Subject: Donation - Police Vehicle Partitions - Village of Biscayne Park PD
Purpose of Item:
A Resolution of the Miami City Commission, pursuant to Section 18-82(a) of the Code of
the City of Miami, Florida, as amended ("City Code"), classifying two used police vehicle
cages as Category "A" stock surplus; authorizing the donation of said police vehicle
cages to the Village of Biscayne Park Police Department for use by their department to
increase officers safety; authorizing the City Manager to negotiate and execute any and
all documents, in forms acceptable to the City Attorney, and in compliance with all
applicable laws, rules, and regulations, as may be deemed necessary for said purpose.
Background of Item:
The Village of Biscayne Park Police Department ("Village") reached out to the City of
Miami ("City") Police Department ("Police") requesting assistance via the donation of
needed police vehicle cages for their police vehicles. The Village acknowledged that
these are used police vehicle cages that are no longer in service/use by the City's police
department. The City's Chief Procurement Officer has declared the attached list of said
police vehicle cages as Category "A" stock surplus. Pursuant to Section 18-82(a) of the
Code of the City of Miami, Florida, as amended ("City Code"), Category "A" stock
surplus shall be available for disposition as the City's contribution or commitment in
support of a particular public purpose which may include those community, civic, or
social service programs as may be authorized by the City Commission. The Village, a
municipality within Miami -Dade County endeavors to heighten their officers' safety and
is therefore qualified to receive Category "A" stock surplus from the City. The City
Manager recommends adoption of this Resolution allowing for the donation of these
police vehicle cages to the Village.

A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTION 18-
82(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,
CLASSIFYING TWO (2) USED POLICE VEHICLE PARTITIONS AS CATEGORY "A"
STOCK SURPLUS; AUTHORIZING THE DONATION OF SAID POLICE VEHICLE
PARTITIONS TO THE VILLAGE OF BISCAYNE PARK POLICE DEPARTMENT FOR
USE BY THEIR DEPARTMENT TO INCREASE OFFICER SAFETY DURING
PRISONER TRANSPORTS; AUTHORIZING THE CITY MANAGER TO NEGOTIATE
AND EXECUTE ANY AND ALL DOCUMENTS, IN FORMS ACCEPTABLE TO THE
CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES,
AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR THE DONATION OF
THE POLICE VEHICLE PARTITIONS FOR SAID PURPOSE.
WHEREAS, the Village of Biscayne Park ("Biscayne Park") Police Department
("Biscayne Park PD") contacted the City of Miami ("City") Police Department ("MPD") to
inquire about the availability of MPD's outdated police vehicle partitions that may be
suitable for use by the Biscayne Park PD for their police vehicles; and
WHEREAS, MPD has identified two (2) police vehicle partitions within its used
inventory that are compatible for use in 2013-2014 Ford Interceptor police vehicles that
are no longer in MPD's fleet of patrol vehicles; and
WHEREAS, the Biscayne Park PD is aware and has acknowledged that these
are used police vehicle partitions no longer in service by the MPD, willing to accept
them "as is" and compatible with Biscayne Park PD patrol vehicles; and
WHEREAS, the City's Chief Procurement Officer has declared two (2) police
vehicle partitions qualify as Category "A" Stock surplus; and
WHEREAS, pursuant to Section 18-82(a) of the Code of the City of Miami,
Florida, as amended ("City Code"), Category "A" Stock surplus shall be available for
disposition as the City's contribution or commitment in support of a particular public
purpose which may include those community, civic, or social service programs as may
be authorized by the City Commission; and
WHEREAS, Biscayne Park, a municipality within Miami -Dade County, endeavors
to increase their officers' safety when transporting subjects that have committed a crime
and is therefore qualified to receive Category "A" Stock surplus from the City; and
WHEREAS, the City Manager recommends adoption of this Resolution to
classify said police vehicle partitions as Category "A" Stock to allow for the contribution
of the items to the Biscayne Park PD;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution
are adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-82(a) of the City Code, as amended,
classifying two (2) used police vehicle partitions as Category "A" Stock surplus, is
hereby authorized.'
Section 3. The donation of said police vehicle cages to the Biscayne Park PD is
hereby authorized.'
Section 4. The City Manager is authorized' to negotiate and execute any and all
documents, in forms acceptable to the City Attorney, and in compliance with all laws,
rules, and regulations, as may be deemed necessary for the donation of the police
vehicle partitions for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption.
The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to those prescribed by applicable City Charter and City Code
provisions.
