A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO EXTEND THE
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH CATERING BY DAVID LYNN, INC.,
TO PROVIDE FOOD AND BEVERAGE CONCESSION
SERVICES FOR THE ORANGE BOWL STADIUM FOR A
ONE-YEAR PERIOD, WITH AN OPTION TO EXTEND
THE AGREEMENT ON A MONTH-TO-MONTH BASIS FOR
AN ADDITIONAL ONE-YEAR PERIOD, UNDER THE
SAME TERMS AND CONDITIONS SET FORTH IN THE
EXISTING AGREEMENT, UNTIL THE ORANGE BOWL
ADVISORY COMMITTEE DEVELOPS A NEW BUSINESS
PLAN FOR LONG-RANGE FOOD AND BEVERAGE
CONCESSION SERVICES AT THE STADIUM.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is authorized'/ to extend
the Agreement, in a form acceptable to the City Attorney, with
Catering by David Lynn, Inc., to provide food and beverage
concession services at the Orange Bowl Stadium, for a one-year

Period, with the option to extend the Agreement on a
month-to-month basis for an additional one-year period, under
the same terms and conditions set forth in the existing
agreement, until the Orange Bowl Advisory Committee develops a
new business plan for long-range food and beverage concession
services at the Stadium.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor 21

zi If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the
City Commission.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution
extending the Concession Agreement (Agreement) between the City of Miami and Catering By
David Lynn, Inc. for a period of one (1) year, with an option to extend on a month-to-month
basis for an additional year under the same terms and conditions contained in the existing
agreement.
BACKGROUND
The Orange Bowl Advisory Board recommends the extension of this agreement for a period of
one (1) year, with an option to extend on a month-to-month basis for an additional year until the
Business Plan for the Orange Bowl Stadium is completed. The Orange Bowl Advisory Board
initiated the development of a Business Plan in order to provide a long-range plan for the
stadium that would include a comprehensive renovation plan as well as recommendations to
expand and improve the concession operation at the stadium. It is anticipated that the business
plan will take approximately six (6) months to one (1) year to complete. Once it is completed an
RFP will be issued for the provision of food and beverage concession services for the stadium.
The City of Miami entered into an agreement with Catering By David Lynn, Inc. on January
18'`, 1998 to provide food & beverage services at the Orange Bowl Stadium for a period of five
(5) years with the option to extend the term for an additional five (5) year period. The RFP,
#96-97-015 was issued November 12, 1997, with a due date of December 10, 1997 and was
mailed to 64 firms. Catering By David Lynn, Inc was the only respondent. The Department of
Procurement contacted several firms to inquire why they did not propose, and were told by
some of the firms that the investment was too high for the low number of attendance at that
time.
The Department of Conferences, Conventions & Public Facilities does not recommend the
Agreement be extended for another five years. The Department recommends the Agreement be
extended only until the business plan is completed and an RFP can be issued to seek proposals
based on the recommendations made in the business plan. It is anticipated that more firms will
respond to the RFP due to the increased attendance at University of Miami Hurricane Football
games.
