RESOLUTION NO. 03— 014
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CONTINUED ENGAGEMENT OF THE LAW
FIRM OF WEISS SEROTA HELFMAN PASTORIZA &
GUEDES, P.A., IN AN AMOUNT NOT TO EXCEED
$100,000 PLUS COSTS AS APPROVED BY THE CITY
ATTORNEY, FOR REPRESENTATION OF THE CITY OF
MIAMI IN CASES RELATED TO THE DEFENSE OF THE
CITY OF MIAMI PARKING SURCHARGE ORDINANCE,
INCLUDING BUT NOT LIMITED TO: AMPCO SYSTEM
PARKING, INC., ET AL. VS CITY OF MIAMI, CASE
NO. 01-27582 CA (15), PARK A. PARTNERS, LTD.,
ET AL. VS CITY OF MIAMI, CASE NO. 01-20074 CA
(06), AND PATRICK MCGRATH, III VS THE CITY OF
MIAMI, CASE NO. 99-23765 CA (10), ALL IN THE
ELEVENTH JUDICIAL CIRCUIT IN AND FOR MIAMI-DADE
COUNTY, FLORIDA; ALLOCATING FUNDS FROM THE
SELF-INSURANCE AND INSURANCE TRUST FUND,
ACCOUNT CODE NO. 515001.624401.6.661, FOR SAID
SERVICES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The continued engagement of the law firm of
Weiss Serota Helfman Pastoriza & Guedes, P.A., in an amount not
to exceed $100,000 plus costs as approved by the City Attorney,
for representation of the City of Miami in cases related to the
defense of the City of Miami Parking Surcharge Ordinance,
including but not limited to: Ampco System Parking, Inc., et al.

vs. City of Miami, Case No. 01-27582 CA (15), Park A. Partners,
Ltd., et al. vs. City of Miami, Case No. 01-20074 CA (06), and
Patrick McGrath, III et al. vs. City of Miami, Case
No. 99-23765 CA (10), all in the Eleventh Judicial Circuit in
and for Miami -Dade County, Florida, with funds allocated from
the Self -Insurance and Insurance Trust Fund, Account Code
No. 515001.624401.6.661, for said services.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.V

1� If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

The attached Resolution seeks authorization for the continued engagement of the law
firm of Weiss Serota Helfman Pastoriza & Guedes, P.A. for representation of the City of
Miami, in the amount of $100,000 plus costs as approved by the City Attorney, in cases
related to the defense of the City of Miami Parking Surcharge Ordinance, including but not
limited to: Ampco System Parking, Inc., et al. vs. City of Miami, Case No. 01-27582 CA
(15), Park A. Partners, Ltd., et al. vs. City of Miami, Case No. 01-20074 CA (06), and
Patrick McGrath, III et al. vs. City of Miami, Case No. 99-23765 CA (10), all in the Eleventh
Judicial Circuit in and for Miami -Dade County, Florida.
To date, funds allocated for this litigation totals $199,500. Upon my initial
engagement, $4,500 was allocated, Resolution No. 00-450 allocated $70,000, Resolution No.
01-228 allocated $100,000, Resolution No. 02-145 allocated $10,000, and Resolution No.
02-737 allocated $15,000. Approval of this Resolution will bring the total amount allocated
to $299,500.
Funds are available from the Self -Insurance and Insurance Trust Fund, Index Code
No. 515001.624401.6.661, for said services.
