Subject: Reclassification - Fire Protection Engineer Vacancy - Fire Rescue
Purpose of Item:
A Resolution authorizing the City Manager to approve the reclassification and
subsequent filling of one (1) Fire Protection Engineer vacancy in the Department of Fire -
Rescue ("Fire") to that of Senior Fire Protection Engineer ("SFPE"), as required
pursuant to Resolution No. R-21-0402 and Resolution No. R-21-0408.
Background of Item:
The mission of the Fire Prevention Bureau of the Department of Fire Rescue ("Fire") is
to provide the residents, visitors, and businesses of the City of Miami with professional,
knowledgeable, and experienced personnel to ensure that all structures contain
functional fire protection and life safety features, where required. To help achieve this
mission, Fire wishes to reclassify one (1) Fire Protection Engineer vacancy to that of a
Senior Fire Protection Engineer who shall serve as a high-level supervisor responsible
for overseeing the work of a team of professional engineers and technical personnel
involved in the review, analysis, approval, and/or disapproval of complex design
documents to include building construction, fire detection/alarm, fire sprinkler, smoke
control, water storage/distribution, and pre-engineered fire protection systems for
compliance with applicable ordinances, codes, standards, and engineering principles.
As per Florida Statute 553.80, the salary for this position shall be 100% funded by the
Building Reserve Fund.

A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO APPROVE THE RECLASSIFICATION OF ONE (1) FIRE
PROTECTION ENGINEER VACANCY IN THE DEPARTMENT OF FIRE -RESCUE
("FIRE") TO THAT OF SENIOR FIRE PROTECTION ENGINEER, AS REQUIRED
PURSUANT TO RESOLUTION NO. R-21-0402 ADOPTED SEPTEMBER 23, 2021
AND RESOLUTION NO. R-22-0371 ADOPTED SEPTEMBER 22, 2022, THEREBY
INCREASING THE ANNUAL FISCAL IMPACT TO THE BUILDING RESERVE FUND
BY AN ESTIMATED $13,156.00-1 FURTHER AUTHORIZING THE CITY MANAGER TO
MAKE ANY NECESSARY CHANGES TO ADJUST, AMEND, AND APPROPRIATE
THE FISCAL YEAR 2022-2023 OPERATING BUDGET, FIVE-YEAR FINANCIAL PLAN,
STRATEGIC PLAN, AND MULTI -YEAR CAPITAL PLAN REGARDING CITY
SERVICES AND RESOURCES AS NECESSARY, LEGALLY ALLOWED, AND
APPLICABLE IN ORDER TO CREATE AND FILL SAID POSITION FOR FIRE;
RATIFYING, APPROVING, AND CONFIRMING CERTAIN NECESSARY ACTIONS OF
THE CITY MANAGER AND DESIGNATED CITY DEPARTMENTS TO UPDATE THE
RELEVANT FINANCIAL CONTROLS, PROJECT CLOSE-OUTS, ACCOUNTING
ENTRIES, AND COMPUTER SYSTEMS; PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, on October 1, 2021, pursuant to Resolution No. R-21-0408, the City
Commission modified and amended the City of Miami's ("City") Adopted Budget and the Capital
Plan for Fiscal Year 2021-22 as follows: (i) notwithstanding the language in Resolution No. R-
21-0402, including but not limited to the language in Section 16 of Resolution No. R-21-0402, in
order for the creation of or change in temporary or permanent positions in the Department of
Fire -Rescue ("Fire") to be effective, the City Commission must first confirm the creation or
change of such positions by an affirmative vote, and (ii) requiring that, notwithstanding anything
in Resolution No. R-21-0402 or the Capital Plan to the contrary, an affirmative vote of the City
Commission is required prior to any and all movements of monies that are different from the line
item -budgets' approved amounts as adopted on September 13, 2021 for the Capital Plan and
as adopted on September 23, 2021 for Resolution No. R-21-0402, for the departmental budgets
of Fire (the "Restriction"); and
WHEREAS, on June 23, 2022, the City Commission modified the Restriction pursuant to
Resolution No. R-22-0230 so that the portion pertaining to movements of monies would only
apply to movements of monies in excess of one hundred thousand dollars ($100,000.00) while
the rest of the Restriction would apply unmodified; and
WHEREAS, on September 22, 2022, the City Commission adopted the Final Budget for
Fiscal Year 2022-2023 pursuant to Resolution No. R-22-0371, which incorporated the
Restriction as modified through Resolution No. R-22-0230; and
WHEREAS, the Senior Fire Protection Engineer ("SFPE") shall serve as a high-level
supervisor responsible for overseeing the work of a team of professional engineers and
technical personnel involved in the review, analysis, approval, and/or disapproval of complex
design documents to include building construction, fire detection/alarm, fire sprinkler, smoke
control, water storage/distribution, and pre-engineered fire protection systems for compliance
with applicable ordinances, codes, standards, and engineering principles; and
WHEREAS, the SFPE will be expected to utilize sound and extensive judgment in
anticipating and solving unprecedented engineering problems, determining program objectives
and requirements, organizing projects and programs, and developing standards and guidelines
for the activities of the Fire Protection Engineering Section within Fire; and
WHEREAS, acquiring a SFPE is a critical component to the success of Fire's mission to
provide the residents, visitors, and businesses of the City with professional, knowledgeable, and
experienced fire prevention personnel to ensure that all structures contain functional fire
protection and life safety features, where required; and
WHEREAS, the salary of the SFPE shall be 100% funded by the Building Reserve Fund;
and
WHEREAS, it is in the best interests of the City to authorize the City Manager to make
any and all necessary changes to adjust, amend, and appropriate the City's Operating Budget,
Five -Year Financial Plan, Strategic Plan, and Multi -Year Capital Plan regarding City services
and resources as necessary, legally allowed, and applicable in order to create and fill the SFPE
position; and
WHEREAS, it is also in the best interests of the City to ratify, approve, and confirm
certain necessary actions of the City Manager and designated City departments to update the
relevant financial controls, project close-outs, accounting entries, and computer systems.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to approve the reclassification and
subsequent filling of one (1) Fire Protection Engineer vacancy in Fire to that of Senior Fire
Protection Engineer, as required pursuant to Resolution No. R-21-0408, adopted October 1,
2021, as modified by Resolution No. R-22-0230, adopted June 23, 2022, and incorporated into
Resolution No. R-22-0371, adopted September 22, 2022.
Section 3. The City Manager is further authorized' to make any necessary changes to
adjust, amend, and appropriate to the Fiscal Year 2022-23 Operating Budget, Five -Year
Financial Plan, Strategic Plan, and Multi -Year Capital Plan regarding City services and
resources as necessary, legally allowed, and applicable in order to create and fill said position
for Fire.
Section 4. Certain necessary actions by the City Manager and the designated City
departments to update the relevant financial controls, project close-outs, accounting entries, and
computer systems are hereby ratified, approved, and confirmed.
' The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
