RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, AND
AUTHORIZING THE PROCUREMENT OF EQUIPMENT AND
CONTAINERS REQUIRED FOR THE IMPLEMENTATION
OF THE SECOND PHASE OF THE DEPARTMENT OF
SOLID WASTE'S RESIDENTIAL AUTOMATED GARBAGE
AND TRASH COLLECTION SYSTEM, IN AN AMOUNT
NOT TO EXCEED $5,500,000 UTILIZING VARIOUS
ESTABLISHED MUNICIPAL CONTRACTS; AUTHORIZING
THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENT PROJECT NO. 353019.329401.6.840,
ENTITLED "SOLID WASTE REMOVAL PILOT
PROGRAM."
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager's finding of an emergency,
waiving the requirements for competitive bidding procedures, and
authorizing the procurement of equipment and containers required
for the implementation of the second phase of the Department of
Solid Waste's Residential Automated Garbage and Trash Collection
System, utilizing various vendors, in an amount not to exceed

$5,500,000, is ratified, approved and confirmed, with funds
allocated from Capital Improvement Project
No. 353019.329401.6.840, entitled "Solid Waste Removal Project
Program."
Section 2. The City Manager is authorizedll to execute
all necessary documents, in a form acceptable to the City
Attorney, with the various vendors, for said purpose.
Section 3. This Resolution shall become effective
immediately upon its adoption and the signature of the Mayor Y

including but not limited to those prescribed by applicable
provisions of the City Charter and Code.
z/ If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

It is respectfully recommended that the City Commission adopt the attached resolution ratifying,
approving and confirming the City Manager's finding of an emergency, as a result of the City
Commissions' approval of Ordinance No. 12268, amending the annual appropriations and Capital
Improvement Project to increase appropriations in Capital Improvement Project No. 353019, "Solid
Waste Removal Pilot Program;" for the expeditious acquisition of equipment and containers
required for the implementation of the second phase of the Department of Solid Waste's
Residential Automated Garbage and Trash Collection System. Specifically, this action authorized
the City Manager to waive formal competitive bidding procedures authorizing the utilization of
various established municipal contracts (Escambia and Palm Beach Counties) respectively for said
acquisitions. Funds are allocated in an amount not to exceed $5,500,000.00, from Capital
Improvement Project No. 353019.329401.6.840.
BACKGROUND:
Pursuant to the City Commissions' action and approval of Resolution No. 01-591, on June 14, 2001,
directing the City Manager to take all steps necessary for the expeditious acquisition of equipment
and containers required for the implementation of the first phase of the Department of Solid
Waste's Residential Automated Garbage and Trash Collection System, and the subsequent
approval of Ordinance No. 12268 increasing the appropriations in Capital Improvement Project No.
353019 for the purchase of equipment for the second phase of this collection system, an
emergency designation was warranted. As a result of this action, the City Manager was authorized
to accept the most reasonable, responsive and responsible. bid (s), utilizing various existing
municipal contracts to procure the equipment and containw and execute all necessary
documents, in a form acceptable to the City Attorney, for required acquisitions.

Pursuant to City Commission approval and authorization by Ordinance No. 12268, amending the
annual appropriations and Capital Improvement Project to increase appropriations in Capital
Improvement Project No. 353019, "Solid Waste Removal Pilot Program;" approval is sought for the
expeditious acquisition of all equipment and containers required for the implementation of the
second (2^d) phase of the department's residential automated garbage and trash collection system.
The equipment and containers will be secured under "Piggy Back" contracts from Escambia and
Palm Beach Counties respectively (see attached). This purchase will not exceed $5,500,000.00
and funding is available in FY'02-'03 Capital Improvement Project No. 353019.329401.6840.
Your signature below will indicate the approval of such an emergency finding for said acquisitions
and services and resultantly ratification of this action will be scheduled before the City Commission
as soon as practicable.
