ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A NEW SPECIAL REVENUE FUND
ENTITLED "THE NEIGHBORHOOD INITIATIVE GRANT
FOR MODEL CITY COMMUNITY REVITALIZATION
DISTRICT TRUST" FOR CERTAIN SPECIAL PROJECTS
AND APPROPRIATING FUNDS, IN THE AMOUNT OF
$1.26 MILLION, FROM THE UNITED STATES
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
IN SUPPORT OF THE MODEL CITY HOMEOWNERSHIP
PILOT PROJECT; AUTHORIZING THE CITY MANAGER
TO ACCEPT THE GRANT AND TO EXECUTE ANY
DOCUMENTS NECESSARY, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR ACCEPTANCE OF THE
GRANT; AND CONTAINING A REPEALER PROVISION,
A SEVERABILITY CLAUSE AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the United States Department of Housing and Urban
Development has advised the Model City Community Revitalization
District Trust ("Trust") that it has been awarded a special
grant in support of the Model City Homeownership Project from
the Fiscal Year 2003 Appropriations Act, the Neighborhood
Initiative Grant for certain earmarked projects, in the amount
of $1.26 million; and

WHEREAS, Section 12.5-29 of the Code of the City of Miami,
Florida, as amended, provides authority for the Trust to
"solicit and accept grants, contributions and financial and
non-financial support from individuals, private business
interests, the general public, governmental entities,
corporations and organizations, foundations and other
philanthropic entities;" and
WHEREAS, the Board of Directors of the Trust accepted the
funds; and
WHEREAS, the Board of Directors has requested that the City
Commission appropriate said funds for the purpose of land
acquisition in the Model City Homeownership Zone Pilot Project
area;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in the Section.
Section 2. A new Special Revenue Fund entitled
"Neighborhood Initiative Grant for the Model City Community

Revitalization District Trust," for certain special projects is
established, and resources are appropriated as described herein:
FUND TITLE: Neighborhood Initiative Grant
for the Model City
Community Revitalization
District Trust
RESOURCES: U.S. Department of Housing
and Urban Development $1.26 Million
APPROPRIATIONS: $1.26 Million
Section 3. The appropriations are contingent upon
funding by the United States Department of Housing and Urban
Development and the Model City Trust's acceptance thereof.
Section 4. The City Manager is authorized!' to execute
any documents necessary, in a form acceptable to the City
Attorney, for acceptance of the grant.
Section 5. All ordinances or parts of ordinance insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be
affected.
1� The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 7. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21

RECOMMENDATION:
It is respectfully requested that the City Commission approve the attached
ordinance to recognize the funds appropriated by Congress to the Model City
Community Revitalization District Trust for the Model City Homeownership
Zone.
BACKGROUND:
Congresswoman Carrie P. Meek was successful in securing $1.26 Million for the
Model City Community Revitalization District Trust in the FY 2003 HUD Budget
for the Model City Homeownership Zone. The Trust Board has accepted the
funds as its establishing ordinances allows; however, this legislation is submitted
for the Commission's - approval to adjust the Trust's FY 2002-2003 budget to
include the appropriated amounts.
As you will recall, several questions have developed regarding the use of HOME
Investment Partnership Program ("HOME") funds for land acquisition relative to
the timeline for the commencement of construction. In the interest of avoiding
this sort of challenge in the future, the Trust has prioritized the use of other
funds for immediate acquisitions and earmarked the HOME funds for uses at
later stages in the project, particularly infrastructure and relocation costs that will
occur closer to the time projected for acquisition.
Please refer to the attached copy of the relevant page from a FY 2003 Conference
Report (Report 108-10) as supporting documentation to reflect the Congressional
appropriation of funds to the Model City Community Revitalization District
Trust. The appropriation ordinance creates a special revenue fund to receive the
funds and authorizes the use of the funds for land acquisition costs in the Model
City Homeownership Zone.

stead of $23,400,000 as proposed by the House and $40,000,000 as
proposed by the Senate. Modified language is included, similar to
language proposed by the House and Senate, targeting funds made
available under this program. Targeted grants shall be provided as
follows:
1. $900,000 for Anchorage, Alaska for an expansion of the An-
chorage Museum;
2. $250,000 for the City of Boaz, Alabama for facilities renova-
tions and expansion;
3. $250,000 for the Alabama Historic Commission for the His-
toric Fort Toulouse -Fort Jackson project;
4. $1,260,000 to the Model City Community Revitalization Dis-
trict Trust in Miami, Florida for the Model City Homeownership
project;
5. $1,620,000 to the University of Idaho in Moscow, Idaho for
construction of the Performance and Education Facility at the Lio-
nel Hampton Center;
6. $620,000 for the City of Indianapolis, Indiana for the Life
Sciences Project;
7. $225,000 to the New Zion Community Foundation Develop-
ment for continued renovations and improvements for a community
resource center in Louisville, Kentucky;
8. $90,000 for The Neighborhood House in Louisville, Kentucky
to furnish the community center;
9. $135,000 for the Portland Avenue Community Trust in Lou-
isville, Kentucky for a multi-purpose facility;
