AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A NEW SPECIAL REVENUE FUND
ENTITLED: "WEAPONS OF MASS DESTRUCTION
ADMINISTRATIVE PREPAREDNESS/ FEMA GRANT AWARD
(FY 2002)" FOR THE OPERATION OF SAME IN THE
AMOUNT OF $740,000 CONSISTING OF A GRANT
ALLOCATED BY THE FEDERAL EMERGENCY MANAGEMENT
AGENCY (FEMA) FOR THE PERIOD BEGINNING
JANUARY 10, 2003 THROUGH JANUARY 9, 2004, TO
PURCHASE SPECIALIZED EQUIPMENT, STORAGE AND
MAINTENANCE, TRAINING, MANAGEMENT, AND
ADMINISTRATION OF THE SOUTH FLORIDA URBAN
SEARCH AND RESCUE TASK FORCE WEAPONS OF MASS
DESTRUCTION PREPAREDNESS PROGRAM; AUTHORIZING
THE CITY MANAGER TO ACCEPT THE GRANT AWARD
FROM FEMA AND TO EXECUTE ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR ACCEPTANCE OF THE GRANT;
CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Miami South Florida Urban Search and
Rescue ("USAR") Task Force, FL-TF2, has been awarded a grant, in
the amount of $740,000, from the Federal Emergency Management
Agency ("FEMA"), for the development and operation of the
Department of Fire -Rescue's 2002 Weapons of Mass Destruction
("WMD") Program; and

WHEREAS, said funds shall be used by the Department of
Fire -Rescue to purchase specialized equipment, storage and
maintenance, and to provide training, management and
administration of the USAR and WMD Programs, as stipulated in the
grant award; and
WHEREAS, it is appropriate for the City Manager to accept
said grant and to establish a special revenue fund for the
appropriation of the grant award;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Fund
entitled: "Weapons of Mass Destruction Administrative
Preparedness/ Federal Emergency Management Agency ("FEMA") Grant
Award (FY 2002)," for the period beginning January 10, 2003
through January 9, 2004, is established and appropriated to
purchase specialized equipment, storage and maintenance,
training, management, and administration of the South Florida
Urban Search and Rescue Task Force Weapons of Mass Destruction
Preparedness Program as described below:

The City Manager is authorizedll to accept
the grant from FEMA and to execute all necessary documents, in a
form acceptable to the City Attorney, for acceptance of the
grant.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
1� The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.V

RECOMMENDATION
It is recommended that the attached Ordinance be adopted establishing a special revenue fund,
"Weapons of Mass Destruction Administrative Preparedness/FEMA Grant Award (FY 2002)",
and appropriating funds, in the amount of $740,000 consisting of a grant from the Federal
Emergency Management Agency (FEMA) for the period beginning January 10, 2003 through
January 9, 2004. The funds will be used, as stipulated by the grant, for the purchase of
specialized equipment, storage and maintenance, provision of training, management, and
administration of the South Florida Urban Search and Rescue (USAR) Task Force Weapons of
Mass Destruction (WMD) Preparedness Program.
BACKGROUND
The Federal Emergency Management Agency "FEMA" has awarded a FEMA grant to the South
Florida Urban Search and Rescue Task Force, FL-TF2 for fiscal year 2002 for the development
and operation of the Department of Fire -Rescue's Weapons of Mass Destruction (WMD)
Preparedness Program, in the amount of $740,000. Specifically, the City will use these funds as
stipulated by the grant, for the purchase of specialized equipment, storage and maintenance,
provision of training, management, and administration of the South Florida Urban Search and
Rescue Team Weapons of Mass Destruction (WMD) Program.
It is now appropriate to accept said grant award, establish a special revenue fund, and appropriate
the $740,000 grant award therein for this fiscal year.

CONTENTS OF AGREEMENT

ARTICLE I — PROJECT DESCRIPTION
The Grantee shall furnish the necessary personnel, materials, services, equipment,
facilities and otherwise do all things necessary for the performance of the work set forth
in the Program Narrative.
ARTICLE II — PERIOD OF PERFORMANCE
The period of performance shall be from January 10, 2003 through January 9, 2004.
ARTICLE III — AMOUNT AWARDED
This agreement is for the administration and completion of an approved National Urban
Search and Rescue Response System Weapons of Mass Destruction (WMD) Grant.
Agreement funds shall not be used for other purposes.
The scope and conditions of the tasks to be undertaken by the Grantee with the amount of
money identified in block 14 of the coversheet (FEMA Form 40-21), "ASSISTANCE
AMOUNT' during the time identified as the "PERFORMANCE PERIOD" are contained
in the Statement of Work.

