ORDINANCE NO. 12408
AN ORDINANCE OF THE MIAMI CITY COMMISSION
SUNSETTING CITY OF MIAMI DISTRICTS TWO,
THREE, AND FIVE HISTORIC PRESERVATION
ADVISORY BOARDS BY AMENDING SECTION 2-892 AND
REPEALING, IN THEIR ENTIRETY, ALL DIVISIONS
AND SECTIONS OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, AND ORDINANCE
NOS. 12077, 12086, AND 12234.1 RELATED TO
SAID ADVISORY BOARDS; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE, AND
PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. City of Miami Districts Two, Three, and Five
Historic Preservation Advisory Boards are sunsetted and Ordinance
Nos. 12077, 12086, and 12234.1, and all Divisions and Sections of
the Code related to said Advisory Boards are repealed, in their
entirety.
Section 2. Chapter 2/Article XI of the Code of the City
of Miami, Florida, as amended, entitled," is further amended in
the following particulars:l/

words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

DIVISION 2. STANDARDS FOR CREATION AND
REVIEW OF BOARDS GENERALLY
Sec. 2-892. "Sunset" review of Boards.
Commencing with the year 1995, each city Board
shall be reviewed in the following manner:
(4) The following Boards shall initially be reviewed
in the following years and shall be reviewed every
four years thereafter:

Section 3. All ordinances or parts of ordinances that
are inconsistent or in conflict with the provisions of this
Ordinance are repealed.

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.al

This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.

The attached proposed Ordinance has been drafted pursuant to Motion 03-804, adopted
July 17, 2003, whereby the City Commission directed that legislation be drafted to sunset City of
Miami Districts Two, Three, and Five Historic Preservation Advisory Boards.
