ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENTS, AMENDING PAGES NO. 15, 21
AND 23 OF THE ZONING ATLAS OF ORDINANCE NO.
11000, AS AMENDED, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, ARTICLE 4,
SECTION 401, SCHEDULE DISTRICT REGULATIONS,
BY CHANGING THE ZONING CLASSIFICATION FOR
THE PROPERTIES LOCATED FOR A DISTANCE OF
APPROXIMATELY 200 FEET ON EITHER SIDE OF
BISCAYNE BOULEVARD FROM NORTHEAST 17TH
TERRACE TO NORTHEAST 36TH STREET, MIAMI,
FLORIDA, FROM (C-1) "RESTRICTED COMMERCIAL"
WITH AN (SD -20) "EDGEWATER OVERLAY
DISTRICT" TO (C-1) "RESTRICTED COMMERCIAL"
WITH AN (SD -20.1) "BISCAYNE BOULEVARD
EDGEWATER OVERLAY DISTRICT" WITH A "PRIMARY
PEDESTRIAN PATHWAY" DESIGNATION FOR THOSE
PROPERTIES FRONTING ON BISCAYNE BOULEVARD;
MAKING FINDINGS; DIRECTING TRANSMITTALS TO
AFFECTED AGENCIES; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its
meeting of May 21, 2003, Item No. 10, following an
advertised hearing, adopted Resolution No. PAB 31-03 by a
vote of eight to zero (8-0), RECOMMENDING APPROVAL of a
change of zoning classification as hereinafter set forth;
and

WHEREAS, the City Commission after careful
consideration of this matter deems it advisable and in the
best interest of the general welfare of the City of Miami
and its inhabitants to grant this change of zoning
classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in
the Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The Zoning Atlas of Ordinance
No. 11000, as amended, the Zoning Ordinance of the City of
Miami, Florida, Pages No. 15, 21 and 23, Article 4, Section
401, Schedule of District Regulations, is amended by
changing the zoning classification for the properties
located for a distance of approximately 200 feet on either
side of Biscayne Boulevard from Northeast 17th Terrace to
Northeast 36th Street, Miami, Florida, (more particularly
described in "Exhibit A" attached and made a part hereof)
from (C-1) "Restricted Commercial" with an (SD -20)
"Edgewater Overlay District" to (C-1) "Restricted
Commercial" with an (SD -20.1) "Biscayne Boulevard Edgewater
Overlay District" with a "Primary Pedestrian Pathway"

Designation for those properties fronting on Biscayne
Boulevard (as depicted in exhibits "B and C").
Section 3. It is found that this Zoning
designation change:
(a) is necessary in order to facilitate the
appropriate development of Biscayne Boulevard;
(b) is consistent with the proposed intent and use of
the said property;
(c) is consistent with Zoning Ordinance No. 11000;
(d) is positive and will not impose an adverse effect
on the area.
Section 4. Pages No. 15, 21 and 23 of the Zoning
Atlas, made a part of Ordinance No. 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, by
reference and description in said Ordinance, is amended to
reflect the changes made necessary by this Amendment.
Section 5. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 6. If any section, part of section,
paragraph, clause, phrase, or word of this Ordinance is
declared invalid, the remaining provisions of this
Ordinance shall not be affected.

Section 7. This Ordinance shall become effective
thirty-one (31) days after second reading and adoption
pursuant and subject to § 163.3187(3)(c), Fla. Stat.
(2002) "
PASSED ON FIRST READING BY TITLE ONLY this 17th day
of July, , 2003.
1� This Ordinance shall become effective as specified unless vetoed by the
Mayor within ten days from the date it was passed and adopted. If the
Mayor vetoes this Ordinance, it shall become effective immediately upon
override of the veto by the City Commission or upon the effective date
stated, whichever is later.

Pursuant to Article 4, Section 401 and Article 22 of Ordinance 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, the proposal has been reviewed for an
amendment to the Zoning Atlas as follows:
Consideration of amending pages No. 15, 21 and 23 of the Zoning Atlas of Zon-
ing Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami,
Florida, Article 4, Section 401, Schedule District Regulations, by changing the
zoning classification for the properties located for a distance of about 200 feet on
either side of Biscayne Boulevard from approximately NE 170' Terrace to NE
36'h Street, Miami, Florida, (Complete legal description and map on file with the
Hearing Boards Office), from (C-1) "Restricted Commercial" with an (SD -20)
"Edgewater Overlay District" to (C-1) "Restricted Commercial" with an (SD -
20.1) "Biscayne Boulevard Edgewater Overlay District" with a "Primary Pedes-
trian Pathway" Designation for those properties fronting on Biscayne Boulevard.
The following findings have been made:
• It is found that the subject properties current zoning designation consists of C-1
Restricted Commercial Zoning with an SD -20 "Edgewater Overlay District".
• It is found that the subject properties are generally located along the Biscayne
Boulevard frontage of the zone from NE 17th Terrace to 36`h Street, and that as such,
should be protected from certain incompatible uses along Biscayne Boulevard.
• It is found that the SD -20.1 "Biscayne Boulevard Edgewater Overlay District" is
needed in order to allow the limitations on uses required to protect the character of
Biscayne Boulevard.
• It is found that the proposed change is consistent with the intent of the area and will
not have an adverse impact on the adjacent community.
Based on these findings the Planning and Zoning Department is recommending
approval of the application as presented.
