A RESOLUTION OF THE MIAMI CITY COMMISSION GRANTING AN EXTENSION, FROM MARCH 1, 2002 TO MARCH 31, 2004, TO THE RAFAEL HERNANDEZ HOUSING AND ECONOMIC DEVELOPMENT CORPORATION TO CONSTRUCT, MARKET AND SELL FOUR NEW SINGLE FAMILY HOMES PLANNED ON FOUR CITY -OWNED PARCELS IN THE ALLAPATTAH AND WYNWOOD COMMUNITY REVITALIZATION DISTRICTS FOR LOW AND MODERATE -INCOME FAMILIES; STATING INTENTION OF CITY COMMISSION RELATED TO DATE OF TITLE CONVEYANCE; AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENT(S) TO CONFIRM THE CONVEYANCE OF SAID PARCELS. WHEREAS, at its meeting of September 14, 1995, the City Commission adopted Resolution No. 95-612 that designated Rafael Hernandez Housing and Economic Development Corporation ("Corporation") to develop six new single family homes on five City -owned parcels in the Allapattah and Wynwood neighborhoods; and WHEREAS, the adopting legislation further included the requirement that the Corporation prepare housing plans and specifications, identify construction and permanent financing, and develop a construction schedule for completion within twelve months from the date that the project received City Commission approval; and CITY COMMISSION METING OF Resolution No. 03- 032 WHEREAS, pursuant to Resolution No. 00-346, adopted April 7, 2000, the City Commission granted a twelve month extension, from April 25, 2000 to April 25, 2001, to the Corporation to complete the construction and marketing of five new single family homes on City -owned parcels; and WHEREAS, pursuant to Resolution No. 00-1087, adopted December 14, 2000, the City Commission granted the Corporation an extension from April 25, 2001 to December 14, 2001, to complete construction and market the new single family homes planned; and WHEREAS, pursuant to Resolution No. 01-641, adopted July 10, 2001, the City Commission granted the Corporation another extension, from December 14, 2001 to March 1, 2002; and WHEREAS, the Corporation has completed construction and sold one single-family home located on one of the City -owned parcels located at 3453 Northwest 11th Court, Miami, Florida; and WHEREAS, due to delays in conveying the subject parcels in a timely manner to the Corporation, the Administration recommends another extension from March 1, 2002 to March 31, 2004, for the organization to complete construction and sell the four remaining single family homes to qualified low and moderate -income homebuyers; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Page 2 of 4 03- 032 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An extension, from March 1, 2002 to March 31, 2004, is granted to Rafael Hernandez Housing and Economic Development Corporation to construct, market and sell four new single-family homes planned on four City -owned parcels in the Allapattah and Wynwood Community Revitalization District for low and moderate -income families. Section 3. It is in the intention of the City Commission that title to the City -owned parcels conveyed to the Corporation shall be deemed to have remained in the Corporation from the date of conveyance, and therefore, the extension of time granted herein shall be deemed to have been made on or before March 1, 2002. Section 4. The City Manager is authorized -11 to execute all necessary document(s), in a form acceptable to the City Attorney, to confirm the conveyance of the said parcels, subject to the completion of construction and marketing of the single-family homes to qualified low and moderate -income participants by March 31, 2004, or title to the said parcels shall revert back to the City. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. REFERENCES: City Commission Meeting of ENCLOSURES: January 9, 2003 It is respectfully recommended that the City Commission adopt the attached resolution authorizing and granting an extension from March 1, 2002 to March 31, 2004 to the Rafael Hernandez Housing and Economic Development Corporation ("Corporation'), in the construction and sale of four (4) new single family homes planned on four (4) city -owned parcels in the Allapattah and Wynwood Community Revitalization Districts; further authorizing the City Manager to execute the necessary documents, in a form acceptable to the City Attorney, for conveyance of the subject parcels, at no cost to the corporation, subject to certain terms and conditions. BACKGROUND: At its meeting of September 14, 1995, the City Commission adopted Resolution No. 95-612 that designated Rafael Hernandez Housing and Economic Development Corporation to develop six (6) new single family homes on five (5) City -owned parcels in the Allapattah and Wynwood neighborhoods. The authorizing legislation further