(the "Applicant") in connection with a request to rezone two parcels in the City of Miami located at 1960 and 1970 NW 27th Avenue (the "Property"). The Applicant has filed an application under PZ-22-11948 with the City of Miami requesting a change to the Future Land Use Map designation of the Property from Industrial to Restricted Commercial and companion application under PZ-22-11949 to rezone the Property from D-1 to T6-12 (the "Application"). We are providing additional supportive information that has been uncovered about relevant prior development approvals for the Property. The Property as depicted in the aerial below consists of two contiguous platted lots located on the north side of the Miami River, immediately west of NW 27 Avenue and south of NW North River Drive. The Property is identified by tax folio number numbers 01-3133-007-0030 and 01-3133- 007-0020. In total, the Property consists of 90,005 square feet (±2.06 acres). Ordinance I100 Zoning and previous Multifamily Development Approvals Prior to the adoption of Miami 21 Code, under the Zoning Atlas for Ordinance 1100, the Property was zoned Liberal Commercial "C-2." Ordinance 1100 Zoning Atlas Designation for Property The C-2 District permitted multi -family development subject to approval of a Special Exception. Specifically, Section 401, Ordinance 1100, Conditional Principal Uses in the C-2 District, permitted "multifamily residential structures of a density equal to R-3 or higher] subject to the following criteria by Special Exception, upon finding that: a. The proposed site's proximity to other residentially zoned property makes it a logical extension or continuation of existing residential development; and b. Adequate services and amenities exist in the adjacent area to accommodate the needs of potential residents. In 2003, the Miami Zoning Board ("ZB") approved Resolution N-2003-0694, a Special Exception for a Multifamily development at a high density equal to R-4 (150 dwelling units per acre). Under the procedures of Ordinance 1100, projects approved via Special Exception approvals were required to obtain a building permit within one (1) year. A copy of the approval is submitted with this letter. It is also recorded in the public records at Official Records Book 21239 at Page 3165. Due to the financial constraints associated with the environmental remediation of the Property, the developers of the project were unable to obtain financing and file for a building permit for the multifamily development. As part of the process to address the environmental contamination issues of the property, the prospective developer and the current owner pursued a brownfield designation. On June 24, 2004, 1 R-3 Zone permitted a residential density of up to 65 du/acre; R-4 permitted a residential density of up to 150 du/acre. Maximum height in C-2 was 120 ft; FAR 1.72 gross lot area (including 1/2 of abutting rights of way). 2 #180009205_vl the Miami City Commission passed Resolution No. 04-00635, expanding the boundaries of the City's Brownfield Areas to include the Property at the request of Aguaclara, LTD. Aguaclara, LTD was a subsidiary of The Pinnacle Housing Group, a multifamily residential developer. With a better grasp of the environmental remediation risks, the contract purchasers, Aguaclara LTD, Filed a new Special Exception application with the City to approve a redesigned multifamily residential development under the C-2 zoning. On September 14, 2024, the Miami Zoning Board approved Resolution 2004-0922, a Special Exception to permit a multifamily development at a R- 4 high density (150 du/acre) and a parking variance to reduce the 363 required offstreet parking spaces by 83 spaces. The Zoning Board approved the Special Exception and the Variance by a vote of 9 - 0 (1 member was absent). The project was ultimately not built for a number of reasons including the environmental remediation risk and liability. Resolution 2004-0922 is included with this submittal. The importance of these two approvals cannot be diminished because both approvals required a determination that (a) the Property's proximity to other residentially zoned property make it a logical extension or continuation of existing residential development; and (b) adequate services and amenities exist in the adjacent area to accommodate the needs of potential residents. These two factors have not changed. In fact, the Property is more suitable for multifamily development today than it was in 2004, more than 18 years ago. Approximately 6 years ago, the NW 20th Street corridor in Allapattah was rezoned by the City of Miami from D1 to T6 to encourage and promote more urbanistic development. The rezoning of this area sought to incentivize sound, well planned urban projects, and the elimination of undesirable and incompatible industrial uses New developments to the east, including River Landing and the Miami Produce Special Area Plan are an indication that the development trend of the area is not light industrial. More specifically, this Property has remained vacant and continues to be contaminated. Based on the prior City determination that multifamily development on the Property is appropriate, this request continues to be consistent. Furthermore, the request will follow the neighboring trend to designate parcels both along the Miami River and adjacent to the Property for mixed use designations in an effort to develop a balanced mix of uses located within walking distance to each other. Rezoning of the Property to a category that permits mixed use multifamily will also establish a suitable transect next to the River Park neighbors to the east, across NW 27 Avenue. Development on the Property will have to comply with the Waterfront Standards in Appendix B of the Miami 21 Code as well as the requirements in the Comprehensive Plan Requirements in Policy PA-3.1.3 for Category "B" properties. Specifically the "City shall require that any residential development with a density greater than duplex residential or any mixed use development include Working Waterfront use component per Ch. 342.07, F.S. or other amenities that is [sic] accessible to the public which promotes the enjoyment of the Miami River. (Miami Neighborhood Comprehensive Plan, Policy PA-3.1.3, emphasis added). Lastly, the residential density, height, floor lot ratio of the T6-12 transect will permit the development of a project that can offset the financial cost of environmental remediation. Just as important, the Applicant plans to develop the site with workforce and/or affordable housing. The City and County overall is in a housing crisis and construction of new housing options for our working residents is an overriding priority for all. The request to zone the Property to T6-12 O is justified because the site is also governed by height restrictions from the Miami Dade Aviation 3 #180009205_vl Department limiting structures to 150' in height and abuts property zoned T-3R which will prevent the use of benefit height or benefit FAR.
