BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Elevator Services for the Miami Riverside Center RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached resolution ratifying, approving, and confirming by a four-fifths (4/5th,) affirmative vote, the City Manager's finding that an emergency situation existed, thus waiving the requirements for competitive bidding procedures and awarding the continuation of Elevator Maintenance Services to Schindler Elevator Corporation, a Non-Local/Non-Minority vendor located at 15751 S.W. 41 Street, Suite 100, Davie, Florida 33331-1502, for the Department of General Services Administration, Miami Riverside Center Building and Parking Garage, for a period of three (3) months commencing July 1, 2002 through September 30, 2002, in an amount not to exceed $6,300. Funding for this purchase is available from the Department of General Services Administration, Miami Riverside Center Division, Account Code No. 504000.421901.6.670. BACKGROUND The Department of General Services Administration went to City Commission on April 25, 2002 and under Reso. No. 02473 was granted the provision of Elevator Maintenance Services from Schindler Elevator Corporation, a sole source provider, for a period of one year, with the option to renew for four additional one-year periods, in an amount not to exceed $25,200 for the first year, and annual increases not to exceed five percent (5%) subject to negotiation. Unfortunately, the contract review process took longer than expected and our City Attorney's office was not able to come into agreement with Schindler's Elevator Corporation's attorney office. Ernmencv Justification The Department of General Services Administration went to City Commission on April 25, 2002 and under Reso. No. 02-473 was granted the provision of Elevator Maintenance Services from Schindler Elevator Corporation, a sole source provider, for period of one year, with the option to renew for four additional one-year periods, in an amount not to exceed $25,200 for the first year, and annual increases not to exceed five (5) percent subject to negotiation. Unfortunately, the contract review process took longer than expected and our City Attorney's office has not been able to come into agreement with Schindler's Elevator Corporation's attorney's office. Should this request be rejected, a new bid process must be started. To avoid any lapse in service while the sole source or bid process for the new contract award is being properly secured, this Department is requesting your authorization for an emergency purchase for the provision of elevator maintenance services for the MRC Facility, for a period of three (3) months, commencing 7/1/02 through 9/30/02, in an amount not to exceed $6,300. Solicitation Schindler Elevator Corporation has agreed to provide these services from 7/01/02 through 9/30/02, in a total amount not to exceed $6,300. 03- 044 I Carlos A.
