ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 12280, THE
CAPITAL PROJECTS APPROPRIATIONS ORDINANCE, TO
ESTABLISH NEW CAPITAL PROJECT NO. 333138
ENTITLED "FERN ISLE CLEANUP AND RENOVATION"
AND APPROPRIATE $580,000 FROM UNALLOCATED
HOMELAND DEFENSE/NEIGHBORHOOD IMPROVEMENT
BOND FUNDS FOR SAID PROJECT; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 12280,
the Capital Improvements Appropriations Ordinance, on
September 26, 2002; and
WHEREAS, the Fern Isle Cleanup and Renovation is an approved
project under the Homeland Defense/Neighborhood Improvement
General Obligation Bonds; and
WHEREAS, Miami -Dade County Department of Environmental
Resources Management has given the City of Miami until August
2003 to remediate the environmental issues at the Fern Isle site;
and

WHEREAS, the proposed project schedule has a duration time
of approximately 17 weeks; and
WHEREAS, it is necessary to establish a new Capital
Improvement Project ("CIP") entitled "Fern Isle Cleanup and
Renovation," CIP No. 333138, in the Parks and Recreation fund and
to appropriate $580,000 from available unallocated Homeland
Defense/Neighborhood Improvement Bonds for said environmental
work;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 12280, adopted September 26,
2002, the Capital Improvements Appropriations Ordinance, is
amended in the following particulars:l/

Section 1. The herein appropriations are hereby made
for implementation of all municipal capital improvements of
the City of Miami, including new capital improvement
projects scheduled to begin during Fiscal Year 2003. The
herein appropriations which are hereby designated by
reference to descriptive project title and number also
include appropriations for previously approved scheduled
projects as well as reappropriat ions of prior funds. The
sources of revenues to support the herein appropriations are
hereby identified by fund and project in ten Capital Funds,
as follows:

Section 3. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this Ordinance
are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.

Section 5. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon further grounds of the necessity to make the required and
necessary payments to its employees and officers, payment of its
debts, necessary and required purchases of goods and supplies and
to generally carry on the functions and duties of municipal
affairs.
Section 6. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths (4/5ths) of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.V
2/ This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.

RECOMMENDATION
It is respectfully requested that the City Commission approve the attached amendment to the
Capital Projects Appropriations Ordinance No. 12280, as amended, adopted on September
26, 2002.
BACKGROUND
The proposed amendment ordinance is for the appropriation of an additional $580,000 from
the unallocated Homeland Defense/Neighborhood Improvement Bonds. The funds will be
utilized to perform environmental cleanup and removal of materials at the Fern Isle site
located at 2201 NW 11 Street as mandated by Miami -Dade County Department of
Environmental Resources Management ("DERM")
The City received a notice from DERM extending the required compliance timeframe to
August 2003. The proposed project duration time is approximately seventeen (17) weeks.
Therefore, it is critical to have the funding appropriated to proceed with this work.
A separate resolution awarding a contract for the project has been scheduled as a companion
item to this amendment ordinance.

Dear Commissioner Gonzalez:
This letter serves as the Miami River Commission's (MRC) "official
statement" to the City Commission, requested in City Resolution 00-
320, regarding March 27, 2003 City Commission agenda items 7, 18 &
31, which impact the Miami River corridor.
The MRC recommends approval of agenda item 7, accepting and
remediating the property located 1431 NW 17th Street, and item 31,
authorizing additional environmental testing in the Wagner Creek area.
These are positive steps towards remediating contamination in and
adjacent to Wagner Creek.
In addition, the MRC recommends approval of agenda item 18,
authorizing the cleanup and removal of materials from Fern Isle Park,
located at 2201 NW 11 Street. The clean up of Fern Isle Park, located
on the Miami River's south fork, is a recommendation of our adopted
strategic plan, the Miami River Corridor Urban Infill Plan.
