ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 12280, THE CAPITAL
PROJECTS APPROPRIATIONS ORDINANCE, TO
INCREASE APPROPRIATIONS FOR CAPITAL
IMPROVEMENT PROJECT NO. 313855, ENTITLED
"OCTOBER 2000 FLOOD RECOVERY," IN THE AMOUNT
OF $8,500,000, CONSISTING OF FUNDS IN THE
AMOUNT OF $3,150,000, OF LOCAL OPTION GAS TAX
REPROGRAMMED FROM CAPITAL IMPROVEMENT PROJECT
NO. 341183, $4,000,000 OF STORM SEWER BONDS,
$1,000,000 OF STORMWATER UTILITY TRUST FUNDS
AND $350,000 OF STORMWATER UTILITY TRUST FUND
INTEREST; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE.
WHEREAS, on September 26, 2002, the City Commission adopted
Ordinance No. 12280, the Capital Improvements Appropriations
Ordinance, making appropriations for new Capital Improvement
Projects scheduled to begin in Fiscal Year 2002-2003 and
continuing previously approved projects; and
WHEREAS, the Federal Emergency Management Agency ("FEMA")
approved project worksheets for various road improvements and
canal dredging necessitated by the October 2000 Flood Disaster;
and
WHEREAS, cost estimates for the work to be performed far
exceed the amounts anticipated in FEMA's project worksheets; and

WHEREAS, the project manager has determined that the
projects will not be completed by the FEMA deadline and has
requested an extension; and
WHEREAS, FEMA has approved a time extension for these
projects until July 4, 2003; and
WHEREAS, funds, in the amount of $8,500,000, have been
identified for the shortfall, consisting of $3,150,000 of local
option gas tax to be reprogrammed from Capital Improvement
Project ("CIP") No. 341183 entitled "Citywide Street Improvements
Fiscal Year 2001-2005," $4,000,000 of unallocated Storm Sewer
Bonds available in Revenue Project No. 399001, $1,000,000 of
unallocated Stormwater Utility Trust Funds available in Revenue
Project No. 360001 and $350,000 of unallocated Stormwater Utility
Trust Funds Interest available in Revenue Project No. 360002; and
WHEREAS, it is necessary to amend Ordinance No. 12280 to
appropriate funds to CIP No. 313855, entitled "October 2000 Flood
Recovery;"
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.

Section 2. Ordinance No. 12280, adopted September 26,
2002, the Capital Improvements Appropriations Ordinance, is
amended in the following particulars:l/
"Ordinance No. 12280
Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City
of Miami, including new capital improvement projects scheduled to
begin during Fiscal Year 2003. The herein appropriations which are
hereby designated by reference to descriptive project title and
number also include appropriations for previously approved
scheduled projects as well as reappropriations of prior funds. The
sources of revenues to support the herein appropriations are
hereby identified by fund and project in ten Capital Funds, as
follows:

remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.�l

vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become

RECOMMENDATION
It is respectfully requested that the City Commission approve the attached amendment to the
Capital Projects Appropriations Ordinance No. 12280, as amended, adopted on September
26, 2002.
BACKGROUND
The Federal Emergency Management Agency (FEMA) approved various project worksheets
for damage caused by the October 2000 Flood Disaster. Disaster recovery projects require a
12.5% share each from the State and City, with the majority of funding, 75%, contributed by
FEMA. The City is preparing to bid out eight of these FEMA -funded projects consisting of
five road improvements and three canal dredgings. The list of locations is attached for your
review.
However, cost estimates prepared by the Department of Capital Improvements for the work
to be performed exceed the preliminary amounts in FEMA's schedules. The City will put the
projects out for bid and then submit the lowest bids to FEMA for approval. In the event that
FEMA will only fund costs based on the original project worksheets, sufficient City funding
would need to be in place to award construction contracts.
An amount of $8,500,000 has been identified from various capital projects revenue sources
in anticipation that the additional funds are needed. The funding consists of $3,150,000 of
local option gas tax to be reprogrammed from CIP 341183 entitled "Citywide Street
Improvements FY2001-2005", $4,000,000 of unallocated storm sewer bonds, $1,350,000 of
unallocated stormwater utility trust funds and interest.

AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NEC-
ESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, TO ACCEPT THE GRANT; CONTAINING A

OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "LANDFILLS.
AND WATERFRONT IMPROWMENTB/WATERFRONT ADVI-
SORY BOARD" TO INCREASETHE. MEMBERSHIP OF THE
WATERFRONT ADVISORY BOARD FROM TEN TO TWELVE
MEMBERS, ELIMINATE THE ALTERNATE MEMBER POSI-
TION, AND PROVIDE FOR THE APPOINTMENT OF TWO IN-
DIVIDUALSBY THE MAYOR AND PROVIDE FOR INSTANCES
OF A TIE VOTE; m6RE PARTICULARLY BY AMENDING SEC-
TION 29-123 OF SAID CdDE; CONTAINING A REPEALER
PROVISION, A SEVERABILITY CLAUSE AMD PROVIDING
FOR AN EFFECTIVE DATE.
Said proposed ordinances may be inspected by the public at the
Office of1he City Clerk, 3500 Pan American Drive, Miami, Flori-
da, Monday through Friday,, excluding holidays, between the
hours.of 8 a.m. and 5 p.m.
All interested persons may appear a 10,neeting and may be heard
with respect to the proposed ordinances. Should any person desire to ap-
peal any decision of the City Commission with respect to any matter to be
considered at this meeting, that person shall ensure that a verbatim
record of the proceedings is made including all testimony and evidence
upon which any appeal may be based.
