J-03-350 04/16/03 ORDINANCE NO. 12373 AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "MIAMI-DADE COUNTY EMS GRANT AWARD (FY 2002-2003)," AND APPROPRIATING FUNDS FOR THE OPERATION OF SAME IN THE TOTAL AMOUNT OF $229,993, CONSISTING OF A GRANT APPORTIONED BY MIAMI-DADE COUNTY FROM THE STATE OF FLORIDA DEPARTMENT OF HEALTH AND REHABILITATIVE SERVICES "GRANT PROGRAM FOR COUNTIES," AND $120,000 IN CARRY-OVER FUND BALANCE FROM PREVIOUS EMS GRANT AWARDS; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AWARD AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Florida Department of Health is authorized by Chapter 401, Part II, Florida Statutes, to provide grants to boards of county commissioners to improve and expand pre -hospital emergency medical services ("EMS"); and WHEREAS, it is the intent of the members of the Miami -Dade Board of County Commissioners that Fiscal Year 2002-2003 funding, in the amount of $476,979.44, for Miami -Dade County from the Florida Department of Health, "Florida Emergency Medical Services Grant Program for Counties," be appropriated and passed through to participating municipal fire departments for individual projects; and 12373 WHEREAS, the City of Miami's ("City") allocation of said total grant for Fiscal Year 2002-2003 is $109,993, with a carry-over fund balance from previous grant awards of $120,000; and WHEREAS, the City's Department of Fire -Rescue desires to implement the following projects, which work plans have been approved by Miami -Dade County, under a total grant appropriation of $229,993: (1) Riskwatch Program, $60,616; (2) EMS Equipment, $149,306, and (3) EMS Conferences and Seminars, $20,071; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Fund, entitled "Miami -Dade County EMS Grant Award," is established and resources are appropriated as described below: FUND TITLE: Miami -Dade County EMS Grant Award (FY 2002-03) RESOURCES: State of Florida Department of Health, $109,993 Florida Emergency Medical Services Grant Program for Counties through Miami -Dade County Carry-over Fund Balance 120,000 APPROPRIATIONS: Miami -Dade County EMS Grant Award $229,993 (FY 2002-03) Page 2 of 4 12373 Section 3. This appropriation is contingent upon final grant approval by the State of Florida Department of Health and Rehabilitative Services ("HRS") and the City Manager's acceptance thereof. Section 4. The City Manager is authorizedll to accept said Grant from the HRS and to execute the necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. The funds consist of a $109,993 pass through grant from the State of Florida Department of Health and Rehabilitative Services, and apportioned by Miami -Dade County, plus a $120,000 carry-over fund balance from previous EMS grant awards. BACKGROUND The Florida Department of Health and Rehabilitative Services is authorized by chapter 401, Part II, Florida Statutes, to provide grants to boards of county commissioners for the purpose of improving and expanding pre -hospital emergency medical services ("EMS"). Miami -Dade County annually submits the County Grant Application Package, a composite of improvements municipal Fire Departments wish to implement for the pre -hospital Emergency Medial System. An Emergency Medical Services County Grant, number C2013 in the total amount of $476,979.44 has been awarded by the State of Florida and the City of Miami was apportioned $109,993 for the Fiscal Year 2002-2003 EMS Program beginning October 1, 2002. A $120,000 carry-over from previous EMS grants brings the total appropriation in the special revenue fund to $229,993, from which the following projects will be funded: (1) Riskwatch Program, $60,616, (2) EMS equipment, $149,306, and (3) EMS Conferences and Seminars, $20,071.
