ORDINANCE NO. 12357
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED: "SUMMER FOOD SERVICE PROGRAM
FOR CHILDREN 2003" AND APPROPRIATING FUNDS
FOR THE OPERATION OF THE PROGRAM IN THE
ESTIMATED AMOUNT OF $557,868, CONSISTING OF A
GRANT FROM THE UNITED STATES DEPARTMENT OF
AGRICULTURE THROUGH THE FLORIDA DEPARTMENT OF
EDUCATION; AUTHORIZING THE CITY MANAGER TO
ACCEPT THE GRANT AWARD FROM THE UNITED STATES
DEPARTMENT OF AGRICULTURE AND TO EXECUTE THE
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY; FURTHER AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH
THE SCHOOL BOARD OF MIAMI-DADE COUNTY FOR THE
PROVISION OF LUNCHES AND SNACKS TO THE
PARTICIPANTS OF THE CITY OF MIAMI'S 2003
SUMMER FOOD SERVICE PROGRAM FROM JUNE 16,
2003 THROUGH, AUGUST 15, 2003; CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Department of Parks and Recreation of the City
of Miami ("City") sponsors a Summer Food Service Program for
children which provides nutritional meals in conjunction with its
comprehensive recreational program; and
WHEREAS the Florida Department of Education, Food and
Nutrition Management Division, with funding from the United
States Department of Agriculture has granted

funds in the estimated amount of $557,868 to conduct a summer
food service program from June 16, 2003 through August 15, 2003
for children up to the age of 18; and
WHEREAS, on April 9, 2003, the School Board of Miami -Dade
County ("School Board"), is scheduled to approve an agreement
with the City, to provide the meals for participants of the
City's 2003 Summer Food Program at an estimated $2.555 per lunch
and $.6025 per snack per participant with said reimbursement
figures including operation and administrative costs; and
WHEREAS, the grant for year 2003 is estimated to be $557,868
based on Year 2003 figures and the reimbursement rates of $2.55
per lunch and .6025 per snack including the respective
reimbursement rates for operation and administrative costs, to
serve an estimated 177,100 lunches and 174,900 supplements during
the project period starting June 16, 2003 and ending August 15,
2003; and
WHEREAS, an estimated $557,868 will be received from the
State of Florida to implement said program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and included
as is fully set forth in this Section.

Section 2. The Special Revenue Fund entitled "Summer
Food Service Program for Children 2003" is established and
resources are appropriated as described below:
FUND TITLE: Summer Food Service for Children -2003.
RESOURCES: Grant Reimbursements from the
United States Department of
Agriculture through the Florida
Department of Education. $557,868
APPROPRIATION: Summer Food Service Program for
Children -2003. $557,868
Section 3. This appropriation is contingent upon the
approval of the City of Miami's ("City") application for said
grant by the Florida Department of Education and the City
Manager's acceptance.
Section 4. The City Manager is authorizedll to accept
the grant from the United States Department of Agriculture
("USDA") and to execute the necessary documents(s), in a form
acceptable to the City Attorney, for said purpose.
1� The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 5. The City Manager is authorizedll to execute
an agreement, in a form acceptable to the City Attorney, with the
School Board of Miami -Dade County for the provision of lunches
and snacks to the participants of the City's 2003 Summer Food
Service Program, from June 16, 2003 through August 15, 2003,
conditioned upon the City's acceptance and appropriation of grant
funds in the estimated amount of $557,868 from the USDA through
the Florida Department of Education, with funds allocated for
said meals from the Summer Food Service Program for Children 2003
Special Revenue Fund.
Section 6. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of
municipal affairs.

Section 9. The requirements of reading this Ordinance on
two separate days is dispensed by an affirmative vote of not less
than four-fifths (4/5th,) of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor./

If the Mayor does not sign this Ordinance, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the
City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission
adopt the attached emergency ordinance to create a new
Special Revenue Fund and to appropriate grant funds in the
estimated amount of $557,868, to be received from the United
States Department of Agriculture (USDA) to conduct a summer
food service program for youth aged 18 and under from June
16, 2003 through August 15, 2003 and authorizing the City
Manager to enter into an agreement, in a form acceptable to
the City Attorney, with the School Board of Miami -Dade
County, for the purpose of providing meals to the
participants of the City's Summer Food Program operated by
the Department of Parks and Recreation from June 16, 2003
through August 15, 2003.
BACKGROUND:
Each year since 1968, the Department of Parks and Recreation
has sponsored a Summer Food Service Program for children.
Under this program, the City provides nutritional meals in
conjunction with its comprehensive recreational program
featuring arts and crafts, sporting activities, field trips
and special events. This year, we plan to serve up to 4,025
lunches and 3,975 snacks per day using no less than twenty-
eight (28) sites throughout the City during the forty-four
(44) day program.

Based on 2003 program totals, we estimate that 177,100
lunches and 174,900 snacks will be served during the
upcoming summer program. Funding is provided to the City
from a USDA grant through Florida's Department of Education
(DOE). This year's grant is estimated at $557,868 based on
current year's meals figures and reimbursement rates (which
include the respective reimbursement rates for operating and
administrative expenses) of $2.555 for lunch and $.6025 for
afternoon supplements (snacks). These rates will provide
sufficient funds to cover the meal cost and to hire the
necessary temporary, part-time recreation aides to operate
the program. It should be noted that this grant does not
require matching funds.
Last year, the City of Miami, along with Miami -Dade County,
utilized the School Board of Miami -Dade County for the
provision of this food service. Once again, under this
Ordinance, the School Board of Miami -Dade County is
authorized to provide the meals for the 2003 Summer Food
Program to both the City and County.
Due to the fact that there is only one Commission Meeting
scheduled in March, this is being submitted as an emergency
ordinance to ensure that there is sufficient time to execute
all agreements needed to implement this program. The Dade
County School Board has notified us that they would need a
signed agreement to provide these services by April 9, 2003.
The executed agreement with the State of Florida is due in
Tallahassee, Florida by May 16, 2003
