AMENDING RESOLUTION NO. 02-772, AS AMENDED
BY RESOLUTION NOS. 02-878, 02-979 AND
02-1132, RELATING TO THE ALLOCATION OF 28TH
YEAR COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) PROGRAM FUNDS IN THE CATEGORY OF
PUBLIC SERVICES FOR DISTRICT 5, BY
DEOBLIGATING FUNDS IN THE AMOUNT OF $25,000,
FROM HAITIAN AMERICAN COMMUNITY ASSOCIATION
OF DADE COUNTY, INC./FOOD VOUCHER PROGRAM
AND $25,000, FROM THE HAITIAN AMERICAN
COMMUNITY ASSOCIATION OF DADE COUNTY,
INC./AFTER SCHOOL PROGRAM; ALLOCATING FUNDS

EDUCATIONAL PROGRAM; AND DIRECTING THAT
$80,000 OF THE ALLOCATION TO FANM AYISYEN
NAN MIAMI, INC. BE ADMINISTERED DIRECTLY BY
THE CITY OF MIAMI DEPARTMENT OF COMMUNITY
DEVELOPMENT FOR PAYMENT OF STIPENDS DIRECTLY
TO STUDENT PARTICIPANTS OF THE PROGRAM;
FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE INDIVIDUAL AGREEMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID
AGENCIES FOR SAID PURPOSES.
WHEREAS, Resolution No. 02-772, relating to the allocation
of $1,928,400 of 28th Year Community Development Block Grant
("CDBG") Program funds available under the entitlement formula
and

an additional $960,000 of eligible program income in the
category of Public Services was adopted July 8, 2002; and
WHEREAS, Resolution No. 02-772, as amended by Resolution
Nos. 02-878 and 02-979, authorized the transfer of Public
Services funds in the amount of $40,000 from the District 5
Priority Set -Aside to the District 2 Public Service Set -Aside;
and
WHEREAS, Resolution No. 02-772, as amended by Resolution
Nos. 02-878 and 02-979, was further amended by Resolution
No. 02-1132, to authorize the allocation an additional $231,000
of Program Income to Public Service agencies for the 28th Program
Year beginning October 1, 2002; and
WHEREAS, the City has received a Notice of Levy from the
United States Internal Revenue Service placing a lien on the
assets of the Haitian American Community Association of Dade
County, Inc. and has not received notice from said Agency of
intent to resolve said Levy; and
WHEREAS, the City has received proposals for Public Service
programs from Catholic Charities of the Archdiocese of Miami,
Inc./Notre Dame for a Books and Educational program, Word of
Life, Inc. for their Art in Public Places and Work Experience
Educational programs, and from Fanm Ayisyen Nan Miami, Inc.;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Section 2 of Resolution No. 02-772, as
amended by Resolution Nos. 02-878, 02-979 and 02-1132, which
allocated funds in the amount of $1,928,400 of 28th Year "CDBG"
funds in the Public Service category by City Commission District
for District 5, is further amended in the following particulars:'/

Section 3. The City Manager is authorize&/ to execute
individual agreements, in a form acceptable to the City
Attorney, with said agencies for said purposes.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.3/
The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.
3/ If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission amend Resolution No. 02-1132,
adopted at the City Commission Meeting of October 10, 2002 relating to the allocation of 28`h
Year Community Development Block Grant (CDBG) Program funds in the category of Public
Services for District 5, de -obligating funds of $25,000 from the Haitian American Community
Association of Dade County, Inc./Food Voucher program and $25,000 from the Haitian
American Community Association of Dade County, Inc. / After School program; and by
allocating funds o f $ 200,984 from t he D istrict 5 P ublic Service R eserve F and a long w ith t he
above-mentioned de -obligated funds in the amount of $15,000 to Catholic Charities of the
Archdiocese of Miami, Inc. / Notre Dame, $15,000 to Word of Life, Inc. for Art in Public Places,
$150,984 to Fanm Ayisyen Nan Miami, Inc. and $70,000 to Word of Life, Inc. for the Work
Experience Educational Program; and further authorizing the City Manager to enter into
agreement with said agencies for said purposes, in a form acceptable to the City Attorney,
subject to applicable City Code provisions.
BACKGROUND:
At the July 8, 2002 Special City Commission Public Hearing discussion on Public Services, the
City Commission adopted Resolution No. 02-772 allocating $1,928,400 of Community
Development Block Grant (CDBG) funds available under the entitlement formula and an
additional $960,000 of eligible program income in the Public Services category. The
Administration's funding recommendation for District 5 included the Haitian American
Community Association of Dade County, Inc. / Food Voucher program for $25,000, the Haitian
American Community Association of Dade County, Inc. / After School p rogram for $25,000,
and a District 5 Public Service Reserve Fund of $200,984 to be allocated at a later date.
The City of Miami received a Notice o f Levy from the U.S. Internal Revenue S ervice ( IRS)
dated August 21, 2002 placing a lien on the assets of Haitian American Community Association
of Dade County, Inc. (HACAD). HACAD has not responded to letters from the City or to
repeated attempts by City staff to establish contact. Therefore, it is requested that the Public
Service funds of $25,000 for the HACAD Food Voucher program and the $25,000 for the
HACAD After School program be de -obligated and reallocated to other District 5 Public Service
programs.
The City has received proposals for Public Service programs from Catholic Charities of the
Archdiocese of Miami, Inc. / Notre Dame (Notre Dame) for a Books and Educational Program,