ARTICLE IV — REQUEST FOR RELVIBURSEMENT
A. Payments will be requested via Smartlink, the Department of Health and Human
Services' internet-based payment system. Payments are to be requested in three
increments of $20,000, $2.50,000, and $240,000. (Please refer to the program
guidance.)
ARTICLE V — FINANCIAL REPORTS
The Department of Health and Human Services requires a quarterly financial status report
electronically which will serve as the Expenditure report and detail the amount of funds
spent.

A final FEMA Form 20-10, Financial Status Report, will be due 90 days after project
completion. Copies of the FF 20-10 are to be submitted to the FEMA Office of Financial
Management, Grants Management Branch with a copy to the FEMA program office. The

ARTICLE VI — PERFORTNIANCE REPORTS
The Performance Report is a written report and is a breakout of expenditures, as
described in the Statement of Work and Program Guidance. The Performance Report
is due every 120 days to the FEMA Headquarters Program office for the duration of
this agreement.
ARTICLE VII — FENIA OFFICIALS
A. FEMA officials for the WMD agreement are as follows:
1. The Program Officer (PO) shall be an official at FEMA Headquarters who will be
responsible for the technical monitoring of the stages of work and technical
performance of the activities described in the Statement of Work.
2. The Assistance Officer (AO) is the FEMA official who has full authority to
negotiate, administer and execute all business matters of the agreement.

ARTICLE VIII — BUDGET
A. The Grantee shall follow prior approval requirements found in the Emergency
Management and Assistance Regulations, 44 CFR Part 13.30. for non -construction
grants, transfers of funds between total direct cost categories in the approved budget
shall receive the prior approval of FEMA when such cumulative transfers among
those direct cost categories exceed ten percent of the total budget. The Grantee shall
obtain prior written approval for any budget revision that would result in the need for
additional funds. If a cooperative agreement provides funding for both construction
and non -construction activities, the Grantee must obtain written approval from
FEMA before making any fund or budget transfer from non -construction to
construction or vice versa.
B. No transfer of funds to agencies other than those identified in the approved
cooperative agreement application shall be made without prior approval of FEMA.
C. If a Grantee estimates that it will have unobligated funds remaining after the end of
the performance period, the Grantee should report this to FEMA Headquarters at the
earliest possible time and ask for disposition instructions.
D. No monetary increase amendments hereto, or time extension amendments hereto,
will be approved unless all financial or performance reports are current.
ARTICLE IX — OTHER TERNIS AND CONDITIONS
The other terms and conditions of this agreement are as follows:
A. Prior to the start of any construction activity, the Grantee shall ensure that all
applicable Federal, State; and local permits and clearances are obtained.
B. Grantees are encouraged to integrate National Environmental Policy Act (NEPA)
compliance and related legislation as implemented under 44CFi, Part 10, with the
initial planning and decision making process for this program. Grantees are
encouraged to seek support from FEMA Environmental Officers in complying with
NEPA requirements.
C. The Grantee shall transfer to FEMA the appropriate share, based 9n the Federal
support percentage, of any refund, rebate, credit of other amounts arising from the
performance of this agreement, along with accrued interest, if any. The Grantee shall
take necessary action to effect prompt collection of all monies due or which may
become due and to cooperate with FEMA in any claim or suit in connection with
amounts due.
D. The Grantee is free to copyright any original work developed in the course of or
under the agreement. FEMA reserves a royalty -free, non-exclusive and irrevocable
right to reproduce, publish, or otherwise use, and to authorize others to use, the work
for Government program purposes. Any publication resulting from work performed
under this agreement shall include an acknowledgement of FEMA's financial support
and a statement that the publication does not necessarily reflect FEMA's views.