included the requirement that Rafael Hernandez Housing and Economic Development Corporation prepare housing plans and specifications, identify construction and permanent financing, and develop a construction schedule for completion within twelve (12) months from the date that the project received City Commission approval. Subsequently, due to title problems and other issues impairing development which transpired over the next several years, the City Commission approved several extensions to the original approval. This included extensions from April 25, 2000 to April 25, 2001, then to December 14, 2001 and finally to March 14, 2002 for Rafael Hernandez Housing and Economic Development Corporation to complete the financing plans, construction and marketing of the five (5) new single family homes to qualified low and moderate income families in the City. As a result of certain title defects that impeded construction on one (1) of the homes, the City Commission also adopted legislation to provide an alternate city -owned parcel located at 229 Northwest 30th Street to replace a parcel located at 1264 Northwest 31St Street. Through all the challenges that the project has encountered over the years, Rafael Hernandez Housing and Economic Development Corporation is now in a position to move forward with the construction. 03- 032 The organization has secured construction financing from CitiBank/CitiGroup and has joint ventured with a private sector builder, Wind & Rain, Inc., to ensure timely construction of the homes within the March 31, 2004 timeline established in the proposed legislation. It should also be noted that previous legislation relating to this project identifies five (5) new single family homes to be constructed and the proposed legislation extending construction deadlines references only four (4) homes. The reason for this adjustment is that Rafael Hernandez Housing and Economic Development Corporation has been successful in completing the build out of the property located at 3453 NW 11 Court and an eligible homebuyer is living at this address. Due to the circumstances and the delays in the conveyance of the subject parcels in a timely manner to the corporation, it is recommended that the City Commission adopt the proposed resolution that provides an additional extension from March 1, 2002 to March 31, 2004 for Rafael Hernandez Housing and Economic Development Corporation to complete construction and market the single family homes to qualified low and moderate income homebuyers on the final four (4) sites. If construction and the marketing of the homes is not completed by March 31, 2004, the subject parcels will revert back to the City. Discussion and proposed resolution of the City of Miami Commission relating to funding for the 2002-2003 Housing Opportunities for Persons With AIDS (HOPWA) Program, by moving funding to three (3) previously approved agencies from the Supportive Housing Category to the Long Term Assistance Category, revising allocations to providers of Long Term Housing Assistance consistent with the absorption of clients resulting from the closeout of the contract with the Miami -Dade Housing Agency, eliminating the allocation of funds for the payment of Utility Assistance in the Long Term Assistance Program and moving the balance of previously approved HOPWA funds as a result of said revisions to a HOPWA Contingency Fund for future distribution following the completion of a needs assessment and development of a strategic plan to most effectively provide housing assistance and housing related services to low income individuals living with HIV/AIDS; allocating $50,000 of HOPWA funds to Apple Tree Perspectives, Inc. to complete the needs assessment; and further authorizing the City Manager to execute individual agreements with approved agencies, in a form acceptable to the City Attorney. 2. Discussion and proposed resolution authorizing and granting an extension from March 1, 2002 to March 31, 2004 to the Rafael Hernandez Housing and Economic Development Corporation ("Corporation"), in the construction and sale of four (4) new single family homes planned on four (4) city -owned parcels in the Allapattah and Wynwood Community Revitalization Districts. 3. Discussion and proposed resolution allocating $36,650 of Community Development Block Grant (CDBG) funds to Catholic Charities of Greater Miami, Inc. to provide elderly meal services at Claude Pepper Tower. 