JACOBS JR. TO SERVE AS THE EXECUTIVE DIRECTOR OF THE CIVILIAN INVESTIGATIVE PANEL, AS SET FORTH IN CIP RESOLUTION NO. 22-005, EFFECTIVE OCTOBER 18, 2022, PURSUANT TO SECTION 51(B) OF THE CHARTER OF THE CITY OF MIAMI, AS AMENDED, SUBJECT TO ADHERENCE OF ALL CITY OF MIAMI POLICIES AND PROCEDURES DURING THE TERM OF APPOINTMENT. SPONSOR(S): Mayor Francis X. Suarez, Commissioner Christine King WHEREAS, the Civilian Investigative Panel ("CIP") serves as an independent oversight panel with authority to conduct investigations related to allegations of misconduct committed by sworn officers of the City of Miami ("City") Police Department ("MPD"), review policies and procedures of the City's police department, and authorized to issue subpoenas in the course of their investigations; and WHEREAS, section 51(B) of the Charter of the City of Miami, Florida, as amended ("Charter"), provides that the CIP shall be staffed with professional personnel, including an executive director who shall serve as chief executive officer of whom shall be appointed by and subject to removal by the CIP with the approval of the City Commission; and WHEREAS, section 11.5-34(a)(1) of the Code of the City of Miami, Florida, as amended ("City Code"), provides that the CIP office shall be headed by a full-time professional executive director, with certain qualifications, who is appointed by and subject to removal by the CIP, with the approval of the City Commission, to serve as the CIP's chief executive officer and shall oversee the operations of the CIP and perform specific duties; and WHEREAS, in April 2022, the CIP created a Search Committee in accordance with its bylaws to initiate a national search for an executive director; and WHEREAS, the Search Committee convened on various occasions to consider and interview numerous applicants; and WHEREAS, on August 5, 2022, the Search Committee selected Mr. Rodney W. Jacobs, Jr. ("Mr. Jacobs") from the list of qualified applicants for executive director and moved to recommend the appointment of Mr. Jacobs as executive director to the members of the CIP; and WHEREAS, on October 18, 2022, the members of the CIP adopted CIP Resolution No. 22-005, selecting Mr. Jacobs to serve as the CIP's executive director and approving the terms of compensation and emoluments as set forth in "Attachment A" to CIP Resolution No. 22-005, attached and incorporated; and City of Miami Page 1 of 2 File ID: 12884 (Revision:) Printed On: 121712022 File ID: 12884 Enactment Number: R-22-0461 WHEREAS, the executive director is an employee of the CIP therefore the terms of employment are determined by the members of the CIP; and WHEREAS, the CIP finds that the employment term sheet is fair and provides reasonable compensation for Mr. Jacobs to serve as executive director, subject to adherence with all City policies and procedures during the term of his appointment; and WHEREAS, the CIP is operated on an annual budget that shall be no less than one percent of the approved regular salaries and wages line item of the MPD general fund budget to allow the CIP to maintain its independence and perform its Charter mandated functions with sufficient professional staff while taking into account the City Manager's declaration of a fiscal emergency, a financial urgency, or financial emergency; and WHEREAS, the CIP has offered and Mr. Jacobs has accepted the appointment as CIP Executive Director; and WHEREAS, the CIP finds that it is in its best interest for the City Commission to approve the appointment of Mr. Jacobs as the CIP's executive director and approve the terms of compensation and emoluments as set forth in CIP Resolution No. 22-005; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are incorporated as if fully set forth in this Section. Section 2. The CIP's appointment of Mr. Jacobs to serve as executive director of the CIP, effective October 18, 2022, as set forth in CIP Resolution No. 22-005, are approved, pursuant to Section 51(B) of the Charter, subject to adherence of all City policies and procedures during the term of appointment. Section 3. This Resolution shall be effective immediately upon its adoption.
