AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
12.5/ARTICLE I/DIVISION 3/SECTION 12.5-44 OF THE CODE OF THE CITY
OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), TITLED "COMMUNITY
REVITALIZATION/COMMUNITY REVITALIZATION DISTRICTS/LITTLE HAITI
REVITALIZATION TRUST/GOVERNING BODY -COMPOSITION AND
APPOINTMENTS; TERMS OF OFFICE AND VACANCIES; MEMBERSHIP
QUALIFICATIONS; PROCEDURES FOR APPOINTMENT OF MEMBERS;
OATH; QUORUM AND VOTING; MEETINGS; ATTENDANCE
REQUIREMENTS; INDEMNIFICATION" TO AMEND THE REQUIREMENTS TO
ALLOW FOR THE APPOINTMENT OF FIRST RESPONDERS TO THE TRUST;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
IMMEDIATE EFFECTIVE DATE.

WHEREAS, Chapter 12.5, Article I, Division 3, Section 12.5-44 of the Code of the City of
Miami, Florida, as amended ("City Code"), establishes the rules and regulations governing
appointments to the Little Haiti Revitalization Trust ("Trust"); and
WHEREAS, the proposed amendment recognizes the commitment Fire Fighters and
Law Enforcement Officers ("First Responders") make to the Little Haiti community by facilitating
the appointment of these First Responders to the Trust;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
hereby adopted and incorporated as if fully set forth in this section.
Section 2. Chapter 12.5, Article I, Division 3, Section 12.5-44 of the City Code is hereby
amended in the following particulars:'
"CHAPTER 12.5
COMMUNITY REVITALIZATION
ARTICLE I. COMMUNITY REVITALIZATION DISTRICTS

DIVISION 3. LITTLE HAITI REVITALIZATION TRUST
Sec. 12.5-44. Governing body -composition and appointments; terms of office and
vacancies; membership qualifications; procedures for appointment of members; oath;
quorum and voting; meetings; attendance requirements; indemnification.
(c) Membership qualifications.
(1) The Little Haiti Trust voting members shall be 18 years of age or
older and broadly reflect the diversity of the community and share
technical, professional expertise, or experiential knowledge and interest in
the residential construction, development, architecture and engineering,
planning, zoning and land use law, economic development, historic
preservation and restoration, administration, fiscal management, or
community involvement. Members shall be subject to section 2-884 of the
City Code. Notwithstanding the requirements herein this Section or Section
2-884(e) of the City Code, Fire Fighters and Law Enforcement Officers may
be appointed to the Little Haiti Revitalization Trust.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
