AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12280, AS AMENDED, THE CAPITAL PROJECTS APPROPRIATIONS ORDINANCE, TO REVISE PREVIOUSLY APPROVED CAPITAL PROJECT NO. 333112 ENTITLED "KENNEDY PARK IMPROVEMENTS," CAPITAL PROJECT NO. 333124 ENTITLED "VIRRICK COMMUNITY WATER SPORTS CENTER" AND CAPITAL PROJECT NO. 333126 ENTITLED "WATSON ISLAND IMPROVEMENTS" BY APPROPRIATING $915,000 FROM UNALLOCATED GENERAL FUND CONTRIBUTION FUNDS AVAILABLE IN THE CAPITAL FUND; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 12280, the Capital Improvements Appropriations Ordinance, on September 26, 2002; and WHEREAS, the Administration wishes to implement parking lot renovations at Kennedy Park and the Virrick Water Sports Center and electrical utility conversion on Watson Island; and WHEREAS, it is necessary to appropriate additional funds in the amount of $200,000 for Kennedy Park, $400,000 for the Virrick Water Sports Center and $315,000 for Watson Island; and WHEREAS, the total funding of $915,000 is available from unallocated General Fund Contribution in the Capital Fund; 12366 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12280, adopted September 26, 2002, as amended, the Capital Improvements Appropriations Ordinance, is amended in the following particulars::/ "Ordinance No. 12280 Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2003. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: VI. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal Page 3 of 4 12366 affairs. Section 6. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. Page 4 of 4 1236 TO FROM CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM The Honorable Mayor and Members of the City Commission Joe Arriola DATE : May 13, 2003 SUBJECT: Capital Projects Amendment Ordinance REFERENCES: ENCLOSURES: 12 FILE : It is respectfully requested that the City Commission approve the attached amendment to the Capital Projects Appropriations Ordinance No. 12280, as amended, adopted on September 26, 2002. BACKGROUND The proposed amendment ordinance is for the appropriation of $915,000 necessary to initiate three projects this fiscal year: ■ The parking lot adjacent to the Miami Watersports Center (i.e. former Virrick Gym) needs to be renovated to meet the City's zoning Ordinance and Florida Building Code. There will be 163 parking spaces and the improvements include new paving, curbing, bumpers, stripping, landscaping, irrigation, drainage and site lighting. The estimated cost for this project is $400,000. ■ The parking lot at Kennedy Park currently contains 30 parking spaces. The addition of a new parking area and renovation of the existing lot will result in 58 additional spaces for a total of 88 parking spaces. Due to the nature of the site conditions and use of the parking area, drainage facilities and lighting structures are not included. The estimated cost for this project is $200,000. ■ The electrical utilities on the south side of Watson Island need to be placed underground in preparation for the development of the Air Transportation Facility and Regional Visitors Center. The estimated cost for this work is $315,000 per a quote provided by Florida Power and Light Company. The total funding needed for the three projects has been identified from general fund contribution available in the capital fund and needs to be appropriated into the respective capital projects.
