HomeMy WebLinkAboutR-03-0214J-03-177 2/26/03 RESOLUTION NO. 03— 214 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CONVEYANCE OF SIX CITY -OWNED VACANT PARCELS LOCATED IN THE MODEL CITY NEIGHBORHOOD TO PALMETTO HOMES OF MIAMI, INC. AS DEVELOPER, AT NO COST, FOR THE DEVELOPMENT OF SIX NEW SINGLE-FAMILY HOMES AFFORDABLE TO FAMILIES AND INDIVIDUALS OF LOW-INCOME, SUBJECT TO THE DEVELOPER: (1) AGREEING TO PAY THE COST OF ELIMINATING ALL TITLE DEFECTS EXISTING ON THE PARCELS, (2) PROVIDING EVIDENCE ACCEPTABLE TO THE CITY OF FIRM COMMITMENTS FOR PROJECT CONSTRUCTION AND PERMANENT FINANCING FOR PURCHASE BY QUALIFIED HOMEBUYERS, (3) COMMENCING CONSTRUCTION WITHIN TWELVE MONTHS FROM THE DATE OF CONVEYANCE BY THE CITY, (4) COMPLYING WITH OTHER TERMS AND CONDITIONS INCLUDING PARCEL REVERTER PROVISIONS, AS DEEMED APPROPRIATE BY THE CITY MANAGER AND THE CITY ATTORNEY, AND (5) PROVIDING THE ADMINISTRATION WITH A STATUS REPORT CONCERNING THE TITLE TO THE PARCELS WITHIN NINETY (90) DAYS FROM THE DATE OF CONVEYANCE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, a severe shortage of affordable housing exists in the City of Miami ("City") for families and individuals in the low and moderate -income range; and CITY CoreasSIO;i�F MEM,NG OF FED ? 7 2P03 Resolution No, WHEREAS, pursuant to Resolution No. 99-429, adopted July 22, 1999, the City Commission approved the City's proposed Five -Year Consolidated Plan (1999-2004) ("Plan") for submission to the United States Department of Housing and Urban Development including, as a major component of the Plan, a housing strategy designed to facilitate the annual creation of 1,000 new homeownership units for purchase by very low, low and moderate -income families; and WHEREAS, the six parcels are located in the Model City Community Revitalization District and the Model City Revitalization Trust has confirmed that the development plan proposed by Palmetto Homes of Miami, Inc. ("Developer") conforms with the mission of the Model City Trust; and WHEREAS, Section 29-B of the City Charter, as amended, allows for the conveyance or disposition of City -owned property in connection with the implementation of City -assisted housing programs or projects intended to benefit persons or households of low or moderate -income without competitive bidding requirements and fair market value return to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 4 03- 214 Section 2. The conveyance of the following six parcels at no cost to the Developer is authorized, subject to the Developer (1) agreeing to pay the cost of eliminating all title defects existing on the parcels, (2) providing evidence acceptable to the City of firm commitments for project construction and permanent financing for purchase by qualified homebuyers, (3) commencing construction on the parcels within twelve months from the date of conveyance to the Developer by the City, (4) complying with other terms and conditions, including reverter provisions for each parcel, as deemed appropriate by the City Manager and the City Attorney, and (5) providing the administration with a status report concerning the title to the parcels within ninety days from the date of conveyance: 1761 Northwest 55th Terrace, 1743 Northwest 41st Street, 1758 Northwest 48th Terrace, 1761 Northwest 47th Street, 1755 Northwest 55th Terrace, 821 Northwest 50th Street, Miami, Florida Miami, Florida Miami, Florida Miami, Florida Miami, Florida Miami, Florida Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. BACKGROUND: The Housing and Commercial Loan Committee approved HOME Program funds of S270,WO to Palmetto Homes of Miami, Inc. (Developer) on September 13, 2002 for the development of six (6) new single-family affordable homes in the Model City neighborhood. Unable to acquire the properties specified iu the original proposal, the Developer has identified six (6) alternate vacant parcels (Parcels) in the Model City neighborhood, which are owned by the City. On February 6, 2003, the Mousing and Commercial Loan Committee approved a change to the project to replace the previouslyidentffied sites with scattered sites to be identified and approved by the City. The Model City Revitalization Trust has confirmed that the Parcels identified by the Developer and listed below are located in the Model City Community Revitalization District and that the Developer's plan conforms to the overall mission of the Model City Trust 1761 NW 55 Terrace 1743 NW 41 Svect 1758 NW 48 Terrace 1761 NW 47 Street 1755 NW 55 Terrace 821 NW 50 Suva On February 13, 2003, the City Commission directed the City Manager to bring a resolution for the ttas nsfer of the Parcels located in the Model City Neighborhood to Palmetto Homes of Miami, Inc. to the February 27, 2003 City Commission Meeting. 03- 214 FEB -20-2063 1732 CITY MPHqGERS OFFICE 305 416 1019 P.02/06 City Commission approval of this action would be subject to and contingent upon Palmetto Homes of Miami, Inc.: 1) agreeing to pay the cost of eliminating all title defects existing on the parcels, 2) providing evidence acceptable to the City of firm commitments for project construction and permanent ftnancing for purchase by qualified homebuyers, 3) commencing construction within twelve (12) months from the date of conveyance by the City, 4) complying with other terms and conditions, including parcel reverter provisiorts, as deemed appropriate by the City Manager mad the City Attomey, and 5) providing the administration with a status report concerning the title to the parcels within ninety (90) days from the date of conveyance. Palmetto Homes of Miaaaui, Inc. is required to commence construction on the City -owned parcels within twelve (12) months from the date of conveyance by the City or said parcels will revert back to the City. It is recommended that the City Commission authorize the conveyance of the six (6) City -owned vacant parcels located in the Model City neighborhood to Palmetto Homes of Miami, Inc. at no cost for the development of six (6) new single-family homes affordable to families and individuals of low income and subject to the provisions listed above and further authorize the City Manages to execute all necessary document(s), in a form acceptable to the City Attorney, subject to applicable City Code provisions. The proposed Resolution does not have a budgetary impact on the General Fund. 471PER 03- 214
