A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH
ATTACHMENT(S), AUTHORIZING AND DIRECTING THE CITY
MANAGER TO CONVEY AND DISPOSE OF, AT NO COST, A
CITY -OWNED PARCEL LOCATED AT 2368 NORTHWEST 35TH
STREET, MIAMI, FLORIDA, LEGALLY DESCRIBED IN
"EXHIBIT A," ATTACHED AND INCORPORATED, TO
GREATER MIAMI COMMUNITY SERVICES, INC., A
NON-PROFIT ORGANIZATION, FOR SAID PROPERTY TO BE
REHABILITATED TO PROVIDE AFFORDABLE HOUSING
OPPORTUNITIES FOR ELIGIBLE LOW-INCOME PERSONS
PARTICIPATING IN THE SECTION 8 HOUSING PROGRAM,
CONDITIONED UPON GREATER MIAMI COMMUNITY
SERVICES, INC. COMMENCING AND COMPLETING THE
REHABILITATION OF THE 12 -UNIT FACILITY WITHIN
TWELVE MONTHS FROM THE DATE OF THE CONVEYANCE OF
THE PARCEL OR THE PROPERTY SHALL REVERT BACK TO
THE CITY; FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, CONVEYING THE
CITY -OWNED PARCEL TO SAID AGENCY, SUBJECT TO
CERTAIN TERMS AND CONDITIONS.
WHEREAS, at its meeting of

living with AIDS; and

WHEREAS, such funding award was contingent upon the
organization acquiring site control of the building to be
rehabilitated, identified as City -owned property located at 2368
Northwest 35th Street, Miami, Florida; and
WHEREAS, this property is included among the 29 properties
identified in the City's defaulted loan portfolio as published
in the Audit Report issued by the Office of the Inspector
General in March 1998; and
WHEREAS, the City acquired the rights to this property by
filing foreclosure proceedings against the defaulted party; and
WHEREAS, Greater Miami Community Services, Inc. met with
neighborhood residents and determined that the community was
supportive of an affordable housing project, but was in
opposition to establishing a facility to provide housing for
persons living with AIDS; and
WHEREAS, Greater Miami Community Services, Inc. has
requested that the City donate the property to the Agency which
shall assume responsibility to rehabilitate the 12 -unit facility
to provide affordable housing opportunities in the Allapattah
neighborhood for eligible low-income persons; and
WHEREAS, Section 29-B of the City Charter allows for the
conveyance or disposition of City -owned property in connection
with the implementation of City -assisted housing programs or
projects which are intended to benefit persons or households of

low and/or moderate income without being subject to competitive
bidding requirements and fair market value return to the City;
and
WHEREAS, the City Commission adopted Resolution No. 99-429
at its meeting of June 22, 1999, which approved the City's
Five -Year Consolidated Plan (1999-2004), and authorized the
conveyance of City -owned property at no cost if utilized for the
development of affordable housing in the City; and
WHEREAS, the Administration recommends the conveyance of
the subject City -owned parcel to Greater Miami Community
Services, Inc., to renovate the 12 -unit building on this parcel
to provide affordable housing opportunities, conditioned upon
rehabilitation to be commenced and completed within twelve
months from the date of conveyance or the parcel shall revert
back to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

Section 2. The City Manager is authorized!' and directed
to convey and dispose of, at no cost, a City -owned parcel
located at 2368 Northwest 35th Street, Miami, Florida, legally
described in "Exhibit A," attached and incorporated, to Greater
Miami Community Services, Inc., a non-profit organization, for
said property to be renovated and provide affordable housing
opportunities for eligible low-income persons participating in
the Section -8 Housing Program, conditioned upon Greater Miami
Community Services, Inc. commencing and completing renovation of
the 12 -unit facility within twelve months from the date of
conveyance of the parcel, or the property shall revert back to
the City.
Section 3. The City Manager is authorized" to execute
all necessary documents, in a form acceptable to the City
Attorney, with Greater Miami Community Services, Inc. to
effectuate the conveyance of said parcel to said agency, subject
to certain terms and conditions, included but not be limited to,
the following:
1 The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

1. The units shall be made available to low-income
persons in accordance with HUD guidelines.
2. The affordability/eligibility period shall be for
a period of not less than 15 years.
3. The Agency shall execute a mutually acceptable
Rent Regulatory Agreement with the City.
4. The grantee shall agree to incorporate
affirmative outreach procedures and comply with
Fair housing requirements.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.

