HomeMy WebLinkAboutR-22-0393City of Miami Resolution R-22-0393 alldl 11 li.Rl I + Legislation File Number: 12437 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 10/13/2022 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT ("CDBG") FUNDS IN THE AMOUNT OF $800,000.00 IN THE ECONOMIC DEVELOPMENT CATEGORY FROM DISTRICT 3 TO THE DEPARTMENT OF PARKS AND RECREATION TO BE USED FOR PARK IMPROVEMENT ACTIVITIES IN DISTRICT 3, AS DESCRIBED IN EXHIBIT "A", ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 20-0382, adopted on November 19, 2020, the City Commission approved a transfer of CDBG Economic Development funds for Fiscal Year (TY") 2020-2021 in the total amount of $2,287,998.20, which included an amount of $494,208.00 allocated to Department of Parks and Recreation ("Parks Department") for park construction in District 3; and WHEREAS, the park construction activity did not take place and the funds remain available to be used; and WHEREAS, on September 23, 2021, pursuant to Resolution No. 21-0387, the City Commission approved an allocation of $3,098,006.65 in CDGB Economic Development funds for FY 2021-2022, which included an amount of $2,070,707.99 to Department of Housing and Community Development to be allocated for economic development activities; and WHEREAS, there is an unallocated amount of $305,792.00 that represents a portion of the CDBG Economic Development funds earmarked for District 3 for FY 2021-2022, that must be allocated and spent; and WHEREAS, the District 3 Commissioner desires to transfer the amount of $494,208.00 in CDBG Economic Development funds from FY 2020-2021 and the unallocated amount of $305,792.00 in CDBG Economic Development funds from FY 2021-2022 to the Parks Department for eligible park improvements activities in District 3; and WHEREAS, the City's Administration recommends the allocation of CDBG funds in the total amount of $800,000.00 from FY 2020-2021 and FY 2021-2022 in the Economic Development category, to the Parks Department to be used for park improvement activities; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The transfer of CDBG funds in the economic development category in the total amount of $800,000.00 from District 3, from FY 2020-2021 and FY 2021-2022, to the Parks Department to be used for park improvement activities in District 3, as described in Exhibit "A", attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 i ria i �-nde` z, City Attor iey 11/18/2022 ' The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
