A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, ACCEPTING THE PLAT ENTITLED PARK PLACE AT BRICKELL, A SUBDIVISION IN THE CITY OF MIAMI, SUBJECT TO ALL OF THE CONDITIONS OF THE PLAT AND STREET COMMITTEE, AND FURTHER, SUBJECT TO THE FOLLOWING: (1) AN EXECUTED INDEMNIFICATION AND HOLD HARMLESS AGREEMENT IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; (2) A BOND ACCEPTABLE TO THE CITY'S RISK MANAGEMENT ADMINISTRATOR, AS REQUIRED BY CITY OF MIAMI CODE SECTION 54-4; AND ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE SAID PLAT; AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA. WHEREAS, the Department of Public Works recommends the acceptance of the plat entitled PARK PLACE AT BRICKELL; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The plat entitled PARK PLACE AT BRICKELL is a replat of the property described in Attachment 1, which plat CITY C0MUSSI0IM N:EETIN G OF JAS' ?M3 Resolution hlo. . 104 by reference is made a part hereof as if fully incorporated herein, and subject to all of the conditions required by the Plat and Street Committee, as set forth as "Exhibit A" attached hereto, is accepted, subject to the following: (1) an executed Indemnification and Hold Harmless Agreement in a form acceptable to the City Attorney; (2) a Bond acceptable to the Risk Management Administrator, as required by City of Miami Code Section 54-4. The dedications shown on the plat together with the dedications to the perpetual use of the public of all existing and future planting, trees and shrubbery on said property are also accepted and confirmed by the City of Miami, Florida. Section 2. The City Manager and City Clerk are authorized and directed to execute the plat, and cause the same to be recorded in the Public Records of Miami -Dade County, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.11 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. GIMENEZ City Manager The City of Miami Plat and Street Committee, at its meeting of May 2, 2002, approved the above tentative plat. Please be aware of the following: 1. State and local laws require the installation of various physical Improvements In the public -rights-of-way when property Is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc. caused by this plat will be at the property owner's expense. Also, utility easements may be required on the property being platted. 3. A building permit will not be issued on the property being platted until the final plat is recorded. Also, the Certificate of Occupancy for any building construction will be issued only after -all the required subdivision improvements have been completed. 4. Approval for fire flow requirements must be obtained from the Fire -Rescue Department prior to the Issuance of a building permit. S. Additional Items must be provided to the City of Miami Department of Public works _ before the final plat is submitted to the City Commission for approval. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: (1) The property platted is a replat of the property described in the attached Legal Description. WHEREAS, Developer is the owner of that certain property located in Miami -Dade County more particularly described on Exhibit "A" attached hereto and incorporated herein (the "Property"); and WHEREAS, the Property has been platted into two separate tracts of land known as Tract A and Tract B. A copy of the plat is attached as Exhibit "A"; and WHEREAS, there will be two phases constructed, each with a tower; and WHEREAS, each phase will be independent of the other; and WHEREAS, Developer intends to develop the Property in two phases and may submit each phase to the condominium form of ownership; and WHEREAS, Developer may wish to convey portions of the Property from time to time, developed or undeveloped, totally or partially and may wish to offer units therein as 03- 104 Page 2 condominiums, and this instrument is executed in order to assure that the development of the Property will not violate Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami (the "City") when it is so developed. Developer, as owner of the Property, does hereby agree and declare that in the event legal title to the Property is hereafter ever divided into developed or undeveloped, totally or partially, then (i) for the purpose of determining compliance with all aspects of the Zoning Ordinance of the City, including without limitation, FAR, setbacks and design review standards, parking, etc., the Property shall be considered as one plot and parcel of land, (ii) so long as this instrument shall remain in effect, any and all conveyances or transfers of all or any portion of the Property by Developer, its grantees, successors and assigns, shall be subject to the terms and restrictions of this Declaration as if any such grantee, successor, or assign, were a party hereto or a signatory hereof; and (iii) in the event there are any code violations, the City shall issue a citation to the property owner responsible for said violation for either Tract A or Tract B as referred to on the attached Exhibit "A". 3. Nothing herein shall prohibit the development or conveyance of any phase in a condominium form of ownership or conveying legal title to the Property, developed or undeveloped, totally or partially undeveloped. 4. The provisions of this instrument shall become effective upon their recordation in the Public Records of Miami -Dade County, Florida, and shall continue in effect for a period of thirty (30) years after the date of such recordation, after which time they shall be extended automatically for successive periods of ten (10) years each, unless released in writing by the then owners of the Property (or if any portion of the Property has been submitted to the condominium form of ownership, then by the condominium association governing such condominium in lieu of all of the owners thereof) and the directors of the departments of public works, and planning and zoning of the City, or their respective designees or successors, upon the demonstration and affirmative finding that the same is no longer necessary to preserve and protect the Property for the purposes herein intended. 5. The provisions of this instrument may be amended, modified or released by a written instrument executed by the then owners of the Property (or if any Property has been submitted to the condominium form of ownership, then by the condominium association governing such condominium in lieu of all of the owners thereof) provided same is also ,j3_ 104 Page 3 approved by the directors of the departments, Public Works, Planning and Zoning and Building Departments and approved as to form by the City Attorney. Should this Declaration of Restrictive Covenants be so modified, amended, or released, the directors of the departments of Public Works, Planning and Zoning and Building of the City, or their respective designees or successors, shall forthwith execute a written instrument effectuating and acknowledging such amendments, modifications or release. 