AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12280, AS AMENDED, THE CAPITAL PROJECTS APPROPRIATIONS ORDINANCE, TO APPROPRIATE $15,750,000 FROM AVAILABLE HOMELAND DEFENSE/NEIGHBORHOOD IMPROVEMENT BOND PROCEEDS FOR VARIOUS CAPITAL IMPROVEMENT PURPOSES; REVISING PREVIOUSLY APPROVED PROJECTS AND ESTABLISHING NEW PROJECTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 12280, as amended, the Capital Improvements Appropriations Ordinance, on September 26, 2002; and WHEREAS, it is necessary to appropriate available Homeland Defense/Neighborhood Improvement Bond proceeds in the amount of $15,750,000 to projects previously approved to be funded with said funds pursuant to Resolution No. 02-1294 adopted on December 12, 2002; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. 12389 Section 2. Ordinance No. 12280, as amended, adopted September 26, 2002, the Capital Improvements Appropriations Ordinance, is amended in the following particulars:11 "Ordinance No. 12280 Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2003. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriat ions of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: III. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, Page 4 of 5 12389 payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. BACKGROUND It is proposed that the $28 million in unappropriated first series funds be distributed in a manner consistent with the funding ratio beh-Ven City and District projects established for the $255 million Homeland Defense/Neighborhood Improvement Bond Program. Resolution 02-1294 adopted on December 12, 2002 established the list of projects authorized and approved under the Bond Program. The resolution is attached for your convenience. Using the existing funding ratio as a guideline, the $28 million would be appropriated as follows: $17 million for approved City projects $11 million for approved District projects Discussions with Commissioners and the City Manager resulted in the following recommended appropriations for City projects: Fern Isle Park Renovations ...................................... $1,000,000 Police Training Facility ..:........................................... 5,500,000 Neighborhood Fire Stations & Training Facility ....... 1,000,000 Bicentennial Park Improvements ............................... 2,000,000 Coral Way Improvements .......................................... 1,500,000 Model City Infrastructure Improvements ................... 1,000,000 Historic Preservation Initiatives ................................. 1,000,000 Calle Ocho Improvements ............................................. 750,000 Design District/FEC Corridor Improvements ............... 500,000 NE 2°d Avenue Improvements ................................... 1,000,000 Greenways Improvements ............................................. 500,000 Total: ............... $15,750,000 In addition to $580,000 previously appropriated for the Fern Isle cleanup, there would be a remaining unappropriated balance of $670,000 to complete the $17 million of City projects. It is recommended that the $670,000 be held as reserve for future appropriation. It was also agreed that the $11 million to be appropriated for approved District projects would be equally distributed resulting in a $2.2 million share for each district. Due to a previous $2 million appropriation in District 3 for Memorial Boulevard, that district's remaining balance stands at $200,000. Appropriations to the District projects will be made at a later time as priorities are established in each district. 1238(P The attached Ordinance seeks to appropriate $15,750,000 of available Homeland Defense Bonds to the City projects listed above.
