AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), RELATED TO TAXATION, DEFINING AND DESIGNATING THE TERRITORIAL LIMITS OF THE DOWNTOWN DEVELOPMENT DISTRICT OF THE CITY OF MIAMI, FLORIDA; FIXING THE MILLAGE AND LEVYING TAXES IN SAID DOWNTOWN DEVELOPMENT DISTRICT FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2003 AND ENDING SEPTEMBER 30, 2004, AT FIVE -TENTHS (.5) MILLS ON THE DOLLAR OF NONEXEMPT ASSESSED VALUE OF ALL REAL AND PERSONAL PROPERTY IN SAID DISTRICT; PROVIDING THAT SAID MILLAGE AND THE LEVYING OF TAXES WITHIN THE TERRITORIAL LIMITS OF THE CITY OF MIAMI AS REFLECTED IN THE CITY'S MILLAGE LEVY ORDINANCE FOR THE AFORESAID FISCAL YEAR WHICH IS REQUIRED BY CITY CHARTER SECTION 27; PROVIDING THAT THE FIXING OF THE MILLAGE AND THE LEVYING OF TAXES HEREIN SHALL BE IN ADDITION TO SPECIAL ASSESSMENTS; PROVIDING THAT THIS ORDINANCE SHALL NOT BE DEEMED AS REPEALING OR AMENDING ANY OTHER ORDINANCE FIXING MILLAGE OR LEVYING TAXES, BUT SHALL BE DEEMED SUPPLEMENTAL AND IN ADDITION THERETO; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Tax Assessor of Miami -Dade County, Florida, a political subdivision of the State of Florida, has determined the nonexempt aggregate valuation of taxable property, real and personal, in the Downtown Development District of the City of Miami to be $ 5,400,000,000; 7 n, T'71 7 _ 7.77^ r7"� J 'c. LT i Y y� j yyh ^%3. Cy f 7 12421 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as fully set forth in this Section. Section 2. For the purpose of this Ordinance, the "DOWNTOWN DEVELOPMENT DISTRICT" is defined as that area within the territorial limits of the "City of Miami" as it now exists, with the boundaries thereof being designated in the City of Miami Ordinance No. 10575, adopted April 27, 1989 and more specifically described in "Exhibit A," attached and incorporated. Section 3. There shall be and is levied upon the nonexempt assessed value of all property, real and personal, in the Downtown Development District as described in Section 2 hereof, taxes at a rate shown below for the Fiscal Year beginning October 1, 2003 and ending September 30, 2004, for the following purpose: A tax of five -tenths (.5) mills on the dollar for the purpose of financing the operation of the Downtown Development Authority of the City of Miami. Section 4. This proposed millage rate herein adopted by the governing body exceeds the rolled back rate by 5.11tn percent. This rate is determined by calculating the percentage increase between the Fiscal Year 2003 rolled back revenue and the Page 2 of 4 12421 Fiscal Year 2003 estimated revenue for the Downtown Development Authority. Section 5. The fixing of the millage and levying of taxes in this Ordinance shall be in addition to the fixing of the millage and levying of taxes within the territorial limits of the City of Miami as reflected in the millage-levy Ordinance for the aforesaid fiscal year which is required by Section 27 of the City Charter. Section 6. The fixing of the millage and levying of taxes in the Downtown Development District, as provided by this Ordinance, shall be in addition to the special assessments for improvements imposed by the City Commission within the territorial limits of the City of Miami. Section 7. This Ordinance shall not repeal or amend any other ordinance fixing millage or levying taxes for the Fiscal Year beginning October 1, 2003 and ending September 30, 2004 but shall be deemed supplemental and in addition thereto. Section 8. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 9. If any section, part of this section, paragraph, clause, phrase or word of this Ordinance is declared Page 3 of 4 12421 invalid, the remaining provisions of this Ordinance shall not be affected. Fifth Street and N.W. Third Avenue (east side of N -S Expressway (I-95), thence run southerly along the centerline of N.W. Background Chapter 14 of the City of Miami Code authorize the City Commission to levy an additional ad valorem tax on all real and pdrsonal property within the Downtown Development Authority District, not to exceed five -tenths (.5) mills on the dollar valuation of such property for the purpose of financing the operations of the Downtown Development Authority. Section 2. Section 5. The Executive Director of the DDA is directed to prepare and file with the City Clerk of the City Miami, Florida detailed statement of the proposed expenditures and estimated revenues for the Fiscal Year 2003-2004 which shall be entitled "Annual Budget of the Downtown Development Authority: Fiscal Year October 1, 2003 through September 30, 2004". Section 5. A copy of this Resolution and the attachment shall be filled with the City Clerk of the City of Miami, Florida after adoption of the millage by the City of Miami Commission.
