AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 12280, AS AMENDED, THE CAPITAL PROJECTS APPROPRIATIONS ORDINANCE, TO REVISE CERTAIN ONGOING CAPITAL IMPROVEMENT PROJECTS ("CIP") FOR FISCAL YEAR 2003 BY INCREASING FUNDS FOR STRATEGIC INITIATIVES, THE RESTORATION OF THE MIAMI HIGH SCHOOL BUNGALOW, AND THE STORM_ WATER UTILITY TRUST FUND PROJECT ENTITLED "NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM"; CONTAINING A REPEALER PROVISION, AND A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Ordinance No. 12280, as amended, the Capital Improvements Appropriations Ordinance, was adopted on September 26, 2002; and WHEREAS, it is necessary to revise Capital Improvements Program ("CIP") Project No. 311047, entitled "Efficiency Improvement Studies," to reflect Fiscal Year 2002-2003 Operational Budget appropriations from the Strategic Initiatives and General Fund Accounts; and WHEREAS, additional funding in the amount of $100,000 has been identified for the restoration of the Miami High School Bungalow from CIP Project No. 327001, entitled "Historic Preservation Initiatives"; and 1231 WHEREAS, it is necessary to increase Stormwater Utility Trust Fund appropriations in CIP Project No. 352277, entitled "National Pollutant Discharge Elimination System" ("NPDES"), for equipment needed to perform the functions of the NPDES Division of the Department of Municipal Services; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 12280, as, amended, adopted September 26, 2002, the Capital Improvements Appropriations Ordinance, is amended in the following particulars:!/ "Ordinance No. 12280 Section 1. The herein appropriations are hereby made for implementation of all municipal capital improvements of the City of Miami, including new capital improvement projects scheduled to begin during Fiscal Year 2003. The herein appropriations which are hereby designated by reference to descriptive project title and number also include appropriations for previously approved scheduled projects as well as reappropriations of prior funds. The sources of revenues to support the herein appropriations are hereby identified by fund and project in ten Capital Funds, as follows: �i Words and/or figures stricken through shall be. deleted. All ordinances or parts of ordinances, insofar as they are in conflict with provisions of this Ordinance are repealed. Page 3 of 5 12316 Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor./ a/ This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND The proposed revisions include $100,000 from the capital project revolving account to complete funding for the restoration of the Miami High School Bungalow. The stormwater utility trust funds in CEP No. 352277, National Pollutant Discharge Elimination System, are being increased by $123,000 for equipment acquisition for the NPDES function in the Department of Municipal Services. The Strategic Initiatives and General Fund line items in CIP No. 311047, Efficiency Improvement Studies, are also being revised to reflect appropriations in the FY2003 Operational Budget.
