Background of Item: Pursuant to Resolution No. 20-0382 on November 19, 2020, City Commission approved a transfer of CDBG Economic Development funds for fiscal year 2020-2021 in the total amount of $2,287,998.20, which included an amount of $494,208.00 to Department of Parks and Recreation for park construction in District 3. The park construction activity did not take place and the funds remain available to be used -land On September 23, 2021, pursuant to Resolution No. R-21-0387 the City Commission approved an allocation of $3,098,006.65 in CDGB funds for economic development activities, which included an amount of $2,070,707.99 to Department of Housing and Community Development to be allocated to economic development activities. There is an unallocated amount of $305,792.00 that represents the economic development funds earmarked for Districts 3, that is required to be allocated and spent. District 3 desires to transfer the amount of $494,208.00 funds from fiscal year 2020-21 and the unallocated amount of $305,792.00 from CDBG economic development category from fiscal year 2021-22 to the Department of Parks and Recreation Department for eligible park improvements activities in the District. The City's Administration recommends the allocation of CDBG funds in the total amount of $800,000.00 from fiscal year 2020-21 and 2021-22 in the economic development category, to the Department of Parks and Recreation to be used for park improvement activities. WHEREAS, pursuant to Resolution No. 20-0382, adopted on November 19, 2020, the City Commission approved a transfer of CDBG Economic Development funds for Fiscal Year (TY") 2020-2021 in the total amount of $2,287,998.20, which included an amount of $494,208.00 allocated to Department of Parks and Recreation ("Parks Department") for park construction in District 3; and WHEREAS, the park construction activity did not take place and the funds remain available to be used; and WHEREAS, on September 23, 2021, pursuant to Resolution No. 21-0387, the City Commission approved an allocation of $3,098,006.65 in CDGB Economic Development funds for FY 2021-2022, which included an amount of $2,070,707.99 to Department of Housing and Community Development to be allocated for economic development activities; and WHEREAS, there is an unallocated amount of $305,792.00 that represents a portion of the CDBG Economic Development funds earmarked for District 3 for FY 2021-2022, that must be allocated and spent; and WHEREAS, the District 3 Commissioner desires to transfer the amount of $494,208.00 in CDBG Economic Development funds from FY 2020-2021 and the unallocated amount of $305,792.00 in CDBG Economic Development funds from FY 2021-2022 to the Parks Department for eligible park improvements activities in District 3; and WHEREAS, the City's Administration recommends the allocation of CDBG funds in the total amount of $800,000.00 from FY 2020-2021 and FY 2021-2022 in the Economic Development category, to the Parks Department to be used for park improvement activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The transfer of CDBG funds in the economic development category in the total amount of $800,000.00 from District 3, from FY 2020-2021 and FY 2021-2022, to the Parks Department to be used for park improvement activities in District 3, as described in Exhibit "A", attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. Z If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
