A RESOLUTION OF THE MIAMI CITY COMMISSION
RESCINDING RESOLUTION NOS. 02-288 AND 02-469
IN THEIR ENTIRETY, AND SUBSTITUTING IN LIEU
THEREOF THE HEREIN RESOLUTION, RELATED TO
COMMUNITY BASED NEWSPAPERS; ESTABLISHING
MINIMUM QUALIFICATIONS FOR PUBLISHING, ON AN
AS -NEEDED ROTATIONAL BASIS, CITY SUPPLEMENTAL
OR COURTESY PUBLIC NOTICES IN COMMUNITY-BASED
NEWSPAPERS; FURTHER AUTHORIZING THE CITY CLERK
TO QUALIFY AND INCLUDE ADDITIONAL QUALIFIED
COMMUNITY-BASED NEWSPAPERS ON THE LIST WHEN
DEEMED APPROPRIATE; FURTHER DIRECTING THE CITY
CLERK TO SET FORTH CRITERIA FOR QUALIFICATIONS
BASED ON CERTAIN CIRCULATION AND PUBLICATION
INFORMATION AND ALLOCATING FUNDS FROM THE
BUDGETS OF INDIVIDUAL USER DEPARTMENTS,
SUBJECT TO AVAILABILITY OF FUNDS.
WHEREAS, the Commission of City of Miami seeks to establish a
Community, Minority, Multi -Ethnic Newspapers Program ("Program")
that provides advertising support on an annual basis for newspapers
that provide a valuable and complimentary services to communities
that do not access general circulation newspapers; and
WHEREAS, many poor and elderly citizens of City of Miami
cannot afford to buy a major daily newspaper and depend on the
weekly community -minority newspapers for their news and
information; and

WHEREAS, the 2000 Population Census indicates that almost
87.5% of City of Miami is from multi-ethnic origins with the City
population comprised of Hispanic (63.5%), black non -Hispanic
(24.3%) and white non -Hispanic (11.2%); and
WHEREAS, the Commission recognizes that, in a community with
more than 370,000 residents from diverse cultural, national,
language and racial ethnicities, it is essential to provide
information about the City of Miami because many poor and elderly
residents cannot buy major daily newspapers but receive other
publications; and
WHEREAS, the City Commission directed that the administration
establish minimum qualification criteria for publishing City
supplemental or courtesy public notices on an as -needed rotational
basis and a list of qualified community-based newspapers; and
WHEREAS, funding for such advertising will be allocated from
the budgets of the individual user departments, subject to the
availability of funds; and
WHEREAS, the City of Miami annually expends substantial funds
on public advertisements in newspapers of general circulation;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The following minimum qualifications are
established for City supplemental or courtesy public notices to be
published in community-based papers on an as -needed rotational
basis:
1. A community-based newspaper shall:
a. be geographically located in the City of Miami.
Post Office boxes do not qualify; and
b. be published on at least a monthly basis and
provide proof of having been published continuously
for a minimum of two years; and
C. forward a notarized printer's receipt stating the
publication prints at least twelve pages, with
5,000 copies minimum per edition for the last six
months. When being added to the Program, the
newspaper must submit an affidavit of bulk
distribution location for the last six months and
the upcoming six months. At the same time,
newspapers must forward a notarized printer's
receipt attesting to the number of printed copies
per edition; and
d. be geographically located in the City of Miami, and
possess and maintain a current City occupational
license in accordance with the City Code; and
e. provide scheduled distribution dates and clearly
state publication date on all pages and the
masthead or cover of the newspaper; and
g. provide the City Clerk of the City of Miami with
its published rate card for standard advertising
rates and also provide a price guarantee for at
least 365 days; and
h. have at least 5,000 copies per edition circulated
within the City of Miami; and

i. submit a notarized copy of an income tax form or a
financial statement provided by a certified public
accountant for the last three years and submit a
copy of a Miami -Dade County occupational license.
2. Further, the community-based newspaper shall:
a. not be the arm of a political party and/or
candidate or elected official; and
b. have an annual gross income not exceeding one half
million dollars for an individual publication.
3. To effectively service all the citizens of the City of
Miami, the City Manager may waive requirement that the
newspaper be located in City of Miami as required in
subparagraph (1)(e) above for those community-based
newspapers that meet all other minimum qualification
requirements and publish in either the Spanish or Creole
language, providing that said newspapers possess and
maintain a current Miami -Dade County Occupational
License.
Section 3. The City Clerk may qualify and include
additional community-based newspapers to the List when deemed
appropriate pursuant to the herein criteria.
Section 4. The City Clerk is directed to set forth further
criteria for proof of qualifications based on the circulation and
publication information as established.
Section 5. Funding costs for such advertising shall be
allocated from the budgets of the individual user departments,
subject to availability of funds.

Section 6. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

1� If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City
Commission.
