their total salary,
inclusive of base military pay, to the level earned at the time
of the order to active military duty, with the monies for such
expenditure being allocated from previously appropriated salary
and salary surplus funds; and
WHEREAS, employees receiving the supplement to their
military pay were also provided with health insurance coverage,
unless the military service provided health insurance coverage
for the employee and/or the employee's family; and
WHEREAS, due to the United States' declaration of war with
Iraq and the continued need for continued vigilance related to
acts of terrorism, the City Commission wishes to continue to
supplement military pay and the health insurance coverage for
those employees called to duty; and
WHEREAS, it is the intent of the City Commission that the
need for such supplement be reviewed every six month to determine
the need to continue or terminate such benefits;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Manager is authorized to provide,
pursuant to §115.14 Fla. Stat. (2000), City employees who are
members of the United States Military Reserve or Florida National

Guard, who are ordered to report for active duty for national
defense in response to the United States' War with Iraq or
terrorist attacks against the United States, shall receive a
supplement retroactive to September 25, 2002, if applicable, to
military pay received in an amount necessary to bring their total
salary, inclusive of base military pay, to the level earned at
the time of the order to active military duty, with the monies
for such expenditure being allocated from previously appropriated
salary and salary surplus funds.
Section 2. City employees who receive a supplement to
their military pay in accordance with Section 1 shall be eligible
to receive such supplement until September 25, 2003, if
applicable.
Section 3. City employees who receive a supplement to
their military pay in accordance with Section 1 shall continue to
be provided with health insurance coverage, until September 25,
2003, if applicable, unless the military service provides health
insurance coverage for the employee and/or the employee's family.
Section 4. City employees who receive a supplement to
their military pay in accordance with Section 1 shall not be
eligible to accrue sick or earned personal leave benefits.
section 5. The City Manager is directed to determine the
need to continue or terminate such benefits every six months and
to advise the City Commission accordingly.

Section 6. The City Manager is directedll to execute all
necessary documents for the implementation of said supplement.
Section 7. This Resolution shall become effective
immediately upon its adoption and signature of the Mayors/.

1j The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

RECOMMENDATION
The City Administration recommends the City Commission approve the attached
amendment to Resolution #02-591, adopted on May 23, 2002, authorizing the City
Manager to provide City of Miami employees who are members of the United States
Military Reserve or Florida National Guard and who are ordered to report for active
military duty in response to terrorist attacks against the United States an extension of
previously specified benefits for an additional 365 calendar days.
BACKGROUND
On May 23, 2002, the City. Commission adopted Resolution No. 02-591, authorizing the
City Manager, pursuant to SS 115.15 Fla. Stat. (2000), to provide City of Miami
employees who are members of the United States Military Reserve or Florida National
Guard, a supplement to military pay received in an amount necessary to bring their total
salary, inclusive of base military pay, to the level earned at the time of the order to active
military duty for a period of 365 calendar days. This Resolution also provided for
employees receiving the supplement to their military pay to continue to be provided with
health insurance, for a time up to 365 calendar days, unless the military service provides
health insurance coverage for the employee and/or the employee's family.
The City currently has 14 employees (8 in the police department and 6 in the fire
department) that have been called to active duty, one as far back as September 2001. As
a result, their supplemental benefits have expired or will expire in the immediate future.
The City is requesting the extension of said supplemental benefits for an additional 365
calendar days. It is anticipated that such an extension will not adversely affect the City
financially because the disbursement of reduced supplemental pay will result in salary
savings, which will offset any overtime costs incurred.
