AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 12280, AS
AMENDED, THE CAPITAL PROJECTS APPROPRIATIONS
ORDINANCE, TO REVISE CERTAIN ONGOING CAPITAL
IMPROVEMENT PROJECTS BY APPROPRIATING
ADDITIONAL FUNDING FROM THE FEDERAL EMERGENCY
MANAGEMENT AGENCY ("FEMA"), THE PUBLIC
FACILITIES SPECIAL REVENUE FUND AND
ASSESSMENT LIEN REVENUE; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE,
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission adopted Ordinance No. 12280,
the Capital Improvements Appropriations Ordinance, on
September 26, 2002; and
WHEREAS, Resolution No. 00-1142, adopted on December 14,
2000, authorized the City of Miami to submit claims to and accept
funds from the Federal Emergency Management Agency ("FEMA")
pursuant to the October 2000 Floods; and
WHEREAS, FEMA has approved additional project worksheets for
dredging improvements within the City totaling $3,680,603.83
which includes a 12.5% local match requirement; and
WHEREAS, FEMA also approved an additional $3,000,000 in
Hazard Mitigation Grant Program funds for the Flagami Drainage
Project, an approved project under the Local Mitigation Strategy;
and

WHEREAS, pursuant to the Mid -Year Budget Ordinance approved
June 25, 2003, surplus rollover funds in the amount of $494,125
from the Public Facilities Special Revenue Fund have been
identified for three capital projects; and
WHEREAS, an amount of $111,000 has been identified from
available Assessment Lien Revenue in the Capital Fund to cover a
funding shortage in the Virginia Key Park Improvements Project;
and
WHEREAS, it is necessary to appropriate said funds into
respective capital projects;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 12280, as amended, adopted
September 26, 2002, the Capital Improvements Appropriations
Ordinance, is further amended in the following particulars:'/

Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City
of Miami, including new capital improvement projects scheduled to
begin during Fiscal Year 2003. The herein appropriations which are
hereby designated by reference to descriptive project title and
number also include appropriations for previously approved
scheduled projects as well as reappropriations of prior funds. The
sources of revenues to support the herein appropriations are
hereby identified by fund and project in ten Capital Funds, as
follows:

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon further grounds of the necessity to make the required and
necessary payments to its employees and officers, payment of its
debts, necessary and required purchases of goods and supplies and
to generally carry on the functions and duties of municipal
affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.V
2/ If the Mayor does not sign this Ordinance, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the
City Commission.

It is respectfully requested that the City Commission approve the attached amendment to the Capital
Projects Appropriations Ordinance No. 12280, as amended, adopted on September 26, 2002.
BACKGROUND
On December 14, 2000, the City Commission adopted Resolution No. 00-1142 thereby authorizing
the City of Miami to submit claims: to and accept funds from the Federal Emergency Management
Agency (FEMA) for recovery and `mitigation activities resulting from the October 2000 Flood
Disaster. Thirty FEMA project sites within the boundaries of the City of Miami were originally
included as part of Miami -Dade County's claim. Upon notification from the County, the City
informed FEMA that it would be the applicant responsible for implementing the projects which
consist of drainage improvements within City limits .
Disaster recovery projects require a 12.5% share each from the State and City, with the majority of
funding, 75%, contributed by FEMA. Based on the total project worksheet estimate of
$3,680,603.83, an amount of $460,075 has been identified from available stormwater utility trust
Rinds as the City's local match.
Furthermore, FEMA approved a supplemental $3 million in addition to the $6.23 million previously
approved under the (404) Hazard Mitigation Grant Program. These funds will provide additional
funding for the Flagami Drainage Project, an approved project under the Local Mitigation Strategy.
The drainage improvements need to be expedited since the FEMA funds are time -sensitive.
Therefore, this ordinance is being presented as an emergency to appropriate the funds needed to
proceed with the projects.
Assessment lien revenue of $111,000 is being appropriated into the Virginia Key Park Improvements,
CIP No. 331416, to cover a funding shortage in this construction project. A resolution to award the
construction contract is also scheduled on the July 24, 2003 agenda. Funds in the amount of
$494,125 from the Public Facilities special revenue fund are also being appropriated into two capital
projects pursuant to the Mid -Year Budget Ordinance approved on June 25, 2003.

Affairs (DCA), and local matching funds. The County has begun the neat phase of our reamsfim
plan, which includes project site analysis, design and construction. We have notified sa staff m

the City of Miami.
Local matching funds (12.50/9) are to be paid by each individual municipality where road, cmd,
or drainage improvements are to be performed. Please advise if your municipality wisl>es Mise*

canals, local costs will be predicated on Miami Dade County Department of Environmental
Resources Managemem Stormwater Master Plan basis studies. Attached is a list of sites within
Your city limits depicting the location of the proposed improvements and the estimated available
funding for each project from FEMA and DCA, including the 12.5% matching share of funds for
each municipality. Please be advised that each project has a specific scope of work to address the
storm -related damage. Deviation from the specified scope will result in loss of finuding.