6. Enforcement shall be by action against the parties or persons violating or attempting to violate any covenants in this Declaration. The prevailing party to any action or suit pertaining to or arising out of this Declaration shall be entitled to recover, in addition to costs and disbursements allowed by law, such sum as the Court may adjudge to be reasonable for the services of his attorney. This enforcement provision shall be in addition to any other remedies available at law, in equity or both. 7. Invalidation of any of these covenants by judgment of court shall not affect any of the other provisions, which shall remain in full force and effect. 8. All rights, remedies and privileges granted herein shall be deemed to be cumulative and the exercise of any one or more shall neither be deemed to constitute an election of remedies, nor shall it preclude the party exercising the same from exercising such other additional rights, remedies or privileges as may be available to it. 9. An adjacent new development, Park Place at Brickell, proposes as part of its redevelopment to realign the southern portion of this alleyway south of 1428 Brickell Avenue. The realignment will consist of turning the alley 90 degrees (easterly) and reconnecting the alleyway to Brickell Avenue, through a curb -cut, immediately south of 1428 Brickell Avenue office building. The Taplin Company's office building has the following driveways servicing the building: ♦ A two lane, two-way driveway (the lower drive) from Brickell Avenue to the depressed covered parking (right turn in/right turn out). ♦ A two lane, two-way driveway (the upper drive) from Brickell Avenue to the parking deck (right turn in/right turn out). ♦ An exit drive from the remote drive-through bank teller facility to the existing north/south alleyway. ♦ A two lane, two-way driveway from the existing alleyway to the parking deck. The Park Place at Brickell project will consists of 818 residential dwelling units, 7,676 gross square feet of retail and 22,238 gross square feet of restaurant space. As planned, the primary access to Park Place will be via driveways connecting to SE 15' Road and South Miami Avenue. However, all 10 loading docks servicing Park Place will be accessed from the realigned alleyway. STUDY OBJECTIVE The purpose of this study is to analyze the traffic and operational impacts of the proposed realignment of the alley on the existing office building located at 1428 Brickell Avenue. There are six levels of service which range from LOS A (the best condition) to LOS F (the worst condition). LOS A indicates an operating condition where the driver will experience negligible intersection delays to an operating condition of LOS F where the driver will experience long delays. Level of Service B, C, D, and E are intermediate operating conditions with increasing amounts of congestion and delay. In particular, LOS E represents a facility which is operating at its capacity. EXISTING ALLEYWAY TRAFFIC The 24-hour directional machine counts for the conducted for the existing alleyway are summarized in Exhibits 2A & 2B and graphically represented in Exhibit 3. Review of the existing 24-hour volume counts indicates that the majority of the traffic using the alleyway occurs from 7:00 AM to 6:00 PM which coincides with the general business hours of the Brickell Avenue corridor. FUTURE ALLEYWAY ALIGNMENT As described earlier, the Park Place at Brickell project proposes to realign the southern portion of the alleyway south of 1428 Brickell Avenue. The realignment will consist of turning the alley 90 degrees (easterly) and reconnecting the alleyway to Brickell Avenue, through a curb -cut, immediately south of 1428 Brickell Avenue office building. The proposed alignment is shown in Exhibit 4. A review of the Final Plat for Park Place at Brickell indicates the westerly portion of the east/west alleyway has been widened to 54.74 feet to allow fire trucks and service vehicles to negociate the 90 degree turn. However, the physical constraints of the existing 20 foot wide north/south portion of the alleyway will not allow proper two-way operation of the alley. Good engineering design dictates that all turning vehicles should complete all turns within their designated lanes. The proposed Final Plat does not provide sufficient space for two vehicles, traveling in opposite directions along the alleyway, to make the 90 degree turn concurrently, therefore, both the existing portion of the alleyway and the realigned alleyway must be operated as a one-way alley exiting to Brickell Avenue. Therefore, to estimate the amount of service vehicles (trucks) which would use the loading docks of Park Place at Brickell an assumption was made that the mix of vehicles that are on the existing roadways around the site represents the general mix of vehicles which service the developments within the area. Based on this assumption, the two closest Florida Department of Transportation's count stations were reviewed to determine the amount of truck traffic that existed on Brickell Avenue and SE 13`' Street. The average truck traffic from these two count stations was determined to be slightly in excess of 5% of the total daily traffic. Therefore, to estimate the service vehicle volume which would use the alleyway the external trip generation from the Park Place at Brickell Traffic Study was adjusted by this factor (5%) as follows. This statement is incorrect since four of the loading docks require the trucks to back directly into the docks from the alley. This is poor design when considering the number of existing vehicles currently using the alley for other purposes than servicing Park Place. ♦ Two of the proposed loading docks are located perpendicular to the existing 20 foot wide alley. Both of these docks are designed as 35 foot bays to handle trucks up to 50 feet in length. However, both docks cannot be accessed by trucks at the same time since the alley is only 20 feet wide along its original alignment. ♦ The overall arrangement of the loading docks located internal to towers 2 and 3 do not provide adequate maneuvering room with the public access area of the alley to turn into the towers from the alley. ♦ The proposed realignment of the alley to Brickell Avenue is not the closest distance to a public roadway. Turning the alley towards South Miami Avenue would have provided a shorter connection distance. ♦ There is no stacking and parking area provide for trucks waiting to access any of the loading docks abutting the alley directly. Based upon the above analysis, the Final Plat should not be approved because it does not provide adequate servic and public safety to the motoring public.
