A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR-FIFTHS (4/5THS ) AFFIRMATIVE VOTE,
RATIFYING, APPROVING AND CONFIRMING THE
BAYFRONT PARK MANAGEMENT TRUST'S EXECUTIVE
DIRECTOR'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS
AND AWARDING A CONTRACT TO GANCEDO
TECHNOLOGIES, FOR THE RE-PULL OF MAIN POWER
TO THE MILDRED AND CLAUDE PEPPER FOUNTAIN AND
PUMP HOUSE AT BAYFRONT PARK, IN AN AMOUNT NOT
TO EXCEED $96,400; ALLOCATING FUNDS FROM THE
BAYFRONT PARK MANAGEMENT TRUST CAPITAL
IMPROVEMENT BUDGET.
WHEREAS, the Mildred & Claude Pepper Fountain at Bayfront
Park operates 24 hours a day, 365 days per year, and serves as
the center piece of Downtown Miami; and
WHEREAS, on August 26, 2002, the Bayfront Park Management
Trust ("Trust") received an electrical violation (Reference CR
#01-11452) from the Chief of the Electrical Section of the City
of Miami which warranted "hazardous wiring conditions" at the
Fountain; and
WHEREAS, the Trust, at the September 30, 2002 Board meeting,
authorized the Executive Director to proceed with an emergency
repair of the Fountain pursuant to Resolution No. 02-056; and

WHEREAS, Bayfront Park staff placed the project out to bid
using the City of Miami approved contractor list; and
WHEREAS, a pre-bid meeting with four contractors was held at
Bayfront Park and from those four, one contractor responded with
a bid; and
WHEREAS, the responding contractor, Gancedo Technologies,
was awarded the contract; and
WHEREAS, The Trust, at the November 25, 2002, Board meeting
ratified, approved and confirmed the Executive Director's action
for the repair of the re-pull of the main power in an amount not
to exceed $96,400; and
WHEREAS, funds are available from the Bayfront Park
Management Trust's Capital Improvement Budget to pay for said
service;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5ths) affirmative vote,
the Bayfront Park Management Trust's Executive Director's finding
of an emergency, waiving the requirements for competitive sealed
bids and awarding a contract to Gancedo Technologies, for the

re-pull of main power to the Mildred and Claude Pepper Fountain
and pump house at Bayfront Park, in an amount not to exceed
$96,400, is ratified, approved and confirmed, with funds
allocated from the Bayfront Park Management Trust Capital
Improvement Budget.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayoral

It is respectfully recommended that the Miami City Commission adopt the attached Resolution
ratifying, approving and confirming the Executive Director of the Bayfront Park Management Trust's
finding of an emergency, waiving the requirements for competitive sealed bids and approving the
re-pull of main power to the Mildred and Claude Pepper Fountain and pump house at Bayfront Park
in an amount not to exceed $96,400.00 payable to Gancedo Technologies. Funding is available from
the Bayfront Park Management Trust Capital Improvement Budget.
BACKGROUND
The Bayfront Park Management Trust was created by the Miami City Commission to direct,
operate, manage and maintain all aspects of Bayfront Park with the goal of ensuring maximum
community involvement. Notification of an electrical violation (Reference # CR 01-11452) was
received on August 26, 2002, from Orestes Castillo, Chief, Electrical Section, of the City of
Miami warranting "hazardous wiring conditions" existing at Bayfront Park's Mildred and Claude
Pepper Fountain and pump house. The Trust at the September 30, 2002, Board meeting
authorized the Executive Director to proceed with this emergency repair through Resolution No.
02-056. Staff immediately put this project out to bid using the City of Miami approved
contractor list. A pre-bid meeting was held at Bayfront Park where four contractors participated.
From those four, one contractor responded with a bid. Gancedo Technologies was awarded the
contract. The Trust, at the November 25, 2002, Board meeting, approved the expenditure for
repair of the re-pull of main power in an amount not to exceed $96,4000.00 through Resolution
No. 02-070. This purchase is deemed an emergency because the immediate procurement of the
repairs is essential to the safety and convenience of the City.

Dear Mr. Orestes,
I appreciate your continued cooperation with the Bayfront Park Management Trust as we attempt
to correct the existing code violation located in Bayfront Park, in the area adjacent to the fountain
control booth. The repair of this violation, which has been in the park since its construction in
1987, has been a priority for the Trust for the past 14 months. We are currently waiting for bid
specifications from procurement, which are due in this office soon. We are also in negotiations
with FPL regarding use of existing conduit to expedite this project. I will contact you as soon as
we are ready to proceed.

