A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), GRANTING THE REQUEST OF MIAMI-DADE COUNTY ("COUNTY") TO USE A PORTION OF THE MIAMI MARINE STADIUM PARKING LOT, LOCATED AT APPROXIMATELY 3601 RICKENBACKER CAUSEWAY, MIAMI, FLORIDA, AS DEPICTED IN "EXHIBITS A & B," ATTACHED AND INCORPORATED TO PROVIDE TEMPORARY PARKING FOR THE NASDAQ 100 OPEN TENNIS TOURNAMENT, TO BE HELD AT CRANDON PARK ON KEY BISCAYNE, FLORIDA, FROM MARCH 19, 2003 TO MARCH 31, 2003, IN EXCHANGE FOR THE COUNTY'S CLEAN-UP OF THE PARKING LOT INCLUDING ADJACENT CITY -OWNED LAND AND THE GRANT OF THE CITY'S CONTINUED USE OF THE STABLES AT TROPICAL PARK; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER OF AGREEMENT WITH THE COUNTY, IN SUBSTANTIALLY THE ATTACHED FORM, FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request of Miami -Dade County ("County") to use a portion of the Miami Marine Stadium Parking Lot, located at approximately 3601 Rickenbacker Causeway, Miami, Florida, as depicted in "Exhibit A & B," attached and incorporated, to provide temporary parking for the NASDAQ 100 Open Tennis Tournament, to be held at Crandon Park on Key Biscayne, Florida, iATTA >� �4 , j 7 CITY COMUSSION DMETING OF, JAIL ? 3 ?PM Resolution No, 03- 082 from March 19, 2003 to March 31, 2003, in exchange for the County's clean-up of the parking lot including adjacent City -owned land and the grant of the City's continued use of stables at Tropical Park, is granted. Section 2. The City Manager is authorized!/ to execute a Letter of Agreement, in substantially the attached form, with the County, for said purpose. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.V 1/ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. zi If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. This Resolution further authorizes the City Manager to enter into a Letter Agreement with Miami -Dade County for said purpose. As consideration for the use of the Area, Miami -Dade County has agreed to perform preliminary site work, which shall include adjacent City owned land and allow the City continued use of the stables at Tropical Park. BACKGROUND: The NASDAQ 100 Tennis Tournament, formally known as the Ericsson Tennis Tournament, is scheduled for March 19, 20051 to March 31, 2003. Miami -Dade County has requested to utilize a portion of Miami Marine Stadium as parking for event staff and patrons. As in past years, the City has utilized stables at Tropical Park in Miami -Dade County in exchange for Miami -Dade County utilizing parking at Virginia Key and the Marine Stadium for this special event. On December 16, 2002, the Virginia Key Beach Park Trust, voted not to approve the use of a portion of Virginia Key Beach for temporary parking by Miami -Dade County due to anticipated renovation and construction at Virginia Key Beach. Attached is a summary of the justification for granting parking to the County, which shows that the net effect of leasing the stalls from the City and operating the parking ourselves would be in the negative., 6f['Z9K NASDAQ 100 Tennis To..,nt 2003.doc 03- 082 JUSTIFICATION FOR GRANTING MIAMI-DADE COUNTY PARKING AT MARINE STADIUM IN-KIND SERVICES PROVIDED BY MIAMI-DADE COUNTY TO CITY: I. STABLES AT TROPICAL PARK': a) 25 STALLS: County rate = 25 stalls year round @ $300/mo x 365 days $109,000.00 b) 1 TRAILER: Trailer used by MPD — 40' x 10' = 400 sq. ft. County rental rate = $10/sq.ft. x 400 sq. ft. $4,000.00 c) 1 PASTURE AREA FOR HORSES: 125'x 80'= 10,000 sq.ft. County rate = $2.50/sq.ft. x 10,000 sq.ft. $25.000.00 Total In -Kind Services Provided $138,000.00 POTENTIAL PARKING REVENUE IF CITY OPERATED PARKING POTENTIAL GROSS PARKING REVENUE:Z 800 spaces at Marine Stadium Daily Charge per vehicle = $8.00 x 800 spaces x 13 days $ 83,200.00 LESS PROJECTED OPERATING EXPENSES: 3 $ 85.000.00 Estimated Net Revenue (Loss) from Parking Operation ($ 1,800.00) 1 Fees are based on approved fee schedule by Parks and Recreation Department, County Manager's Office, and Board of County Commissioners. City uses a maximum of 25 stalls during the year, but the monthly number of stalls used varies. County pays water and electric which is included in its Park budget. County does not charge for employee parking at Marine Stadium site. Operated expenses are estimates provided by Miami -Dade County and includes bus service to shuttle individuals to the tennis center. The County does not track this event as a cost center. BOX 330708 MIAMI, FLORIDA 33233-0708 (305)416-1025 FAX (305) 400-5043 This letter serves to confirm that the City of Miami will permit Miami -Dade County ("Licensee") to use a portion of the Marine Stadium parking lot, as depicted in Exhibit A, for purposes of providing parking in connection with the NASDAQ 100 Open Tennis Tournament. Licensee may utilize the areas for the period of March 19 through March 31, 2003. Additionally, Licensee is hereby granted access to the site effective February 3, 2003 in order to perform preliminary site work including clean-up of the site (the "Clean Up"). In consideration of this permission, Licensee shall extend the boundaries of the Clean Up area to include the portion of City owned land located adjacent to the Miami Marine Stadium, commonly known as Parcel B, as depicted in Exhibit B. Additionally, Licensee shall grant the City continued use of the stables at Tropical Park through April 30, 2004. The permission herein granted is further subject to Miami Dade County agreeing to indemnify and hold harmless the City to the extent of the limitations included within Florida Statutes, Section 768.28, subject to the provisions of that Statute whereby the Licensee shall not be held liable to pay a personal injury or property damage claim or judgment by any one person which exceeds the sum of $100,000, or any claim or judgments or portions thereof, which, when totaled with all other occurrences, exceeds the sum of $200,000 from any and all personal injury or property damage claims, liabilities, losses and causes of action which may arise solely as a result of the negligence of the Licensee. However, nothing herein shall be deemed to indemnify the City from any liability or claim arising out the negligent performance or failure of performance of the City or as a result of the negligence of any unrelated third pally.