4. Discussion and proposed resolution authorizing and directing the City Manager to convey a City -owned parcel located at 2368 NW 35 Street at no cost to Greater Miami Community Services, Inc., for the purpose of rehabilitating said property to provide housing opportunities for low income persons. U 1" 641 A RESOLUTION OF THE MIAMI CITY COMMISSION, GRANTING AN EXTENSION OF TIME FROM DECEMBER 14, 2001 TO MARCH 1, 2002, TO THE RAFAEL HERNANDEZ HOUSING AND ECONOMIC DEVELOPMENT CORPORATION IN CONNECTION WITH THE CONSTRUCTION AND SALE OF FIVE (5) NEW SINGLE FAMILY HOMES FOR QUALIFIED LOW AND MODERATE -INCOME FAMILIES PLANNED ON FIVE (5) CITY -OWNED PARCELS IN THE ALLAPATTAH AND WYNWOOD COMMUNITY REVITALIZATION DISTRICTS. WHEREAS, pursuant to Resolution No. 00-346, adopted April 27, 2000, the City Commission authorized the conveyance of certain parcels of real property to The Rafael Hernandez Housing and Economic Development Corporation (the "Corporation"), and granted a twelve (12) month extension, from April 25, 2000 to April 25, 2001 to the Corporation to complete the construction and marketing of five (5) new single family homes on those parcels; and WHEREAS, pursuant to Resolution No. 00-1087, adopted December 14, 2000, the City Commission, granted the Corporation an extension from April 25, 2001 to December 14, CITYwratem _ DI ETI= 'iw JU L 1 0 2001 03- 03 2001, to complete the construction of and to market the five new single family homes planned; and WHEREAS, pursuant to Resolution No. 00-1087, the City Commission authorized the City Manager to provide an alternate parcel located at 229 Northwest 30th Street, Miami, Florida, in lieu of the City -owned parcel located at 1264 Northwest 315t Street for conveyance to the Corporation; and WHEREAS, due to delays in conveying the subject parcels to the Corporation, the Administration recommends granting an extension of time from December 14, 2001 to March 1, 2002, for the Corporation to complete the construction of and to market the five single family homes to qualified low and moderate income homebuyers; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Page 2 of 4 03— 032 Section 2. An extension of time, from December 14, 2001 to March 1, 2002, is granted to The Rafael Hernandez Housing and Economic Development Corporation to complete the construction and sale of five (5) single family homes for qualified low and moderate -income families planned on the five (5) parcels referenced above in the Allapattah and Wynwood Community Revitalization Districts. Section 4. The City Manager is authorized!' to execute all necessary document(s), in form acceptable to the City Attorney, for the conveyance of the said parcels, at no cost to the Corporation and subject to the completion of construction and marketing of the single family homes to qualified low and moderate income by March 1, 2002(or title to the said parcels shall revert back to the City). Section S. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2/ 1J The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Rafael Hernandez Housing and Economic Development Corporation, a not-for-profit corporation, is hereby designated, in principle, as sponsor to undertake the development of six (6) new single family homes affordable to low and moderate income families and individuals on several vacant City -owned parcels located in the Allapattah neighborhood, more particularly described in Exhibit A, subject to said corporation providing evidence acceptable to the City of firm commitments for project construction and permanent financing. Section 3. Rafael Hernandez Housing and Economic Development Corporation is hereby directed to prepare and finalize housing plans and specifications, construction and permanent financing, construction schedule for the obtaining of building permits within six (6) months and construction to be completed within twelve (12) months from the date of this action. Subject parcels to revert back to the City if construction is not completed within twelve (12) months from the date of this action. 032 -2-��• c Section 4. The City Commission hereby establishes $40,465 as the acquisition amount to be paid by the sponsor to the City of Miami for said parcels for the subsequent development of the six (6) new single family homes being planned. Section 5. The City Manager is hereby authorized 1/ to execute the appropriate documents, in forms acceptable to the City Attorney, conveying said parcels, more particularly and legally described in the attached Exhibit "A" to the sponsor. The acquisition amount for said parcels to be paid the City shall be placed in the form of a first mortgage lien and satisfied at the consummation of each purchase transaction. Subordination of said lien shall be subject to review and acceptance by the City Manager of any further financing provided for the development of the proposed single family homes. Section 6.