Correct dangerous condition for wiring at electrical
installation at the vicinity of main water fountain. That is in
violation of Nec 240.21 and Nec 300.5.
Solution: Must contact a professional electrical engineer to
provide proper guidance and design to resolve present
situation.
Contact a licensed electrical contractor to pull electrical permit
and to perform corrective work as per P.E recommendations
and design.

are listed on the attached sheet.
Please regard this letter as notice to have the violations corrected by a licensed electrical contractor
within forty-eight hours after the receipt of this letter, or we may be forced to order the service to be
disconnected by the Florida Power & Light Company (in compliance with the Florida Building Code to
safeguard life and property.
If you have any questions regarding the contents of this letter, please contact the above-named Electrical
Inspector by calling this office at (305)416-1100, between 8:00 A.M. to 8:30 A.M. and 4:00 P.M. to 4:30
P.M., Monday thru Friday.
A $50.00 administrative fee is due upon receipt of this notice. Failure to make payment will result in a
lien placed against the above mentioned property.

DL'MOLITION
1. Remove designated electrical equipment from the fenced area. Electrical items shall become
property of the contractor, unless noted otherwise (see detail below and shall be removed
from the site.
2. Remove glass windows from control booth. Block opening with concrete blocks. Stucco and
paint both sides to match surrounding areas.
3. Remove worktable and cabinets from control booth upper level. Paint walls to match
surrounding area.
4. Remove wires from underground conduits that run from the FPL vault to the panel board
"MDF" at the control booth, and from pull box #1 (PB #1) to the fenced area.
5. Fill underground conduits from panel board "MDF" to pull box #1 with weatherproof, water
resistant material and cap. Submit product cut sheet of material for approval.
CONTROL BOOTH
6. Provide and install 2'X2' fixed window with impact resistant glass as per Miami -Dade County
approval.
7. Provide and install steel grating to cover opening located below worktable.
8. Provide and install one 800 AMP, heavy duty, fusible safety switch at upper level.
9. Provide and install conduits and wires from the new 800 AMP safety switch to panel board
"MDF" at the lower level.
10. Provide and install conduits from the upper level to pull box #1.
11. Provide and install four sets of copper wires from the upper level to the electrical room at
the laser tower (also see #'s 19-22 below).
12. Relocate the 200 AMP, heavy-duty safety switch (for sprinkler pumps) to upper level.
13. Relocate the 200 Amp, safety switch (transformer primary) at upper level. Relocate existing
burglar alarm panel. New location shall be determined in the field.
14. Relocate the 112.5 KVA transformer to the lower level. Support transformer as shown on
sheet E-3. Connect transformer to 200 AMP safety switch at lower level.
15. Provide and install two (2) panel boards ("X " and "Y"), connect to 112.5 KVA transformer
secondary.
SERVICE BUILDING
16. Provide and connect temporary 400 KW standby generator system. Generator shall provide
electrical power to the service building during the replacement of the #400 MCM copper
wires.
17. Provide and install one 800 AMP, 600 VOLT, 30, NEMA I, heavy-duty safety switch inside
the electrical room. Safety switch shall be suitable for service entrance.
18. Provide and install conduit and wires from new 800 AMP safety switch to FPL vault for
electrical service connection.
19. Provide and install Brooks pull box (#3) in the path of the existing YO underground conduits.
20. Provide and install underground conduits from new pull box (#3) to the new 800 AMP safety
switch inside electrical room. Repair affected concrete slabs to match surrounding areas.
21. Provide and install one (1) 200 AMP, 30 inverse -time circuit breaker in panel "H" and connect
to 2 existing irrigation pump disconnects in pump house area

On August 26, 2002, the Bayfront Park Management Trust received notification
of an electrical violation from Orestes Castillo, Chief Electrical Section of the City of
Miami, identifying hazardous wiring conditions in Bayfront Park. Staff immediately
began process to procure repair services to the said condition. The Trust authorized the
Executive Director to proceed with emergency repair at its September 30, 2002, meeting.
Staff is herewith directed to affect these repairs as soon as the event calendar
permits and subject to procurement regulations of the City of Miami. This purchase is
deemed an emergency because the immediate procurement of these services is essential
to the safety and convenience of the city.

This project was put out to bid as an emergency repair due to an electrical violation
(Reference # CR 01-11452) sighted by The City of Miami, Chief Electrical Inspector
Orestes Castillo August 27,2002. Four electrical contractors where contacted from
the cities contractor list to bid on this project. A pre bid meeting was held at Bayfront
Park and all four contractors showed up for the meeting. Only one contractor
responded with a bid. The contractor (Gancedo Technologies) that submitted a bid
was awarded the contract.
