FOR REPRESENTATION OF THE CITY OF MIAMI IN THE CASE OF ANGEL ALVAREZ VS. CITY OF MIAMI, ET AL. IN THE U.S. DISTRICT COURT FOR THE SOUTHERN DISTRICT OF FLORIDA, CASE NO. 00 -2151 -CIV -JORDAN, IN THE AMOUNT OF $25,000, PLUS COSTS AS APPROVED BY THE CITY ATTORNEY; ALLOCATING FUNDS FROM THE SELF-INSURANCE AND INSURANCE TRUST FUND, ACCOUNT CODE NO. 515001.624401.6.652, FOR SAID SERVICES. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The continued engagement of the law firm of O'Connor, Chimpoulis, et al. for representation of the City of Miami in the case of Angel Alvarez vs. City of Miami, et al. in the U.S. District Court for the Southern District of Florida, Case No. 01 -2151 -CIV -JORDAN, in the amount of $25,000, plus costs as approved by the City Attorney, is authorized, with CITY COMMON MEETING .CK' JAN 0 9 7003 Resolution I%D- funds allocated from the Self -Insurance and Insurance Trust Fund, Account Code No. 515001.624401.6.652, for said services. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission. The attached proposed Resolution seeks authorization for the continued engagement of the law firm of O'Connor, Chimpoulis, et al., for representation of the City of Miami in the case of Angel Alvarez vs. City of Miami, et al., in the U.S. District Court for the Southern District of Florida, Case No. 00 -2151 -Civ -Jordan, in the amount of $25,000 plus costs as approved by the City Attorney. Resolution No. 02-22, adopted January 10, 2002, Resolution No. 02-625, adopted June 13, 2002, Resolution No. 02-969, adopted September 11, 2002, and Resolution No. 02-1158 adopted October 29, 2002, each approved the allocation of $25,000 for this case. Approval of this Resolution will bring the total amount to $125,000. Outside counsel was initially retained because of a conflict of interest. Further attorney's fees will be necessary to complete discovery and prepare this case for trial.