Work Plan
Administration
The City of Miami and the Miami Fire Department are actively attempting to put the
necessary personnel in-place to meet the requirements set by US&R program needs.
FEMA Funding has been announced by this WMD grant that will allow positions to be
filled for one year and possible reoccurring funding will be announced to secure these
spots for this program in the coming years.
Training
Training classes and calendars are being developed at this time to allow sufficient
planning and scheduling of personnel to ensure successful delivery of FETLA approved
curriculums and information.
Equipment
FL-TF2 Equipment Cache is being reviewed and evaluated for maintenance. repair and
replacement needs on a continual basis.
The additional funding provided within this grant will assist in meeting FEtiLAk Cache
requirements.
Equipment database and management schedules are constantly a priority based on the
amount ofstaffine and volunteer assistance received by this team.
Additional personnel will provide the assistance needed to develop and or follow a
National program standard of Logistics and Equipment Support.
Storage
The City of Miami is actively searching for an adequate facility to move the Equipment
and Vehicles of the US&R Team from its present location.
The requirements for the facility were requested to be a secure facility. temperature

construction contract(s) for the project or undertake other

22. It will operate and maintain the facility in accordance
with the minimum standards as may be required or
prescribed by the applicable Federal, State, and local
agencies for the maintenance and operation of such
facilities.
23. It will require the facility to be designed to comply
with the "American Standard Specifications for Making
Buildings and Facilities Accessible to, and Usable by,
the Physically Handicapped," Number Al 17. -1961, as
modified (41 CFR 101-17.703). The applicant will be
responsible for conducting inspections to ensure
compliance with these specifications by the contractor.
24. If any real property or structure thereon is provided
or improved with the aid of Federal financial assistance
extended to the applicant, this assurance shall obligate
the applicant, or in the case of any transfer of such
property, any transfer, for the period during which the
real property or structure is used for a purpose for which
the Federal financial assistance is extended or for
another purpose involving the provision of similar
services or benefits.
25. In making subgrants with nonprofit institutions

OTHER RESPONSIBILITY MATTERS; AND DRUG-FREE WORKPLACE REQUIREMENTS

when the Federal Emergency Management Agency (FEMA) determines to award the covered transaction, grant, or cooperative
agreement.
1. LOBBYING
A. As required by section 1352, Title 31 of the U.S. Code, and
implemented at 44 CFR Part 18, for persons entering into a grant
or cooperative agreement over $100,000, as defined at 44 CFR
Part 18, the applicant certifies that:
(a) No Federal appropriated funds have been paid or will be paid,
by or on behalf of the undersigned, to any person for influencing or
attempting to influence an officer or employee of any agency, a
Member of Congress, an officer or employee of congress, or an
employee of a Member of Congress in connection. with the maldng
of any Federal grant, the entering into of any cooperative agreement,
and the extension, continuation, renewal, amendment, or modification
of any Federal grant or cooperative agreement;
(b) If any other funds than Federal appropriated funds have been
paid or will be paid to any person for influencing or attempting to
influence an officer or employee of any agency, a Member of
Congress, an officer or an employee of Congress, or employee
of a member of Congress in connection with this Federal grant or
cooperative agreement, the undersigned shall complete and submit
Standard Form LLL, "Disclosure of Lobbying Activities." in
accordance with its instructions;
(c) The undersigned shall require that the language of this certification
be ircluded in the award documents for all subawards at all tiers
(including subgrants, contracts under grants and cooperative
agreements, and subcontract(s) and that all subrecipients shall
certify and disclose accordingly.

theft, forgery, bribery, falsification or destitution of records,
making false statements, or receiving stolen property
(c) Are not presently indicted for or otherwise criminally or civilly
charged by a govemmental entity (Federal, State, or local) with
commission of any of the offenses enumerated in paragraph (1)(b)
of this certification; and
(d) Have not within a three-year period preceding this application

3. DRUG-FREE WORKPLACE
(GRANTEES OTHER THAN INDIVIDUALS)
As required by the Drug -Free Workplace Act of 1988, and
implemented at 44 CFR Part 17, Subpart F, for grantees, as defined
at 44 CFR Part 17, Sections 17.615 and 17.620:

and implemented at 44 CFR Part 67, for prospective participants in

(a) Are not presently debarred, suspended, proposed for debarment,
declared ineligible, sentenced to a denial of Federal benefits by a State
or Federal court, or voluntarily excluded from covered transactions by
any Federal department or agency:

