ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 12280 TO REFLECT A
FUNDING INCREASE FOR EXISTING OR NEW
CAPITAL IMPROVEMENT PROJECTS; AND
AUTHORIZING THE ACCEPTANCE AND APPROPRIATION
OF SIX GRANTS, IN THE TOTAL AMOUNT OF
$785,065, FROM MIAMI-DADE COUNTY AS
DESIGNATED HEREIN UNDER THE SAFE
NEIGHBORHOOD PARK BOND PROGRAM DISCRETIONARY
INTEREST EARNINGS FUNDING PROJECTS 2002
PROCEEDS, AND $92,345 FROM THE FLORIDA
RECREATION DEVELOPMENT ASSISTANCE PROGRAM
FOR IMPROVEMENTS TO THE LEMON CITY PARK,
WITH MATCHING FUNDS IN THE SAME AMOUNT FROM
THE HOMELAND DEFENSE NEIGHBORHOOD
IMPROVEMENT BOND FUNDS; FURTHER AUTHORIZING
THE CITY MANAGER TO EXECUTE THE NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, TO IMPLEMENT ACCEPTANCE OF
SAID GRANTS, PURSUANT TO THE PROVISIONS OF
THE SAFE NEIGHBORHOOD PARKS ORDINANCE;
FURTHER AUTHORIZING THE ALLOCATION AND
PAYMENT OF (1) SUPPLEMENTAL FUNDS REQUIRED
TO COMPLETE SAID PROJECTS IF THE COSTS OF
SAID PROJECTS EXCEED THE GRANT
APPROPRIATION, AND (2) FUNDS TO OPERATE,
MAINTAIN AND PROVIDE PROGRAMMING AT EACH
PROJECT UPON ITS COMPLETION.
WHEREAS, the citizens of Miami -Dade County ("County")
authorized the issuance of general obligation bonds ("Bonds")
for the purpose of financing Capital Improvement Programs for
certain parks, beaches, natural areas and recreation facilities;
and

WHEREAS, to implement and give effect to the bond program,
the County, enacted Ordinance 96-115, the Safe Neighborhood
Parks Ordinance; and
WHEREAS, it is necessary and desirable to improve the
quality of life, to benefit property values, to promote
prevention of juvenile crime by providing positive recreation
opportunities, and to improve the recreation facilities for
youth, adult, and senior citizens in this community through the
improvement of our parks and natural areas; and
WHEREAS, the City of Miami ("City") has made applications
and obtained grant monies in the amount of $785,065 from the
Series 2002 Bond Program Discretionary Interest Earnings Bond
Proceeds for the projects listed herein to the County, pursuant
to all terms and conditions of the Ordinance; and
WHEREAS, in addition, the City has received grant funds, in
the amount of $92,345, from the Florida Recreation Development
Assistance Program for improvements to Lemon City Park, with
matching funds in the same amount from previously appropriated
Homeland Defense Neighborhood Improvement Bond Funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to
this
Ordinance are
adopted by reference and
incorporated
as if
fully set forth in
this Section.
Section 2. The acceptance and appropriation of funds
received from six grants, in the total amount of $877,410 to
Miami -Dade County and the State of Florida for the projects in
the amounts herein designated, under the Safe Neighborhood Parks
Bond Program, 2002 Bond Discretionary Interest Earnings
Allocations and the Florida Recreation Assistance Program
("FRDAP") are authorized as follows:

Section 3. The City Manager is authorizedll to accept
said grants, appropriate said funds and execute the necessary
document(s), in a form acceptable to the City Attorney, to
implement acceptance of said grants.
Section 4. Said Grant, in the amount of $92,345 from
the Florida Recreation Development Assistance Program is
accepted, with matching funds in the same amount from previously
appropriated Homeland Defense Neighborhood Improvement Bond
Funds.
Section 5. The City of Miami ("City") shall complete
each of the Projects in accordance with the terms of said grant
agreement (s) the Ordinance, and the administrative rules
authorized by the Citizen's Oversight Committee ("Committee") to
implement the Ordinance. If the total cost of a Project exceeds
the value appropriated in said grant(s), then the City will
provide any supplemental funds required to complete the Project.
In the event that supplemental funds are necessary for
completion, the City will demonstrate that such supplemental
funds have been committed to the Project prior to and as a

condition of further disbursement of grant funds for a specified
project. The requirement for the City to provide any
supplemental funds required to complete the Project may, at the
sole discretion of the Committee, be modified in whole or in
part by a reduction in scope of work consistent with the
Ordinance.
Section 6. The City recognizes and directs that any
beach, park, or other public facility acquired, developed,
rehabilitated or restored with bond funds, including the
Projects, shall be open and accessible to the public without
discrimination as to race, color, gender, age, religion, belief,
residence, natural origin, marital status or disability.
Section 7. To the extent allowed by law, City shall
commit any and all funds, which may be required to operate,
maintain and provide programming at each park project upon its
completion.
Section 8. All grants received shall be used solely for
the projects for which they have been designated.

Section 9. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City of Miami,
including new capital improvement projects scheduled to begin during Fiscal
Year 2003. The herein appropriations which are hereby designated by reference
to descriptive project title and number also include appropriations for
previously approved scheduled projects as well as reappropriations of prior
funds. The sources of revenues to support the herein appropriations are
hereby identified by fund and project in ten Capital Funds, as follows:

Section 11. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be
affected.
Section 12. This Ordinance shall become effective thirty
(30) days after the final reading and adoption thereof .31
3/ This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt
the attached Ordinance, authorizing the City Manager to accept
(6) six grants in the total amount of $785,065 from Miami -Dade
County Safe Neighborhood Park Bond Program, Series 2002
Discretionary Interest Earnings funding and another grant in the
amount of $92,345 from the State's Florida Recreation
Development Assistance Program (FRDAP), which requires a match
in the same amount from the Homeland Defense Neighborhood
Improvement Bond Funds. The Ordinance further authorizes the
City Manager to execute the necessary document(s), in a form
acceptable to the City Attorney, to implement said grants. In
addition, pursuant to the provisions of the Safe Neighborhood
Parks Ordinance, the Resolution authorizes the payment of: (1)
supplemental funds required to complete said projects if the
costs of said projects exceed the grant allocation; (2) funds
to operate, maintain and provide programming at each project
upon its completion.
