A EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AUTHORIZING THE ROLLOVER OF
UNEXPENDED YEAR ONE SUPER NOFA SUPPORTIVE
SERVICES GRANT FUNDS ("FUNDS") FROM FISCAL
YEAR 2001-2002 TO FISCAL YEAR 2002-2003, IN
THE AMOUNT OF $31,871, PREVIOUSLY ALLOCATED
TO THE CITY OF MIAMI HOMELESS PROGRAM FROM
THE UNITED STATES DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT, THROUGH THE MIAMI-DADE
COUNTY HOMELESS TRUST; AUTHORIZING THE CITY
MANAGER TO AMEND THE EXISTING WORK PROGRAM
AND BUDGET TO REFLECT THE ROLLOVER OF SAID
FUNDS; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, to improve its internal financial management and
reporting systems, particularly pertaining to the City of
Miami's ("City") federal grant programs, a process was
established to close accounts that have been completed at the
end of the Fiscal Year and rollover unexpended funds to the next
Fiscal Year for activities not completed; and
WHEREAS, Ordinance No. 12088, adopted July 10, 2001,
allocated $784,602 for three years from the United States
Department of Housing and Urban Development through the
Miami -Dade County Homeless Trust to the City's Homeless Project;
and

WHEREAS, the grant consisted of resources in the amount of
$261,534 per year for three years; and
WHEREAS, it has been determined that funds, in the amount
of $31,871, of Year One's allocation to the City's Homeless
Program were not expended by the end of the City's Fiscal Year
ending September 30, 2002; and
WHEREAS, to effectively carry out its outreach activities
to the homeless population, it is recommended that the
unexpended Funds be rolled over to Fiscal Year 2002-2003;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The rollover of unexpended Year One's Super
NOFA Supportive Services Grant Funds, in the amount of $31,871,
from Fiscal Year 2001-2002 to Fiscal Year 2002-2003, previously
allocated to the City of Miami's Homeless Program from the
United States Department of Housing and Urban Development,
through the Miami -Dade County Homeless Trust, is authorized.

Section 3. The City Manager is authorized!' to amend the
existing Work Program and Budget to reflect the rollover of said
funds.
Section 4. All Ordinances or parts of Ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be
affected.
Section 6. This Ordinance is declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debts, necessary and required purchases of goods
and supplies and to generally carry on the functions of
municipal affairs.
�i The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 7. The requirement of reading this Ordinance on
two separate days is dispensed by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.�'

This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.

RECOMMENDATION
It is respectfully recommended that the Honorable Mayor and the City Commission adopt
the attached Emergency Ordinance to Roll Over unexpended Revenues of $31,871.00
from fiscal year 2001-2002 to 2002-2003 from the 2000 Super NOFA Supportive
Services Grant awarded to the Homeless Program by the United States Department of
Housing and Urban Development through the Miami -Dade County Homeless Trust.
.BACKGROUND
The Miami Homeless Assistance Program was awarded a three-year grant in 2001 from
the United States Department of Housing and Urban Development through the Miami -
Dade County Homeless Trust. This award was accepted and adopted by Ordinance
#12088 on July 10`h, 2001 by the City of Miami Commission. As the City of Miami's
fiscal year is October 1 through September 30, and the program year for the Supportive
Services Grant is from June 1 through May 31, it is necessary to roll over the remaining
budgeted funds to this year's fiscal budget in order to continue funding the Miami
Homeless Assistance Program at its current level of services.

FUND ENTITLED "2000 SUPER NOFA SUPPORTIVE
SERVICES GRANT FUND"; APPROPRIATING FUNDS IN
THE AMOUNT OF $261,534 EACH YEAR FOR THREE
YEARS FOR A TOTAL OF $784,602, CONSISTING OF

DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY

Section 2. This appropriation is contingent upon receipt
of the grant from the Miami -Dade County Homeless Trust and the
City Manager's acceptance.
Section 3. The City Manager is authorizedl' to accept
the grant and to execute all necessary documents, in a form
acceptable to the City Attorney.
Section 4. The expenditure of these grant funds is
authorized for the operation of the Miami Homeless Assistance
Program.
Section 5. These authorizations shall remain valid and
outstanding even if the anticipated grant award is reduced or
increased.
Section 6. All Ordinances or parts of Ordinance insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