It is respectfully recommended that the City Commission adopt the attached resolution,
authorizing and directing the City Manager to convey a City -owned parcel located at 2368 NW
35 Street at no cost to Greater Miami Community Services, Inc., for the purpose of rehabilitating
said property to provide housing opportunities for low income persons; and further authorizing
the City Manager to execute the appropriate legal documents, in a form acceptable to the City
Attorney, for this purpose.
BACKGROUND:
At its meeting of July 10, 2001, the City Commission awarded Greater Miami Community
Services, Inc. $250,000 of Housing Opportunities for Persons With AIDS (HOPWA) funds to
rehabilitate a facility to provide affordable housing for persons living with AIDS. This funding
award was contingent upon the organization acquiring site control of the building eventually to
be rehabilitated.
Subsequently, Greater Miami Community Services, Inc. identified a City -owned property
located at 2368 NW 35 Street for possible development. This property is included among the 29
properties identified in the City's defaulted loan portfolio published in the Audit Report issued
by the Office of the Inspector General in March 1998. As a condition of the settlement of
findings identified in the Audit Report, the mutually accepted Corrective Action Plan requires
the City of Miami to aggressively exercise appropriate legal action to recover HUD investments
in the defaulted loan portfolio and protect the interests of the federal government. As a result,
the City was successful in acquiring the rights to this property by filing foreclosure proceedings
against the defaulted party.
Greater Miami Community Services, Inc. a non-profit organization, has requested the City to
donate the property to the Agency. The Agency will then rehabilitate the 12 unit facility and
establish an affordable rental project for low income persons. In meetings with area residents
and the District 1 Commissioner, representatives from Greater Miami Community Services, Inc.
understand that there is a need for affordable housing in the neighborhood, but there is
community opposition to a HOPWA facility. In requesting the City of Miami to transfer
ownership of the property to Greater Miami Community Services, Inc., the organization has

indicated in writing that it will "accept the responsibility for rehabilitating the building and
maintaining affordable rental units throughout the required affordability period".
The 12 -unit facility provides a suitable building to establish a much needed affordable housing
project to eligible clients at this location. In addition, the City of Miami will also meet the
mandate of its HUD Corrective Action Plan since it acquired the property through its foreclosure
action and continues to maintain the property as an affordable housing project to meet the City's
affordable housing needs.
Conveyance of the subject property will be subject to conditions, including, but not limited to the
following:
1. Greater Miami Community Services, Inc. must commence and complete renovation of
the building located on the subject property within twelve (12) months from the date of
the conveyance of the subject parcel or it shall revert back to the City.
2. The units must be made available to low income persons in accordance with HUD
guidelines.
3. The Affordability / eligibility period must be for a period of not less than 15 years.
4. The Agency must execute a mutually acceptable Rent Regulatory Agreement with the
City.
5. The grantee must agree to incorporate affirmative outreach procedures and comply with
Fair housing requirements.
In an effort to provide affordable housing units in the Allapattah to meet the needs of eligible
low income persons, it is recommended that the City Commission adopt the proposed resolution
that authorizes and directs the City Manager to convey at no cost to Greater Miami Community
Services, Inc. a City -owned parcel located at 2368 NW 35 Street for the purpose of rehabilitating
said property to provide affordable housing opportunities for participants in the Section 8
Program and further authorizes the City Manager to execute the appropriate legal documents, in
a form acceptable to the City Attorney, for this purpose.
The proposed Resolution involves the conveyance of land to a developer of affordable
housing and does not have a budgetary impact on the General -Fund.

The Miami City Commission will hold a Public Hearing to discuss the following Community Development
issues:
1. Discussion and proposed resolution of the City of Miami Commission relating to funding for
the 2002-2003 Housing Opportunities for Persons With AIDS (HOPWA) Program, by
moving funding to three (3) previously approved agencies from the Supportive Housing
Category to the Long Term Assistance Category, revising allocations to providers of Long
Term Housing Assistance consistent with the absorption of clients resulting from the closeout
of the contract with the Miami -Dade Housing Agency, eliminating the allocation of funds for
the payment of Utility Assistance in the Long Term Assistance Program and moving the
balance of previously approved HOPWA funds as a result of said revisions to a HOPWA
Contingency Fund for future distribution following the completion of a needs assessment and
development of a strategic plan to most effectively provide housing assistance and housing
related services to low income individuals living with HIV/AIDS; allocating $50,000 of
HOPWA funds to Apple Tree Perspectives, Inc. to complete the needs assessment; and further
authorizing the City Manager to execute individual agreements with approved agencies, in a
form acceptable to the City Attorney.
2. Discussion and proposed resolution authorizing and granting an extension from March 1,
2002 to March 31, 2004 to the Rafael Hernandez Housing and Economic Development
Corporation ("Corporation'), in the construction and sale of four (4) new single family homes
planned on four (4) city -owned parcels in the Allapattah and Wynwood Community
Revitalization Districts.
3. Discussion and proposed resolution allocating $36,650 of Community Development Block
Grant (CDBG) funds to Catholic Charities of Greater Miami, Inc. to provide elderly meal
services at Claude Pepper Tower.
4. Discussion and proposed resolution authorizing and directing the City Manager to convey a
City -owned parcel located at 2368 NW 35 Street at no cost to Greater Miami Community
Services, Inc., for the purpose of rehabilitating said property to provide housing opportunities
for low income persons.