Word of Life, Inc. for their Art in Public Places and Work Experience Educational programs,
and from Fanm Ayisyen Nan Miami, Inc. (Farm Miami). Each of these agencies has
successfully provided federally funded programs for the City of Miami in the past. The
proposals from Notre Dame and Word of Life, Inc. are for programs which were not previously
funded for the 28th Program Year. The proposed allocation to Fanm Miami will be added to the
agency's existing 28th Program Year allocation.
It is recommended that the City Commission adopt the proposed Resolution amending
Resolution No. 02-1132 relating to the Public Services Category of District 5 by de -obligating
$25,000 from the Haitian American Community Association of Dade County, Inc./Food Voucher
program and $25,000 from the Haitian American Community Association of Dade County, Inc. /
After School program; and by allocating funds of $200,984 from the District 5 Public Service
Reserve Fund along with the above-mentioned de -obligated funds in the amount of $15,000 to
Catholic Charities of the Archdiocese of Miami, Inc. / Notre Dame, $15,000 to Word of Life,
Inc. for Art in Public Places, $150,984 to Farm Ayisyen Nan Miami, Inc. and $70,000 to Word
of Life, Inc. for the Work Experience Educational Program; and further authorizing the City
Manager to enter agreement with said agencies for said purposes, in a form acceptable to the
City Attorney, subject to applicable City Code provisions.
The proposed Resolution re -allocates CDBG grant funds and does not have a budgetary
impact on the General Fund.

CATEGORY TO THE DOMINICAN AMERICAN NATIONAL
FOUNDATION CDC, I•NC. AND ALLOCATING AN
ADDITIONAL $231,000, INC. OF PROGRAM INCOME
TO PUBLIC SERVICE AGENCIES FOR THE 28'
PROGRAM YEAR BEGINNING OCTOBER 1, 2002;
FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE AGREEMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, WITH APPROVED AGENCIES.
WHEREAS, federal regulations require the City to provide
an opportunity for citizen participation in the planning process
for Housing and Urban Development ("HUD") related grant
activities; and
WHEREAS, a series of Public Hearings were held in each
City Commission District to solicit public participation in the
planning process for its HUD related grant activities; and
WHEREAS, the City of Miami issued a Request for Proposals
to solicit agencies providing public service activities to City
of Miami residents; and

WHEREAS, a Public Hearing was held July 8, 2002, regarding
the proposed use for said grant funds; and
WHEREAS, the City Commission adopted Resolution No. --02-772
at the Special City Commission Meeting of July 8, 2002, relating
to the allocation of $1,928,400 of 28th Year Community
Development Block Grant (CDBG) Program funds and $960,000 of
Program Income in the category of Public Services; and
WHEREAS, Resolution No. 02-878 amended Resolution
No. 02-772 by identifying specific allocations to agencies
providing public services in District 2; and
WHEREAS, Resolution No. 02-979 amended Resolution
No. 02-772, as amended, by identifying specific allocations to
agencies providing public services in District 2 from the
District 5 Public Service Set -Aside; and
WHEREAS, Resolution No. 02-772, as amended by Resolution
No. 02-878 and Resolution No. 02-979 identified $15,000 to
remain ipY the District 1 Priority Set -Aside in the Public
Service Category; and
WHEREAS, as a result of unanticipated, additional Program
Income received from the payoff of a loan executed in the late
1980's with Little Havana Limited to rehabilitate twelve (12)
buildings to provide project based housing for the City's

directed the*. Administration to determine the maximum amount

WHEREAS, the Administration has identified an additional

AMENDMENT TO ITEM NO. 12 - AMENDMENTS TO 28TH CDBG PROGRAMS
THE RESOLUTION RECOMMENDING THE AWARD OF $150,984 TO FANM
AYSIEN NAN MIYAMI, INC AND $80,000 TO WORD OF LIFE CDC FOR THE
"PILOT LIFE EXPERIENCE EDUCATIONAL PROGRAM FOR 7 SCHOOLS IN
DISTRICT 5" NEEDS TO BE AMENDED AS FOLLOWS -
I. $80,000 OF THE FUNDS AWARDED TO FANM AYSIEN NAN MIYAMI,
INC MUST BE ADMINISTERED BY THE DEPARTMENT OF COMMUNITY
DEVELOPMENT TO PAY THE STIPENDS DIRECTLY TO THE STUDENTS
PARTICIPATING IN THE WORK EXPERIENCE PROGRAM.
II. $10,000 REDUCTION OF THE FUNDS AWARDED TO FANM AYSIEN NAN
MIYAMI, INC TO BE REDIRECTED TO WORD LIFE CDC FOR
MONITORING OF THE ENTIRE PROGRAM. WORD OF LIFE CDC MUST
WORK CLOSELY WITH THE DEPARTMENT OF COMMUNITY
DEVELOPMENT IN THE IMPLEMENTATION AND PERFORMING OF THE
MONITORING FUNCTIONS.
III. $140,984 IS THE TOTAL AWARD OF FUNDS TO FANM AYSIEN NAN
MIYAMI, INC INCLUDING THE $80,000 FOR STUDENTS STIPENDS
WHICH WILL ADMINISTERED DIRECTLY BY THE DEPARTMENT OF
COMMUNITY DEELOPMENT.
IV. $80,000 IS THE TOTAL AWARD OF FUNDS TO WORD OF LIFE CDC
INCLUDING THE $10,000 FOR MONITORING OF THE PROGRAM.
V. NO CONTRACT, SUBCONTRACT OR GRANT MAY BE EXPANDED OR
CONTRACTED FOR IN AN AMOUNT OF MORE THAN $1,500 WITHOUT
THE WRITTEN PERMISSION OF THE DEPARTMENT OF COMMUNITY
DEVELOPMENT.