(b) Establishing an on-going drug free awareness program to
inform empoyees about:
(1) The dangers of drug abuse in the workplace;
(2) The grantees policy of maintaining a drug-free workplace;
(3) Any available dug counseling, rehabilitation, and
employee assistance programs: and
(4) the penalties that may be imposed upon employees for
drug abuse violations occurring in the workplace,
(c) Making it a requirement that each employee , engaged in
the performance of the grant to be given a copy of the statement
required by paragraph (a);
(d) Notifying the employee in the statement required by
paragraph (a) that, as a condition of employment under the grant,
the employee will:
(1) Abide by the terms of the statement; and
(2) NOW the employee in writing of his or her conviction for a
violation of a criminal drug statute occurring in the workplace no later
than five calendar days after such conviction.
(e) Notifying the agency, in writing, within 10 calendar days after
receiving notice under subparagraph (d)(2) from an employee or
Otherwise receiving actual notice of such conviction. Employers of
convicted employees must provide notice, including position title,
to the applicable FEMA awarding office, i.e., regional office or
FEMA office.
(f) Taking one of the following actions, within 30 calendar days of
receiving notice under subparagraph (d)(2), with respect to any
employee who is so convicted:
(1) Taking appropriate personnel action against such an employee,
up to and including termination, consistent with the requirements
of the Rehabilitation Act of 1973, as amended; or

South Florida Urban Search and Rescue Team
WMD Administrative Preparedness Grant
These are responses and direction that FLTF2 intends to take to meet all goals
outlined in the WMD package within the time frames specified
GRANT GOALS
Goal 1. To staff each of the 28 State and local US&R Programs with sufficient
personnel for at least one year no later than February 28, 2003. FEMA.
recommends a minimum staffing of a dedicated Task Force Coordinator,
an Administrative Assistant, a Training Coordinator and a Logistician to
administer the day-to-day affairs of the Task Force.
The City of Miami and the Miami Fire Department are in the process of
selecting personnel to fill these positions for a one _year term as outlined
in the grant.
Goal 2. To recruit and fully staff at least 90% of all US&R Task Force positions, 3
deep. no later than March 31. 2003. Staffing level is expected to be 210
personnel as based on a VWti1D level response. This still requires approval
from the various committees.
FL -TF 2 has 195 personnel presenthy rostered and in various phases of
Training for Activation. 45 new personnel have been signed up as iVew
Personnel to account for attrition and retirement of individuals within
the L'S&R team
Goal 3. To assemble and maintain full personnel records for each Task Force
member in a central location for day—to-dav administration and easv
operational readiness review. Records shall include. application
documents, resume, immunizations, full training records & documents,
and related and required US&R medical records no later than March 1.
2003. All team member medical records shall be secured appropriately to
maintain full confidentially based on your Task Force policy.
FL-TF2 offices have been reconfigured and set up with adequate space
and storage capability to fulfill this request. We are also transitioning
Database Management system into new software to allow easier
maintenance of personnel records and equipment accountability.

Goal 4. To provide baseline medical review and examination as required for the
VVNID Program for at least 90% of all US&R personnel no later than June
1, 2003.
Plans were discussed to develop system within the 26 agencies associated
with FL-TF2 to standardize and or develop baseline physical to be
followed during regular employee physicals and or provide location and
Guidelines for civilians to have equal and consistent examinations due
to affiliation with Task force and exposure potential.
Goal 5. To immunize 100% of all US&R personnel according to the US&R
immunization policy no later than March 31, 2003.
Plans are in place to immunize all Task Force personnel with the
FE,YIA approved immunization group of vaccinations and drugs to
prevent infection and or exposure to certain situations. Funding and
Vaccine list to be determined.
Goal 6. To finalize all agreements with participating agencies and civilian
personnel no later than March 31, 2003.
All Alemorandum of agreements are to be completed before January 1,
2003. This deadline has been advertised to all Participating Agencies.
There are only six outstanding as of this date.
Goal 7. To complete at least one internal and self -evaluated operational readiness
inspection and preparedness survey in accordance with FEivIA
specifications prior to March 1, 2003. Your agency shall provide a written
and electronic copy of the report to FERIA by that date. The electronic
copy shall be submitted on a compact disk (CD) with a paper copy and
cover letter addressed to the US&R Program Director.
There are plans to conduct internal review within the specific disciplines
and they: request and also conduct a joint review with FLTFI which will
allow an Objective look at team requirements and performance. We then
will work on combining efforts to standardize preparedness and
operations of the two neighboring Task Forces.
Goal S. To provide FEMA with an updated roster of Task Force personnel in a
Microsoft access database on a CD no later than January 31, 2003 and
continually hereafter on a semi-annual basis. The CD shall be submitted
by January 31St and July 31" each year with a cover letter addressed to the
US&R Program Director.
New Computer software programs and equipment will allow us to
facilitate the request than has been done in the past.

