A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOURTH -FIFTHS (4/5 TIS) VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND ACCEPTING THE BID OF METRO EXPRESS, INC., FOR THE PROJECT ENTITLED "STORM SEWER IMPROVEMENTS - DOWNTOWN, B-4662", IN AN AMOUNT NOT TO EXCEED $295,000 FOR THE PROJECT COSTS PLUS $35,000 FOR ESTIMATED EXPENSES INCURRED BY THE CITY, FOR AN ESTIMATED TOTAL CONTRACT AMOUNT NOT TO EXCEED $330,000; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENT PROJECT NO. 341140. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. By a four-fifths (4/5th,) affirmative vote, after a duly advertised public hearing, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bidding procedures and accepting the bid of Metro Express, Inc., for the project entitled "Storm Sewer CITY COMMISSION MEETTUG OF JAN 2 3 2901 Resolution No, 03- 106 Improvements - Downtown, B-4662", is ratified, approved and confirmed. Section 2. The City Manager is authorizedll to execute a contract, in a form acceptable to the City Attorney, with Metro Express, Inc., in the amount not to exceed $295,000 for project costs, plus $35,000 for estimated expenses incurred by the City, for a total project cost of $330,000, with funds allocated from Capital Improvement Program Project No. 341140. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.�11 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached Resolution ratifying the City Manager's written finding that a valid emergency exists, and waiving formal competitive bidding procedures and authorizing the City Manager to accept the bid of Metro Express, Inc., a Hispanic -minority controlled corporation located at 3594 S.W. 143 Court, Miami, Florida, as the lowest responsive and responsible bid in the amount of $295,000 Total Bid. The estimated total cost of for this project is $330,000, consisting of $295,000 Total Bid and $35,000 for the City's portion. BACKGROUND Based on an agreement between the Downtown Development Authority (DDA), the Florida Department of Transportation and the City of Miami, to construct four deep drainage wells and their corresponding structures in the Downtown area in order to alleviate numerous flooding problems and as part of the Flagler Street Two -Way Conversion Project, an EMERGENCY exists justifying the selection of Contractors by informal bids. Formal Bids for Storm Sewer Improvements - Downtown, 8-4662 FROM: Janet E. Palacino, Director REFERENCES. Capital Improvements ENCLOSURES. The Downtown Development Authority (DDA) and the City of Miami has come to an agreement to construct deep drainage wells at four locations within the downtown area to alleviate the numerous stormwater flooding problems and as part of the Flagler Street Two-way Conversion Project. Based on this agreement, I have found that an EMERGENCY exists which justifies the selection of a contractor by informal bids. The construction work must begin immediately at the following locations to address the current rainy season and meet the April 2003 deadline. Location #1: N. Miami Court and W. Flagler Street. Location #2: S. Miami Avenue and SE 2 Street. Location #3: SE 2 Avenue and SE 2 Street. Location #4: S.E. 1 Street and SE 3 Avenue. Because of the time constraint for construction, there is a need for extraordinary measures to expedite the installation of adequate stormwater drainage systems. In order to initiate the construction of the new deep drainage wells as soon as possible, formal competitive sealed bid procedures shall be waived for the procurement of contracting services required for said EMERGENCY pursuant to sections 18-83 and 18-84 of the City Code. Informal bids shall be obtained and a contract shall be awarded to the lowest responsive and qualified bidder. All costs of this project will be funded from the CIP No. 341140.