This is in reference to your letter dated May 17, 2002 regarding the Federal Emergency
Management Agency's (FEMA) road restorations and drainage infrastructure projects.
Alter careful reviewby our PubTic Works Department, they have come to the conclusion
that the improvements on the aforementioned streets should be coordinated by the City of
Miami. Therefore, it is requested that Miami -Dade County withdraw as the applicant of
record with FEMA and de -obligate these projects from the County scope of work. The
City will then execute the agreement with the Department of Community Affairs
(DEMS) and the State of Florida to accomplish the necessary work for the affected roads
within the City's jurisdiction.
The City of Miami's Disaster Management and Public Affairs (DMPA) division is
already negotiating with the Department of Emergency Management/State of Florida
regarding this matter.

This memorandum serves to inform you of a supplemental $3 million dollars in
addition to the $6.23 million dollars previously approved from FEMA for the
Flagami Drainage Project.
To justify the disbursement of the funds, the STATE OF FLORIDA, Department of
Community Affairs is requesting that the City of Miami submit a completed
proposal within 45 days from receipt of this letter.
The proposal should: outline the use of the additional funds, provide a brief
scope of work and show consistency with the phased in, global solutions for the
Flagami Project.
The proposal should also show consistency with the concurrent solutions
spearheaded by SFWMD, West Miami, and Sweetwater.
Please feel free to consult with Mr. Bashir Wayne regarding the detailed
requirements of the proposal.

Dear Mr. Fugate:
We have completed our revie*of the remaining HMGP fimds in DR -1345 and have discussed
with your staff how these funds will be used. This review was necessary due to the large
amount of fiends available in this disaster and the lower-than-expected costs for some of the
projects. The State has already committed to fiend the remaining phases of previously approved
phased projects, the 7% Planning project, modifications to the Impoundment Area project, and
any additional Management Costs that may be required_for this disaster. In addition to these
commitments, the following projects will use the remainder of the 1345 HMGP fiords:
• Miami -Dade Local Mitigation Strategy (LMS) Prioritized Projects ($572,794)
• South Florida Water Management District C4 Canal Conveyance Project ($5.3 million)
• Completing additional components of the local drainage improvement projects in
Sweetwater, West Miami, and Miami ($3 million each for a total of $9 million)
To complete a timely review of these projects, we will need the following information in the next
60 days:
• For the LMS Prioritized Projects, we are expecting the revised Benefit -Cost Analyses and
additional information previously discussed with your staff.
• For the Canal Conveyance Improvement Project, we will need engineering drawings,
maps outlining the locations of the improvements, a detailed budget, environmental
review information including permits, and how the spoils will be disposed.
• For the funding of additional components of the Sweetwater, West Miami and Miami
local drainage projects, we will need a detailed scope of work, budget, timeline, and a
preliminary set of engineering drawings.
The Canal Conveyance Improvement Project and the additional components of the local drainage
• projects will not require further Benefit -Cost review because they are part of the overall C-4
Drainage Basin Project which has sufficient benefits to cover these costs. However,
environmental review will be nary and this process needs to begin immediately.

A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY. MANAGER TO 'EXECUTE 'A
DISASTER RELIEF FUNDING AGREEMENT IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
STATE OF FLORIDA, DEPARTMENT OF COMMUNITY
AFFAIRS, FOR THE PURPOSE OF -ACCEPTING FEDERAL
EMERGENCY MANAGEMENT AGENCY ("FEMA") GRANT
FUNDS, FOR REIMBURSEMENT OF EMERGENCY RELIEF
EXPENSES INCURRED BY THE CITY OF MIAMI DURING
AND IN THE AFTERMATH -OF THE OCTOBER SOUTH
FLORIDA FLOODS; FURTHER AUTHORIZING THE CITY

WHEREAS, the October South Florida floods ,,produced
disastrous conditions which had a devastating impact upon South
Florida; and
WHEREAS, said conditions resulted in the declaration of a
State of Emergency by the Florida Governor; and
WHEREAS, the President of the United States concurred and
declared an emergency (FEMA -I3 -DR -FL) for the counties of

WHEREAS, the Federal Emergency Management Agency ("FEMA")
has made federal funds available for disaster relief activities
in said Counties pursuant to FEMA -I3 -DR -FL; and

WHEREAS, the City Manager recommends adoption of this
Resolution which will enable the City of Miami to accept grant
funds from FEMA, through the State of Florida, as reimbursement
for eligible costs incurred by the City of - Miami for disaster
relief activities;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA: -
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fkly set forth in this Section.
Section 2. The City Manager is hereby authorized) to
execute a Disaster Relief Funding Agreement ("Agreement"), in a
form acceptable to the City Attorney, with the State of Florida,
Department of Community Affairs, for the purpose of accepting
Federal Emergency Management Agency ("FEMA") grant funds for
reimbursement of emergency relief expenses incurred by the City
of M3.ami during and in the aftermath of the October South Florida
floods.
Section 3. The City Manager is further authorized to
submit related claims to FEMA and to accept payments for same.

The herein authorization is further subject to compliance with all
requirements that may be imposed by the City'Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.J

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