Goal 9. To proviue WMD training for at least 80% of all US&R Task Force
personnel by September 1, 2003.
We are presently working to obtain t1:e * Curriculum and Delivery
materials associated with the FERIA approved W11D training. We are
going to provide training to all of the Agencies associated with the FL-
TF2 US&R Team.
Goal 10. To provide training and certify at least 80% of all US&R personnel in
their assigned primary position according to the current US&R position
description. This shall be accomplished no later than September 1, 2003.
An Advisory Committee has been established within the Task Force to
develop training schedules and timelines that will allow us to meet this
goal within the time specified We have also discussed the possibility of
sending out or bringing in approved Instructors to expedite the training
needs of Task Force.
Goal 11. To provide a minimum 90% complete stand alone US&R equipment cache
no later than September 1, 2003.
We are presently in the process of identifying shortfalls in the FL-TF2
cache and have taken steps to speed rip the Procurement Process within:
the City of:Miami. We are trying to establish Blanket Purchase orders to
be submitted as soon as funding is receiving to allow rapid receipt of
necessary equipment.
Goal 12. To provide personal equipment to at least 80% of personnel assigned to
the Task Force no later than September 1, 2003.
Personal equipment has been ordered and continues to cone in. Policies
are in place to recover and or replace equipment that is lost, damaged or
stolen. This goal should not be difficult to reach.
Goal 13. To develop pre -standing equipment requisitions for all equipment not yet
purchased by the Task Force no later than -larch 31, 2003.

Goal 14. To provide 100% of the manufacturers recommended maintenance on all
US&R equipment. The Sponsoring Agency shall develop a written policy
to describe, guide or maintain a permanent ongoing maintenance plan no
later than January 3 t, 2003. This document shall be kept on file with the
Task Force and shall be provided on demand.
The plans to provide additional staff to this program will greatly assist
with the Day to Day requirements such as this. The Logistics specialist

can be ..valuable when trying to establish and meet the requirements set
by manufacturers of FEMA and US&R approved equipment,
Goal 15. To complete a full inventory review, equipment marking, and equipment
packaging plan to meet an acceptable standard for over the road or air
transportation no later than March 1, 2003.
FLTF2 has made tentative plans to review and pursue a standard
marking and packaging system that is FEMA and Task Force approved
We have also planned to have a joint program between FL-TFJ and FL-
TF2 to allow greater consistency and standardization for load
configurations. There are also plans to create a greater level of
involvement at the Logistics working Group level to have input
regarding Equipment and Load Plan configurations.
Goal 16. To provide FEMA with an updated equipment inventory of Task Force
equipment in a Microsoft access database on a CD no later than January
31, 2003. The equipment inventory shall be continually provided hereafter
on a semi-annual basis. The CD shall be submitted by January 31' and
July 31' each year with a cover letter addressed to the US&R Program
Director.
The new database development and additional personnel will greath
improve the capability of fulfilling this request.
Goal 17. To provide FEMA with comprehensive long-term equipment storage plan
no later than July 1. 2003. Up to $100.000 of this Grant may be used for
costs associated with developing permanent lona-term warehouse space
for equipment storage and team offices. This grant may not be used for
funding actual new construction. However. costs associated with
g2grading. renovations and minor modifications of warehouse facilities
that do not change the footprint of the structure are permitted.
We are presently pursuing the acquisition of adequate storage facilities
within the City of Afiami. We are locating secure, temperature controlled
facilities that will have sufficient space for Storage, Maintenance and
control of LS&R FL-TF2 Equipment.. Vehicles and Propert.
