HomeMy WebLinkAboutO-12377J-03-463 5/21/03 ORDINANCE NO. 12 t 7 7 AN ORDINANCE OF THE MIAMI CITY COMMISSION CREATING A NEW SPECIAL REVENUE FUND ENTITLED: "PROGRAMS FOR THE DEVELOPMENTALLY DISABLED, 2003 -2004"; APPROPRIATING FUNDS FOR ITS - OPERATION IN THE ESTIMATED TOTAL AMOUNT OF $344,114, CONSISTING OF A GRANT, IN AN ESTIMATED AMOUNT OF $9,370 FROM THE STATE OF FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES AND A SECOND GRANT, IN THE ESTIMATED AMOUNT OF $334,744, FROM THE STATE OF FLORIDA AGENCY FOR HEALTH CARE ADMINISTRATION, MEDICAID PROGRAM DEVELOPMENT, BOTH GRANTS TO FUND PROGRAMS FOR THE DEVELOPMENTALLY DISABLED WHICH ARE ADMINISTERED BY THE PARKS AND RECREATION DEPARTMENT THROUGH ITS PROGRAMS FOR PERSONS WITH DISABILITIES DURING THE PERIOD OF JULY 1, 2003 THROUGH JUNE 30, 2004; FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANTS AND EXECUTE THE NECESSARY DOCUMENTS(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT ACCEPTANCE OF BOTH GRANTS. WHEREAS, the Parks and Recreation Department through its Programs for Persons with Disabilities, has for the past twenty- five (25) years applied to the State of Florida Department of Children and Families ("DCF") for funds to support its programs for the coming year; and WHEREAS, it is anticipated that DCF will award the City a grant, in the estimated amount of $9,370, for services for 12377 developmentally disabled individuals during the period of July 1, 2003 through June 30, 2004; and WHEREAS, it is anticipated that the State of Florida Agency for Healthcare Administration will also provide a grant, in the amount of $334,744; and WHEREAS, the aggregate of these funds, in the total estimated amount of $344,114 will enable the City's Program to continue through June 30, 2004; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established as described herein: FUND TITLE: PROGRAMS FOR THE DEVELOPMENTALLY DISABLED, 2003 - 2004 RESOURCES: UNITED STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES CONTRACT THROUGH THE FLORIDA DEPARTMENT OF CHILDREN AND FAMILIES. $ 9,370 STATE OF FLORIDA AGENCY FOR HEALTHCARE ADMINISTRATION MEDICAID PROGRAM DEVELOPMENT $334,744 APPROPRIATION: $344,114 Page 2 of 4 12377 Section 3. The City Manager is authorized:' to accept a grant in an estimated amount of $9,370, from the State of Florida Department of Children and Families and a second grant, in the estimated amount of $334,744 from the State of Florida Agency for Healthcare Administration, Medicaid Program Development to fund programs for the developmentally disabled administered by the Parks and Recreation Department through its Programs for Persons with Disabilities during the period of July 1, 2003 through June 30, 2004, and to execute the necessary document(s), in a form acceptable to the City Attorney, to implement acceptance of both grants. Section 4. All Ordinances or parts of Ordinance insofar as they are inconsistent or in conflict with the provision of this Ordinance are repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective (30) days after final reading and adoption thereof.21 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND: For the past twenty-five (25) years, the Department of Parks and Recreation - Programs for Persons with Disabilities has received funds from the State of Florida Department of Children and Families. Since 1993, the State of Florida Agency for Healthcare Administration Medicaid Program Development has provided funds for this Program. These funds are used to provide programs and transportation services to more than eighty-eight (88) developmentally disabled adults on a weekly basis. Due to the high quality of service provided by the City of Miami, the State of Florida has again awarded grant funds. The contract period for the grants is from July 1, 2003 through June 30, 2004. 12377 Honorable Mayor and Members of the City Commission Page 2 of 2 To serve as many as eighty-eight (88) clients, funds from both State -funding sources are combined to cover two (2) interrelated programs offered by the Parks Department's Program for Persons with Disabilities. The Adult Day Training program provides for twenty-six (26) clients, thirty (30) hours per week, a non -work oriented program, giving instruction in such skills as telling time, transacting money, and learning independent living skills. The second program provides for non-residential support services to a minimum of sixty two (62) clients, on the average of eight (8) hours per month. Specific activities in this program include dances, bowling, movies and special events. Additionally, clients are educated on socialization skills, interpersonal relationships, and peer interaction. The Programs for Persons with Disabilities Division also provides the clients with transportation to the various programs and activity sites. The establishment of a special revenue fund is required in order to appropriate these funds for the operation of the Parks Department's Programs for Persons with Disabilities. It is therefore recommended that the City Commission adopt the attached Ordinance creating a special revenue fund and appropriating funds for said purpose.
