ORDINANCE NO. 12331
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 11000; AS AMENDED,
THE ZONING ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, BY AMENDING ARTICLE 9, SECTION 917,
BY INTRODUCING NEW SUBSECTION 917.14
ENTITLED "PARKING LIFTS" TO ALLOW PARKING
LIFTS CONDITIONALLY WITHIN CERTAIN ZONING
DISTRICTS, AND ADDING CRITERIA FOR THE
IMPLEMENTATION OF SUCH PARKING; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of December 18, 2002 Item No. 12, following an advertised
hearing, adopted Resolution No. PAB 100-02 by a vote of six to
zero (6-0), RECOMMENDING APPROVAL of amending Zoning Ordinance
No. 11000 as hereinafter set forth; and
WHEREAS, the City Commission after careful
consideration of this matter deems it advisable and in the best
interest of the general welfare of the City of Miami and its
inhabitants to amend Ordinance No. 11000 as hereinafter set
forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is amended by amending
the text of said Ordinance as follows:l'
"ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec. 917. Offstreet parking requirements, general
provisions.
The following general requirements, limitations, and
standards shall apply to offstreet parking:
917.14. Parking Lifts.
For the purposes of this section, "Parking Lifts"
shall be defined as an electro -hydraulic mechanism
that lifts a parked vehicle to make space available to
park a vehicle below it in a vertical tandem fashion.
Where parking of vehicles is to be located within a
garage structure, excluding the R-1 and R-2 zoning
districts, a mechanical parkinq lift system, as

defined herein, shall' be permissible pursuant to a
Class II Special Permit, subject to the following
criteria:

Such parking shall be located within the
garage
so that a visual barrier is in place to
screen

the parking from pedestrian view;

Due to the stacked nature of this form
of
parking, when it is being used for residential
purposes, the sharing of parking in this
sort of
vertical tandem fashion shall only be
allowed
for residents within the same unit
(i.e.

spouses, roommates, etc.)
All proposed key switch mechanisms shall be
spring loaded for safety purposes.
Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the, remaining provisions of this Ordinance shall not be
affected.

Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.'
PASSED ON FIRST READING BY TITLE ONLY this 23rd day of
Janaury 2003.
This Ordinance shall become effective as specified herein
unless vetoed by the Mayor within ten days from the date it
was passed and adopted. If the Mayor vetoes this Ordinance,
it shall become effective immediately upon override of the
veto by the City Commission or upon the effective date stated
herein, whichever is later.

PETITION Consideration of amending Ordinance No. 11000, as
amended, the Zoning Ordinance of the City of Miami,
Florida, by amending Article 9, Section 917, by
introducing a new subsection 917.14 entitled Parking
Lifts, in order to allow parking lifts conditionally within
certain zoning districts, and adding criteria for
implementation of such forms of parking.
PLANNING
RECOMMENDATION Approval.
BACKGROUND AND
ANALYSIS The proposed ordinance is in order to allow parking lifts
(as defined in the attached ordinance) as an alternative
method of providing required parking within garage
structures. Parking lifts allow for a form a vertical
tandem spaces to be accommodated within a garage
that will in tum allow garage structures to be smaller
while still accommodating the same number of vehicles.
In order to ensure no problems arise from vertical
tandem sharing, the Planning and Zoning Department is
recommending approval of this amendment subject to
Class II Special Permits and the criteria listed in the
attached ordinance. This form of parking will also be
prohibited in R-1 and R-2 districts due to potential noise
that may be associated with mechanical lifts.
