Proposed Amendment to Section 54-138 of the Code of the City of Miami,
Florida to remove expenses related to the noticing of the sunsetted Miami
Street Codesignation Review Committee

The attached proposed ordinance seeks to amend Section 54-138 of the Code of
the City of Miami, Florida, as amended, to remove language related to the noticing of
the Miami Street Codesignation Review Committee that was sunsetted by the City
Commission pursuant to Ordinance No. 12980, on April 10, 2008.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
54/ARTICLE IV/SECTION 54-138 OF THE CODE OF THE CITY OF MIAMI, FLORIDA,
TITLED "STREETS AND SIDEWALKS/NAMING OF STREETS AND NUMBERING OF
BUILDINGS/EXPENSES", TO REMOVE REQUIREMENTS RELATED TO A
SUNSETTED BOARD; CONTAINING A SEVERABILITY CLAUSE; PROVIDING FOR
AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 12980, adopted on April 10, 2008, the City
Commission sunsetted the Miami Street Codesignation Review Committee ("Committee"); and
WHEREAS, this proposed Ordinance seeks to remove expenses related to the noticing
of the Committee that remain in Section 54-138 of the Code of the City of Miami, Florida, as
amended ("City Code") at the time the Committee was sunsetted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 54, Article IV of the City Code is amended in the following
particulars:'
"CHAPTER 54
STREETS AND SIDEWALKS
ARTICLE IV. NAMING OF STREETS AND NUMBERING OF BUIDLINGS
Sec. 54-137. Street codesignation.
The city commission shall consider proposals for street codesignation using the following
criteria:
(1) Named streets, e.g., as in Coconut Grove, shall not be changed where there is an
historical tradition attached to the existing name.
(2) Named streets shall not be codesignated because of the resulting confusion.
(3) Numbered streets shall not be codesignated for merely commercial purposes.
' Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be
added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and
unchanaed material.

(4) Numbered streets shall only be codesignated if there is significant historical,
neighborhood or community benefit to the codesignation.
(5) Numbered street codesignations shall not exceed five blocks in length.
(6) There shall be a hiatus at least five blocks in length between consecutive codesignations
in numbered streets.
(7) Numbered streets shall not be codesignated with the names of living individuals. This
provision can be waived by four votes of the city commissioners.
(8) Block numbers shall be added to any new street signs that reflect codesignations,
markers or plazas.
Sec. 54-138. Expenses.
(a) Any and Aall expenses on the part of the city or any other governmental agency
resulting from requests for street codesignations, markers or plazas shall be borne by
the applicant.
(b)
the appli aPA Upon approval by the city commission of a request for street
codesignation or a marker or a plaza, the applicant shall pay any and all additional
expenses related to the permits, manufacture and installation of the appropriate signs
and related appurtenances. A nonrefundable deposit in the amount of $400.00 toward
the initial expenses outlined in this section shall accompany any request for a street
codesignation or for a designation of a marker or a plaza.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately upon its adoption and
signature of the Mayor.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
