HomeMy WebLinkAboutO-12418J-03-600 6/27/03 ORDINANCE NO. .1-2418 AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS, AMENDING PAGES NO. 46 AND 47 OF THE ZONING ATLAS OF ZONING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION FROM (R-2) DUPLEX RESIDENTIAL, (0) OFFICE AND SD -2 TO (R-2) DUPLEX RESIDENTIAL, (0) OFFICE AND SD -2 WITH AN NCD -2 OVERLAY FOR A PROPOSED "GRAND AVENUE CORRIDOR NEIGHBORHOOD CONSERVATION OVERLAY DISTRICT" LOCATED IN COCONUT GROVE, MORE PARTICULARLY DESCRIBED AS THE PROPERTIES LOCATED ALONG THE GRAND AVENUE CORRIDOR APPROXIMATELY BOUNDED BY COMMODORE PLAZA AND MCDONALD STREETS TO THE EAST, BROOKER AND JEFFERSON STREETS TO THE WEST AND FRONTING ON GRAND AVENUE, IN COCONUT GROVE, MIAMI, FLORIDA (SEE "EXHIBIT A"); FURTHER RETAINING THE EXISTING "PRIMARY PEDESTRIAN PATHWAY" DESIGNATIONS FOR THOSE PROPERTIES FRONTING ON GRAND AVENUE AND ADDING "PRIMARY PEDESTRIAN PATHWAY" DESIGNATIONS ALONG THE REMAINDER OF THE GRAND AVENUE CORRIDOR, EXCEPT FOR SUCH PROPERTIES ZONED R-2; MAKING FINDINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of June 18, 2003, Item No. 7, following an 12418 Grand Avenue, in Coconut Grove, Miami, Florida (See "Attachment A"). Section 3. It is found that this Zoning designation change: (a) is necessary to allow a "Grand Avenue Corridor Neighborhood Conservation Overlay District"; (b) is consistent with the proposed intent and use of the said property; (c) is consistent with Zoning Ordinance No. 11000; (d) is positive and will not impose an adverse effect on the area. Section 4. Page No. 46 and 47 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, is amended to reflect the changes made necessary by this Amendment. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance shall become effective thirty-one (31) days after second reading and adoption Page 3 of 4 12418 advertised hearing, adopted Resolution No. PAB 41-03 by a vote of six to zero (6-0), RECOMMENDING APPROVAL WITH CONDITIONS of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Page 46 and 47, Article 4, Section 401, Schedule of District Regulations, is amended by changing the zoning classification from (0) "Office" and "SD -2" to (0) "Office" and "SD -2" with an "SD -26" Overlay to allow a "Coconut Grove Farmers Market Special District" located in the Coconut Grove area more particularly described as the properties located along the Grand Avenue corridor approximately bounded by Commodore Plaza and McDonald Street to the east, Brooker and Jefferson Streets to the west, and fronting on Page 2 of 4 12418 pursuant and subject to § 163.3187(3)(c), Fla. The following findings have been made: • It is found that the subject properties current zoning designations consist of R-2, SD -2 and O Zoning; said properties are located along the Grand Avenue Corridor in Coconut Grove. • It is found that the existing classifications fail to unify the Grand Avenue properties in a manner that enhance the cultural heritage of the area. • It is found that the proposed NCD -2 "Grand Avenue Corridor Neighborhood Conservation Overlay District" is needed in order to allow the limitations on uses, architecture and height required to protect and enhance the character of the neighborhood. • It is found that the proposed change is consistent with the intent of the area and will not have an adverse impact on the adjacent community.
